A payer’s TIN is the nine-digit taxpayer identification number that identifies the business or person who made a payment reported to the IRS. On a 1099, it sits in the block near the top left labeled “PAYER’S TIN.” On a W-2, it’s the employer identification number in Box b. For most businesses, a payer’s TIN is an Employer Identification Number (EIN); for a sole proprietor or individual making a reportable payment, it can be a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN).
What Kind of Number a Payer’s TIN Actually Is
“TIN” is an umbrella term. The IRS uses it for several different nine-digit numbers, and which one shows up in the payer field depends on how the payer is set up.1Internal Revenue Service. Taxpayer Identification Numbers
An EIN is the standard payer’s TIN for corporations, partnerships, LLCs, nonprofits, trusts, and estates. It’s formatted XX-XXXXXXX. An SSN can serve as a payer’s TIN when the payer is an individual or sole proprietor. A landlord paying a contractor, for example, may use their own SSN in the payer field. The IRS cautions against mixing the two: don’t use an EIN for personal purposes, and don’t substitute an SSN where an EIN is required.2Internal Revenue Service. Where to Find the Payer’s TIN on Your Forms
If you received a tax form and need to pin down the payer’s TIN, the location depends on the form.
On a W-2, the employer’s EIN is in Box b, labeled “Employer identification number (EIN).” It should match the EIN the employer uses on payroll tax filings like Form 941.4Internal Revenue Service. 2026 General Instructions for Forms W-2 and W-3
On a 1099-NEC or 1099-MISC, look at the payer information block near the top left of the form. The field is labeled “PAYER’S TIN” and sits directly beneath the payer’s name and address. Other 1099 variants, including 1099-INT for interest and 1099-MISC for rents and royalties, use the same layout.
If the Payer’s TIN Is Missing or Looks Wrong
Contact the payer first and ask for a corrected form. That’s the fastest fix, and payers are the ones who can issue the correction.
If the payer doesn’t respond by the end of February, call the IRS at 800-829-1040 for help.5Internal Revenue Service. The payer’s TIN on your return needs to match what the payer reported to the IRS, and a mismatch is one of the most common triggers for post-filing notices.
Payer’s TIN vs. Payee’s TIN
Every information return carries two TINs, and it’s worth knowing which is which so you don’t mix them up when reading a form.
The payer’s TIN identifies the entity that sent the money and filed the form. The payee’s TIN identifies the person or business that received the money and has to report it as income. On a 1099-NEC issued to a freelance designer, the hiring business’s EIN goes in the payer field and the designer’s SSN goes in the recipient field.
Before making a reportable payment, the payer collects the payee’s TIN using Form W-9. The payee provides their name, address, and TIN and certifies the information is correct.6Internal Revenue Service. When a Payer Needs a TIN
A payer’s TIN goes on virtually every information return filed with the IRS. Two of the most common situations:
1099-NEC for non-employee compensation. For 2026, payers must file a 1099-NEC when they pay $2,000 or more in non-employee compensation to an individual or unincorporated entity during the calendar year. That threshold rose from $600 for tax years beginning after 2025, so payers running on the old $600 rule need to update their processes.7Internal Revenue Service. 2026 Publication 1099
W-2s and payroll tax filings. Employers put their EIN on every W-2 they issue, and on the quarterly Form 941 that reports federal income tax, Social Security, and Medicare withholding.4Internal Revenue Service. 2026 General Instructions for Forms W-2 and W-3 The EIN on your W-2s has to match the one on your 941s. A mismatch creates a discrepancy the IRS will flag.
How a Payer Gets an EIN
The IRS issues EINs for free. The fastest route is the online application on irs.gov, which requires the applicant to provide a responsible party’s SSN or ITIN. Government entities are the only applicants that can use an existing EIN to apply online. If the application is approved, the EIN is issued immediately.8Internal Revenue Service. Payers who can’t apply online can fax Form SS-4 to the IRS and expect the EIN within about four business days, or mail the form and wait roughly four weeks.9Internal Revenue Service. Employer Identification Number
The Responsible Party
Every EIN application must name a “responsible party,” a real person who owns, controls, or manages the entity’s funds and assets.10Internal Revenue Service. Responsible Parties and Nominees This has to be an individual, not another entity, with a narrow exception for government agencies. Who qualifies depends on the business type:
- Corporation: a principal officer
- Partnership: a general partner
- Trust: the grantor, owner, or trustor
- Estate: the executor or personal representative
- Tax-exempt organization: a principal officer
A nominee, meaning someone with limited authority during formation who doesn’t actually control the entity, cannot serve as the responsible party and should not appear on Form SS-4.10Internal Revenue Service. Responsible Parties and Nominees
