A release of levy is the IRS’s formal action to stop taking your wages, bank funds, or other property and to return control of those assets to you. Federal law requires the IRS to release a levy when any one of five conditions is met, and knowing which one fits your situation is how you actually get the seizure stopped. A release halts the active taking. It does not erase the tax debt or lift any lien the IRS has filed.
The Five Grounds That Require the IRS to Release a Levy
The IRS does not have open-ended discretion here. Section 6343 lists specific conditions, and if you meet one, the release is mandatory rather than optional.1Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy
The Debt Is Paid or the Collection Period Has Expired
Paying the balance in full ends the levy. So does the running of the 10-year collection statute. The IRS generally has 10 years from the date a tax is assessed to collect it by levy or court action, and once that window closes the debt becomes unenforceable.2Office of the Law Revision Counsel. 26 USC 6502 – Collection After Assessment Certain events pause that 10-year clock, including bankruptcy filings, pending Offers in Compromise, and time spent outside the country, so check the actual remaining time before relying on this ground.
You Enter an Installment Agreement
If you set up a formal payment plan under Section 6159, the IRS must release the levy unless the agreement itself says otherwise.1Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy This is often the most practical route because you do not have to produce the full balance up front. Economic Hardship
If the levy keeps you from paying reasonable basic living expenses, such as housing, food, transportation to work, and medical care, the IRS must release it.3Internal Revenue Service. The IRS measures your actual expenses against its allowable living expense standards, so thorough documentation matters.
Release Would Help the IRS Collect
Counterintuitive but real. If letting go of the levy would actually make it easier to collect the full amount, the IRS is required to release. A bank levy that freezes the account you use to run a business, or to pay the bills that keep you working, is the standard example. Property Value Far Exceeds the Debt
When the fair market value of what has been levied significantly exceeds what you owe, and the IRS can release part of the property without hurting collection, it must do so.1Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy This tends to arise with real estate or other high-value assets where the equity is far larger than the tax bill.
What About an Offer in Compromise?
Filing an Offer in Compromise does not automatically release an existing levy. The IRS has said there is no requirement to release a levy that was served before the offer was submitted, though the IRS will weigh your circumstances when deciding whether to keep the levy going while the offer is pending.4Internal Revenue Service. Offer in Compromise FAQs If the IRS issues a new levy after receiving your offer, that specific levy may be removable. But an OIC by itself is not a stop button for collection already in motion.
How to Request the Release
Speed matters, especially with a bank levy. Your bank is required to hold frozen funds for 21 days before sending them to the IRS.5eCFR. 26 CFR 301.6332-3 – The 21-Day Holding Period That window is when a release can still return the money to your account. After it closes, the funds are gone.
Gather What You Need Before You Call
Have your Social Security number or EIN ready, the notice number from the levy correspondence, the tax periods involved, and documentation supporting the ground you are claiming. For hardship, that means a completed Form 433-A with income, monthly expenses, and asset values. If the debt is already paid, bring proof of payment such as bank statements or cancelled checks.
Call the IRS Directly
Use the phone number on your levy notice. Have the fax number for your bank or employer available so the IRS can transmit the release directly once it is approved.6Internal Revenue Service. What If a Levy Is Causing a Hardship If you can either document hardship or propose an installment agreement during that first call, the release can go out before the 21-day bank hold expires.
When to Bring in the Taxpayer Advocate Service
If normal channels are not working, or the levy is causing an immediate financial emergency, the Taxpayer Advocate Service is an independent office inside the IRS that can step in. If the IRS Denies Your Release Request
Two formal appeal routes exist. Which one you use depends on timing and what has already happened.
Collection Due Process Hearing
When the IRS sends a Final Notice of Intent to Levy (LT11 or Letter 1058), you have 30 days from the date on that notice to request a Collection Due Process hearing by filing Form 12153.8Internal Revenue Service. Request for a Collection Due Process or Equivalent Hearing (Form 12153) A timely CDP request stops most levy activity while the appeal is pending and pauses the 10-year collection clock. At the hearing you can dispute the underlying tax, argue hardship, propose an installment agreement, or raise an Offer in Compromise.
You must state a reason for the dispute on the form; a blank request will not work. If you are proposing a collection alternative, submit a Form 433-A financial statement with the request. Missing the 30-day deadline leaves you the option of an equivalent hearing within one year of the levy notice date, but that hearing does not stop levy activity while pending, and you cannot take its result to Tax Court.
Collection Appeals Program
CAP is faster and less formal, and it is available for a levy that has already been served, a seizure, or a denied request to return levy proceeds. Start by requesting a conference with the IRS employee’s manager. If that does not resolve it, you have two business days to notify the collection office that you intend to appeal, and three business days after the manager conference to submit Form 9423.9Internal Revenue Service. Collection Appeals Program (CAP) A CAP appeal does not give you the right to go to Tax Court, but it is available in situations where CDP is not, including cases where you have already used your CDP hearing right for that tax period.
What a Release Does and Does Not Do
Once the release is issued, the seizure stops. Your bank unfreezes the account. Your employer stops withholding extra from your paycheck. Physical property that has been seized but not yet sold can be returned.
The debt itself is untouched. Any federal tax lien the IRS has filed stays in place until the balance is paid or otherwise resolved, and the IRS still expects you to deal with the underlying liability through an installment agreement, an Offer in Compromise, or another arrangement.6Internal Revenue Service. A release is a reprieve, not a resolution, and the practical move is to use the window to lock in a longer-term arrangement before collection activity restarts.
