Why Does eBay Need My SSN? Tax Rules, EIN Option, and Verification

eBay needs your SSN because federal law makes the platform collect it. Two separate legal regimes drive the request: tax law requires eBay to report your sales to the IRS using your taxpayer identification number, and anti-fraud rules require eBay to verify who you are before moving money on your behalf. For most individual sellers, the Social Security Number satisfies both obligations at once, which is why eBay asks for it at registration rather than waiting until you’ve sold enough to trigger a tax form.

The Tax Law Behind the Request

The tax piece comes from Section 6050W of the Internal Revenue Code, added by the Housing and Economic Recovery Act of 2008. For most individuals, that number is the SSN.

The threshold for when eBay must send you and the IRS a 1099-K has moved around in recent years. The American Rescue Plan Act of 2021 lowered it to $600, but the IRS delayed enforcement, and the One, Big, Beautiful Bill has now permanently restored the original level: eBay is required to issue a 1099-K only if your gross payments exceed $20,000 and you have more than 200 transactions in a calendar year.2Internal Revenue Service. Even so, eBay collects the SSN when you sign up. It has no way of knowing whether you’ll sell $50 worth of items or $50,000 worth over the next year, and the compliance clock starts running at registration. One separate point worth keeping in mind: whether you receive a 1099-K only affects paperwork. What Happens If Your SSN Is Wrong or Missing

If the name and SSN you give eBay don’t match IRS records, or if you refuse to provide one, eBay is required to begin backup withholding. It holds back 24% of your gross payments and sends that amount to the IRS as a credit against your eventual tax liability.4Internal Revenue Service. Refusing outright is worse. eBay will not process payouts to a seller whose tax information it doesn’t have. Selling privileges can be restricted, and funds from completed sales sit unavailable. If nothing changes for long enough, eBay may eventually turn the balance over to your state’s unclaimed property program.

Identity Verification and Anti-Fraud Rules

Tax reporting is only half the reason. Because eBay processes payments directly through its managed payments system, it also has to comply with federal identity verification rules aimed at fraud and money laundering.

The Bank Secrecy Act, as expanded by the USA PATRIOT Act, requires covered entities to run Customer Identification Programs. Those programs must collect a name, date of birth, address, and identification number for each customer, and verify identity through risk-based procedures.6FFIEC BSA/AML Manual. The SSN also feeds sanctions screening. The Office of Foreign Assets Control publishes a Specially Designated Nationals list, and U.S. businesses are prohibited from transacting with anyone on it. OFAC guidance says that when a possible match comes up, all available identifying information should be compared against the entry, including tax ID numbers.8Office of Foreign Assets Control. If eBay’s automated systems can’t verify your identity from the SSN alone, it may follow up with a request for additional documents, typically a government-issued photo ID such as a driver’s license or passport, uploaded through a secure link. Payouts can be paused until verification is complete.

Can You Use an EIN Instead

If you run a registered business, an LLC, partnership, or corporation, you can supply an Employer Identification Number as the business tax ID when you set up an eBay business account. The registration process asks for the legal business name, EIN, business address, and identifying information for beneficial owners and directors.9eBay. Registering as a Seller

Here’s the catch: even with an EIN on file for the business, eBay still asks for your personal SSN in the account’s personal information section. The EIN identifies the business for tax reporting. The SSN identifies you as the person behind it. Sole proprietors are a slightly different story. The IRS lets sole proprietors obtain an EIN, but sellers who’ve tried switching their eBay accounts from SSN to EIN have reported problems with payouts and 1099-K issuance. If you sell under your own name as a sole proprietor, providing the SSN is the smoother route.

If You’re Not a U.S. Taxpayer

Non-U.S. sellers on the U.S. marketplace don’t provide an SSN. Instead, you submit Form W-8BEN to the payment settlement entity, identifying yourself as a nonresident alien receiving reportable payments.11Internal Revenue Service. If not, you can apply for an Individual Taxpayer Identification Number (ITIN) with IRS Form W-7, which serves the same verification role for tax purposes.

One detail for sellers with more than one account: eBay combines payment activity across all accounts tied to the same SSN or ITIN when it measures whether the 1099-K threshold has been crossed.12eBay. Tax Information

How eBay Stores the Information

Handing an SSN to any online platform is uncomfortable. eBay’s developer documentation says sensitive data must be encrypted both in transit and at rest using cryptographic algorithms recommended by the National Institute of Standards and Technology.13eBay Developers Program. Data Protection The privacy notice says personal data is kept only as long as necessary for the purposes it describes, then deleted or anonymized, unless a legal obligation such as tax compliance, accounting, auditing, or fraud detection requires longer retention.7eBay. The short version: eBay asks because it has to, and providing an accurate SSN at registration is the cleanest way to avoid backup withholding, frozen payouts, and repeated identity verification requests down the line.
