For most federal excise taxes, the seller pays. The manufacturer, producer, or importer is the party the statute names, and that business calculates the tax and sends it to the IRS. The cost then travels down the supply chain and lands in the retail price, so the buyer carries the economic weight without writing the check. A smaller group of federal excise taxes flips that arrangement and makes the buyer the legally liable taxpayer, with a seller or service provider collecting on the government’s behalf.
Legal Liability Is Not the Same as Who Feels the Cost
Two different questions hide inside “who pays.” Legal liability is about which party the law requires to file the return and hand the money to the government. Economic burden is about whose wallet actually gets lighter.
For the majority of federal excise taxes, the legally liable party is whoever first puts the goods into commerce: the refiner, the distillery, the importer. That business files IRS Form 720 each quarter and keeps records supporting every taxable transaction for at least four years from when the tax was due, paid, or claimed.1Internal Revenue Service. It builds the tax into its wholesale price, the next link marks up from there, and the person at the pump pays a retail number that already contains the tax.
The design is deliberate. Collecting from a few thousand producers is easier than collecting from hundreds of millions of retail sales. The consumer still bears the cost, but rarely sees it.
Excise Taxes Where the Seller Is Liable
These are the ones assessed at production, at removal from a terminal, or at importation, before goods reach a retail shelf. The seller acts as the government’s collection point.
Motor Fuels
Federal fuel taxes generate the biggest share of excise revenue. Gasoline is taxed at 18.3 cents per gallon and diesel at 24.3 cents per gallon, plus 0.1 cent per gallon on each for the Leaking Underground Storage Tank Trust Fund. The tax attaches when fuel leaves a refinery or terminal or enters the country for consumption, which makes the refiner, terminal operator, or importer the liable party.2Office of the Law Revision Counsel. 26 U.S. Code 4081 – Imposition of Tax At the pump, the tax is invisible; it’s simply part of the per-gallon number.
Alcohol and Tobacco

Superfund Chemicals
Manufacturers and importers of certain listed chemicals and chemical substances owe excise taxes that fund hazardous-waste cleanup. Importers of taxable substances have a choice between the IRS-prescribed rate and a rate they calculate themselves based on chemical composition.6Internal Revenue Service. Excise Taxes Where the Buyer Is Liable
A smaller set of federal excise taxes puts the legal obligation on the buyer or end-user. A seller or service provider usually collects the money, but the statute names the customer as the taxpayer. These are the ones where you often see the charge broken out on the receipt.
Air Travel
Domestic airline tickets carry a 7.5% tax on the fare plus $5.30 per domestic flight segment for 2026, with the segment fee indexed to inflation.7Office of the Law Revision Counsel. 26 USC 4261 – Imposition of Tax8Federal Aviation Administration. Federal Telephone Excise Tax
A 3% federal excise tax applies to local telephone service, toll telephone service, and teletypewriter exchange service.9Office of the Law Revision Counsel. 26 USC 4251 – Imposition of Tax The phone company adds it to the monthly bill and sends it to the IRS, but the customer is the liable party. The tax does not apply to bundled mobile plans that do not distinguish between local and long-distance calls, prepaid calling cards, or voice-over-internet service, so its practical reach has narrowed as communications have moved off traditional landlines.
Heavy Highway Vehicle Use Tax
Owners of highway vehicles with a taxable gross weight of 55,000 pounds or more owe an annual use tax filed on IRS Form 2290.10Internal Revenue Service. Indoor Tanning Services
Indoor tanning services carry a 10% excise tax, and the person paying for the service is legally liable. The salon collects the tax at the point of sale and remits it. State and Local Excise Taxes Follow Their Own Rules
State and local governments layer their own excise taxes on top of federal ones, and legal liability turns entirely on the specific state or municipal code. No universal rule applies. Real estate transfer taxes are the clearest illustration: some states put the tax on the seller, others on the buyer, and a few let the parties negotiate the split in the sale contract. Hotel and short-term rental taxes typically make the guest liable while the hotel or rental platform collects and remits, with rates running from a few percent to over 10% depending on jurisdiction. State fuel taxes generally mirror the federal structure, with distributors or wholesalers remitting and the cost flowing to the consumer at the pump; combined state and federal fuel taxes can exceed 70 cents per gallon in some places.
What Happens When Collected Tax Isn’t Handed Over
When a business collects excise taxes from customers and fails to send them to the IRS, that money is treated the same way withheld payroll taxes are — as trust fund money. The IRS can assess the Trust Fund Recovery Penalty against any individual who was responsible for the funds and willfully failed to remit them. “Responsible” is defined broadly and can reach corporate officers, directors, shareholders with authority over finances, and bookkeepers who control disbursements. The penalty equals the full unpaid balance, and the IRS can pursue the individual’s personal assets through liens, levies, and seizures.14Internal Revenue Service. The willfulness standard is lower than most people expect. Deliberate evasion is not required. The IRS treats it as willful if a responsible person knew about the outstanding taxes and chose to pay other creditors instead, a scenario that comes up constantly when a business runs short on cash.14Internal Revenue Service. Exemptions and Credits That Change Who Ends Up Out of Pocket
Not every transaction that looks taxable owes excise tax, and a few carve-outs let buyers recover tax that was already built into the price they paid.
The most practically useful one involves fuel used off-highway. Farmers, construction companies, and other operations that burn diesel or gasoline in equipment that never touches a public road can claim a credit on their income tax return using IRS Form 4136.15Internal Revenue Service. About Form 4136, Credit For Federal Tax Paid On Fuels The credit is dollar-for-dollar against the excise tax paid at the refinery or terminal. Businesses claiming alternative fuel credits also file Form 4136.
Goods manufactured for export can escape the tax if the shipment occurs within six months of title transfer, the contract or purchase document carries the words “for export,” and the seller provides proof the goods left the country.16Acquisition.GOV. 29.202 General Exemptions And importers under the Superfund chemical tax can run their own composition-based calculation instead of using the IRS-prescribed rate, which sometimes produces a lower number for substances with minimal concentrations of the listed chemicals.6Internal Revenue Service.
