When Are 1099 Forms Sent Out: Deadlines, Delays, and Penalties

Payers must send most 1099 forms to recipients by January 31 of the year following the tax year the income was earned. A handful of forms carry a February 15 deadline instead. The form has to be postmarked or electronically delivered by the deadline, not received by it. So a 1099 mailed on January 31 that shows up in your mailbox in early February is on time.

Send-Out Deadlines by 1099 Form Type

Most common 1099 variants share the January 31 recipient deadline:

A few forms get an extra two weeks. Brokerage firms have until February 15 to send Form 1099-B, which reports proceeds from investment sales, because calculating cost basis and gains across a full year of trades takes longer. Form 1099-S for real estate transactions is on the same February 15 date. Certain 1099-MISC payments reported only in boxes 8 or 10, such as substitute dividend payments, also carry the February 15 deadline.3Internal Revenue Service. On the 1099-K side, third-party settlement organizations must issue the form when your gross payments exceed $20,000 and you had more than 200 transactions in the calendar year. What to Do If Your 1099 Doesn’t Arrive

Give it until early February for January 31 forms, and until late February for the February 15 forms. Mail moves slowly, and payers using an electronic delivery service sometimes route the notice to a spam folder or an old email address.

If nothing shows up, contact the payer directly first. Confirm they have your current mailing address or email and ask them to resend the form.7Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect

If the payer doesn’t respond by the end of February, call the IRS at 800-829-1040. Have the payer’s name, address, and phone number ready, plus your own identifying information. You still owe tax on the income whether or not the form arrives. File your return by the April 15 deadline using your own records: bank statements, invoices, deposit records, and payment confirmations are all workable substitutes for reconstructing the number.1Internal Revenue Service. Publication 509 (2026), Tax Calendars The IRS matches your return against 1099 data it receives from payers, so an accurate figure matters more than having the paper in hand. Keep those supporting records at least three years from the filing date.

Why the IRS May Have a Copy Before You Do

Payers face a separate deadline to file Copy A with the IRS, and for some forms that deadline is later than the recipient deadline. This is why it’s possible for a payer to have already sent the government its copy while yours is still in transit, or vice versa.

Form 1099-NEC is the exception that lines up: payers must file it with the IRS by January 31, the same day the recipient copy is due.2Internal Revenue Service. For most other 1099 forms, including 1099-MISC, 1099-INT, 1099-DIV, 1099-R, 1099-B, 1099-S, and 1099-K, the IRS filing deadline is February 28 on paper or March 31 electronically.3Internal Revenue Service. Payers can request a 30-day extension on the IRS filing deadline using Form 8809, and for most 1099 types the first extension is automatic. Form 1099-NEC again stands apart: any extension for it requires written justification and IRS approval.9Internal Revenue Service. Form 8809 (Rev. Penalties Payers Face for Missing the Deadline

The IRS charges separate per-return penalties for failing to file Copy A with the IRS and for failing to deliver Copy B to the recipient. Both climb with how late the correct return finally shows up. For returns due in 2026:10Internal Revenue Service. Information Return Penalties

A small business for these tiers means average annual gross receipts of $5 million or less over the three most recent tax years.3Internal Revenue Service. General Instructions for Certain Information Returns (2025)

Intentional disregard raises the floor to at least $680 per return with no annual cap, and for certain forms that floor becomes 10% of the amount that should have been reported if 10% is higher than $680.10Internal Revenue Service. Payers can request a penalty reduction or waiver for reasonable cause if they acted in good faith and the failure was genuinely beyond their control, such as a payee providing an incorrect Social Security number despite a proper W-9 request.
