When Do 1099s Have to Be Mailed to Recipients?

1099 forms have to be mailed or electronically delivered to recipients by January 31 of the year after payment for most form types, with a February 15 deadline for a smaller set of investment and real estate forms. For the 2025 tax year, January 31, 2026 falls on a Saturday, so the effective deadline for the January 31 forms moves to Monday, February 2, 2026.1Internal Revenue Service. Publication 509 (2026), Tax Calendars The February 15 deadline shifts to Tuesday, February 17, 2026, because the 15th is a Sunday and Presidents’ Day falls the next day.

Forms Due to Recipients by January 31

January 31 is the default recipient deadline. The form most small businesses deal with is the 1099-NEC, which reports payments of $600 or more to independent contractors and other nonemployees for services.2Internal Revenue Service. If you paid a freelancer, consultant, or subcontractor during 2025, their copy needs to be postmarked or electronically delivered by February 2, 2026.

Several other common forms share the same deadline:

When January 31 lands on a weekend or federal holiday, the deadline rolls to the next business day.1Internal Revenue Service. Publication 509 (2026), Tax Calendars

Forms Due to Recipients by February 15

A narrower group of forms gets two extra weeks. The February 15 deadline (February 17 in 2026) applies to:

  • 1099-B for proceeds from the sale of stocks, bonds, mutual funds, and other securities.
  • 1099-DA for digital asset proceeds from broker transactions.
  • 1099-S for proceeds from real estate transactions.
  • 1099-MISC, but only when it reports substitute payments in lieu of dividends (box 8) or crop insurance proceeds (box 10).4Internal Revenue Service. General Instructions for Certain Information Returns (2025)

If you issue both a regular 1099-MISC and one with box 8 or box 10 amounts to the same recipient, the box 8 or 10 version is the one that gets the later deadline. The others still track to January 31.

How to Deliver the Forms on Time

Timeliness is judged by the postmark, not by when the recipient opens the envelope. A 1099 is considered timely furnished if it is properly addressed and postmarked on or before the due date, either through U.S. mail or an IRS-designated private delivery service.6Internal Revenue Service. 2025 General Instructions for Certain Information Returns Certified mail isn’t required, but if a recipient later claims they never received the form, a plain postmark may not be enough to prove you sent it. Tracking creates a paper trail.

Electronic delivery is allowed only after the recipient affirmatively opts in. Implied consent doesn’t count. Before consenting, the recipient has to receive a disclosure covering:

  • The hardware and software needed to access, download, and print the form.
  • How long the form will remain available online.
  • How to withdraw consent and request a paper copy.

If you later change the technical requirements for accessing the form, you have to notify the recipient and get fresh consent. Skip any of these steps and the electronic delivery doesn’t count. You are treated as if you never furnished the form at all. Whether paper or electronic, the form must be accessible to the recipient on or before the statutory deadline.4Internal Revenue Service. Who Needs a 1099 in the First Place

Not every payment triggers one. You generally do not need to issue a 1099-NEC for payments to C corporations or S corporations, including LLCs taxed as corporations. The big exception is attorney fees, which have to be reported on 1099-NEC even when the law firm is incorporated.7Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. Payments made by credit card, debit card, or through a third-party payment network like PayPal or Venmo are also excluded from 1099-NEC and 1099-MISC reporting. Those get reported by the payment processor on a 1099-K instead, and duplicating them on a 1099-NEC would double-count the income.8Internal Revenue Service. Collecting a Form W-9 from each contractor before you pay is the practical way to know all of this in advance. The W-9 gives you the payee’s entity type and taxpayer identification number, so you can tell by year-end who is owed a 1099 and who isn’t. If a payee refuses to provide a TIN, you’re required to withhold 24% of each payment as backup withholding until you get one.9Internal Revenue Service. Backup Withholding Due to Missing Payee TIN

Penalties for Missing the Recipient Deadline

The IRS applies penalties under two separate provisions: one for failing to file the correct return with the IRS, and another for failing to furnish the correct statement to the recipient. A single late form can trigger both, so the cost of one missed deadline effectively doubles.

Penalty amounts for 2026 scale with how quickly the problem is fixed:10Internal Revenue Service. Information Return Penalties

  • Corrected within 30 days of the due date: $60 per return.
  • Corrected after 30 days but by August 1: $130 per return.
  • Filed after August 1 or not filed at all: $340 per return.
  • Intentional disregard: $680 per return, no annual cap.

Annual caps depend on business size. For businesses with average annual gross receipts over $5 million, the maximums are $683,000, $2,049,000, and $4,098,500 across the three tiers. Businesses with gross receipts of $5 million or less get lower caps of $239,000, $683,000, and $1,366,000.11Internal Revenue Service. Penalties can be waived if the failure resulted from reasonable cause rather than willful neglect. Natural disasters, serious illness, or documented system failures are the kinds of explanations that carry weight. Being busy or forgetful will not.

Extensions Don’t Help With the Recipient Deadline

Form 8809 gets you an automatic 30-day extension to file 1099s with the IRS if you submit it before the due date.12Internal Revenue Service. December 2025) Application for Extension of Time to File Information Returns Extensions for recipient furnishing are granted only in rare, extreme circumstances and require a separate written request. For planning purposes, treat the recipient deadline as immovable.

If You’re the Recipient and Nothing Has Arrived

If you’re expecting a 1099 and it hasn’t shown up by mid-February, contact the payer directly. A phone call or email requesting a copy resolves most cases.14Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect

If you still have nothing by the end of February, call the IRS at 800-829-1040. Have your name, address, Social Security number, and the payer’s name and contact information ready. Do not hold up your tax return waiting on a missing form. You have to report all income whether or not you receive a 1099. Use your own records to estimate the amount and file by the April deadline.
