Form 941 due dates are April 30, July 31, October 31, and January 31, one for each calendar quarter. Those are the dates the return itself is due. The taxes the return reports have to be deposited on a separate, more frequent schedule, and that’s where most employers get into trouble.
The Four Quarterly Deadlines
Each Form 941 covers one calendar quarter and is due the last day of the month after the quarter ends:
- Q1 (January–March): April 30
- Q2 (April–June): July 31
- Q3 (July–September): October 31
- Q4 (October–December): January 31 of the following year
When a due date lands on a Saturday, Sunday, or legal holiday, it shifts to the next business day.1Internal Revenue Service. Employment Tax Due Dates That matters for two 2026 quarters. October 31, 2026 falls on a Saturday, so the Q3 return is due Monday, November 2, 2026. January 31, 2027 falls on a Sunday, so Q4 is due Monday, February 1, 2027. The April 30 and July 31 deadlines land on weekdays and don’t move.
Ten Extra Days if Your Deposits Were on Time
If you deposited every dollar of tax on time throughout the quarter, you get an extra 10 calendar days past the standard due date to file Form 941.2Internal Revenue Service. Topic No. 758, Form 941, Employers Quarterly Federal Tax Return and Form 944, Employers Annual Federal Tax Return The extension applies automatically. Miss even one deposit during the quarter and it disappears, leaving you with the standard date.
Deposit Deadlines Are Separate
Filing Form 941 is the reporting side. The taxes have to be deposited much more often, and your schedule depends on how much employment tax you reported during a lookback period running from July 1 of the second preceding year through June 30 of the prior year.3Internal Revenue Service. Monthly Depositors
If your total employment taxes during the lookback period were $50,000 or less, you’re a monthly depositor. Taxes accumulated during a calendar month are due by the 15th of the following month.4Internal Revenue Service. Semi-Weekly Depositors
If your lookback liability exceeded $50,000, you deposit on a semi-weekly schedule keyed to your paydays.4Internal Revenue Service. Notice 931 – Deposit Requirements for Employment Taxes
- Payday on Wednesday, Thursday, or Friday: deposit due the following Wednesday.
- Payday on Saturday, Sunday, Monday, or Tuesday: deposit due the following Friday.
The name is a little misleading. You don’t automatically deposit twice a week; you may, depending on when your paydays fall.
The $100,000 Next-Day Rule
Whatever your regular schedule, if you accumulate $100,000 or more in tax liability on any single day, the full amount is due by the close of the next business day.3Internal Revenue Service. All federal employment tax deposits must be made electronically.6Internal Revenue Service. Depositing and Reporting Employment Taxes You can’t mail a check. If you’re new in business, enroll in EFTPS early: activation can take a week or more because the IRS mails a PIN to your business address, and missing a deposit because your enrollment wasn’t finished doesn’t excuse the penalty.
When You File a Different Form Instead
Not every employer follows the quarterly 941 calendar.
- Agricultural employers report wages for farm employees on Form 943, an annual return.2Internal Revenue Service. Topic No. 758, Form 941, Employers Quarterly Federal Tax Return and Form 944, Employers Annual Federal Tax Return
- Very small employers with $1,000 or less in annual employment tax liability may file Form 944 once a year, but only if the IRS notifies them they’re eligible. You can request the switch in writing postmarked by March 15 or by calling 800-829-0115 by April 1.7Internal Revenue Service. Employers: Should You File Form 944 or 941?
- Household employers report employment taxes on Schedule H with their personal return, not on Form 941.
Seasonal Employers and Final Returns
If you only pay wages during part of the year, check the seasonal employer box in Part 3 of every Form 941 you actually file. Otherwise the IRS expects returns for the quiet quarters and will send notices when nothing arrives.8Internal Revenue Service. When a business closes or permanently stops paying wages, file a final Form 941 for the last quarter in which wages were paid and check the final-return box. What Missing a Deadline Costs
Late filing and late deposits are penalized separately. You can owe both at once.
Late Filing
The failure-to-file penalty is 5% of the unpaid tax for each month or partial month the return is late, capped at 25%.10Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax A separate failure-to-pay penalty of 0.5% per month runs on any unpaid balance.11Internal Revenue Service. Late Deposits
Deposit penalties escalate with how late the money arrives:12Internal Revenue Service. Failure to Deposit Penalty
- 1–5 calendar days late: 2%
- 6–15 calendar days late: 5%
- 16 or more days late: 10%
- More than 10 days after an IRS notice demanding payment: 15%
Interest runs from the original due date. Each missed deposit generates its own penalty, so several short deposits in a single quarter can stack.
The IRS can abate these penalties for reasonable cause, meaning you exercised ordinary business care and prudence but still couldn’t comply. A fire, serious illness, or a payroll provider that failed can qualify. Forgetting or not knowing the rule generally doesn’t.
Deadlines for Correcting a Past Return
Errors on a filed Form 941 are fixed with Form 941-X, filed separately for each quarter being corrected.13Internal Revenue Service.
