A 1099 form is an IRS information return that reports money you received outside of a regular employer paycheck: freelance pay, interest, dividends, investment sales, retirement distributions, rent, government payments, and more. If you earned that kind of income, the business or institution that paid you sends a copy to you and another to the IRS, and you report the income on your tax return.
There is not one 1099. There are more than twenty variants, each covering a specific kind of payment. Most people only ever see two or three of them.
The 1099 Forms You’re Most Likely to See
1099-NEC for Freelance and Contract Work
If a business paid you $600 or more for services during the year and you weren’t its employee, it sends you a 1099-NEC. “NEC” stands for nonemployee compensation. This is the form freelancers, consultants, and gig workers usually receive, and the income on it is subject to both income tax and self-employment tax.1Internal Revenue Service. 1099-MISC for Rent, Prizes, and Other Payments
The 1099-MISC covers payments that don’t fit the nonemployee compensation box: at least $600 in rent, prizes, awards, medical and health care payments, and similar miscellaneous income, plus royalties of $10 or more.2Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information The line between the two forms confuses people. A designer paid $2,000 for a logo gets a 1099-NEC because it’s payment for services. A landlord paid $2,000 in office rent gets a 1099-MISC because rent isn’t compensation for services.
1099-K for Payment App and Card Transactions
Payment platforms like PayPal, Venmo, and credit card processors issue a 1099-K when your activity through them crosses set thresholds. Under changes made by the One, Big, Beautiful Bill, the threshold reverted to the pre-2022 level: gross payments above $20,000 and more than 200 transactions in a calendar year. Personal payments, like chipping in for dinner or getting a birthday gift by Venmo, are not taxable and shouldn’t appear on a 1099-K. If a platform mistakenly includes them, you can report the 1099-K amount on Schedule 1 of Form 1040 and then subtract the non-taxable portion as an adjustment.4Internal Revenue Service. 1099-INT and 1099-DIV for Bank and Investment Income
Banks send a 1099-INT when they pay you $10 or more in interest from savings, CDs, bonds, or similar holdings.5Internal Revenue Service. What to Do When You Receive a 1099
Every 1099 sends the same message: the IRS already knows about this income. Where it goes on your return depends on the form.
Where Each Form Goes on Your Return
Freelance income on a 1099-NEC goes on Schedule C, where you subtract business expenses to arrive at net profit.11Internal Revenue Service. Interest and dividends from 1099-INT and 1099-DIV go on Schedule B if the total exceeds $1,500, or directly on Form 1040 if it’s less. This income is not subject to self-employment tax.13Internal Revenue Service. Form 1099-DIV (Rev. Self-Employment Tax on 1099-NEC Income
Here is the surprise for a lot of first-time freelancers. Net profit from self-employment is subject to a 15.3% self-employment tax on top of regular income tax. That’s 12.4% for Social Security and 2.9% for Medicare, calculated on Schedule SE.14Internal Revenue Service. You do get to deduct the employer-equivalent portion (half of your self-employment tax) when calculating adjusted gross income.14Internal Revenue Service. Self-employed filers may also qualify for the Qualified Business Income deduction under Section 199A, worth up to 20% of qualified business income. Quarterly Estimated Payments
1099 income doesn’t come with withholding. If you expect to owe $1,000 or more when you file, the IRS wants quarterly payments through the year using Form 1040-ES.17Internal Revenue Service. Miss them and an underpayment penalty accrues on the shortfall. You can avoid the penalty if you’ll owe less than $1,000 at filing, or if you paid at least 90% of the current year’s tax or 100% of last year’s tax, whichever is less.18Internal Revenue Service. If Your 1099 Is Missing or Wrong
The deadline for payers to send recipient copies is January 31 following the tax year (shifted to the next business day if that falls on a weekend or holiday; for the 2025 tax year, copies were due by February 2, 2026).19Internal Revenue Service. If a form you were expecting hasn’t shown up by mid-February, contact the payer. Wrong addresses and missed deadlines happen. Give them a reasonable window before escalating. If you still don’t have it by the end of February, you can call the IRS at 800-829-1040 with the payer’s name and address, and the IRS will contact them and may issue you a substitute.20Internal Revenue Service. Missing form or not, you still have to report the income. Use your own records: bank statements, invoices, payment app histories. Don’t push past your April deadline waiting on a form.
For a 1099 with an incorrect amount, name, or taxpayer ID, ask the payer for a corrected form. They check the “CORRECTED” box at the top and send the revised version to you and the IRS.21Internal Revenue Service. 2025 General Instructions for Certain Information Returns If the payer refuses and your return shows a different figure than IRS records, attach a clear explanation to head off a mismatch notice.
If You’re the One Paying Contractors
The obligation to issue a 1099 sits with the payer. If your business paid a non-employee $600 or more for services, you owe them a 1099-NEC. Similar $600 thresholds cover rent, prizes, and most 1099-MISC categories; royalties and certain interest kick in at $10.1Internal Revenue Service. Payments to C corporations and S corporations are generally exempt. Two exceptions matter: payments to attorneys must be reported regardless of the firm’s corporate form, and medical and health care payments to corporations also require reporting. Payments for merchandise, telephone, freight, and storage are excluded.22Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)
Before paying a contractor, collect a Form W-9 for their taxpayer identification number.23Internal Revenue Service. Instructions for the Requester of Form W-9 If they refuse or give an incorrect TIN, you’re required to withhold 24% of each payment and send it to the IRS as backup withholding. Skipping it when required leaves you liable for the uncollected tax.24Internal Revenue Service. Publication 15 (Circular E), Employers Tax Guide
1099-NECs are due to the IRS by January 31, the same day as the recipient copy. Most other 1099s are due to the IRS by February 28 on paper or March 31 electronically. Paper filers also send Form 1096 as a transmittal summary.19Internal Revenue Service.
