What Does IRS Code 810 Mean? Refund Freeze Triggers and Fixes

IRS Code 810 on your account transcript means the IRS has placed a freeze on your refund. Your return continues processing, but no money is released while the agency reviews it, and the hold stays in place until an employee lifts it manually.1Internal Revenue Service. Internal Revenue Manual 21.5.10 – Examination Issues The freeze itself is neutral. What matters is why it was placed and what notice, if any, arrives with it.

You can see the code by pulling your Account Transcript from your IRS Online Account at irs.gov.2Internal Revenue Service. Why the IRS Freezes a Refund With Code 810

The IRS uses TC 810 when a return is under review or has been flagged by its Automated Questionable Credit system.1Internal Revenue Service. Internal Revenue Manual 21.5.10 – Examination Issues Four situations account for most freezes.

Suspected Identity Theft

A return filed from an unusual location, a duplicate Social Security Number showing up on two filings, or a return that doesn’t match your history can trigger the IRS’s fraud filters. When that happens, you’ll usually get a 5071C letter asking you to verify your identity before the refund moves.4Internal Revenue Service. Understanding Your CP5071 Series Notice

Refundable Credit Verification

Returns claiming the Earned Income Tax Credit or Additional Child Tax Credit draw extra scrutiny because those credits can produce a refund even when nothing was withheld. The IRS holds the refund until it verifies the qualifying child, residency, and income figures.5Internal Revenue Service. Here’s What to Know About Refundable Credits Audits by Mail On top of that, the IRS cannot legally release EITC or ACTC refunds before mid-February, so early-season freezes on these returns can stretch the wait considerably.6Internal Revenue Service. Income Mismatches

The IRS receives copies of your W-2s and 1099s directly from employers and payers. If the wages or withholding on your return don’t line up with those third-party reports, the mismatch triggers a review. This usually means either the reported income is off or the claimed withholding is higher than what your employer actually remitted.

Questionable Credit Claims

Some freezes come from credits the taxpayer wasn’t eligible for. The fuel tax credit is a recurring example: it exists for farmers and off-highway business use of fuel, but fraudulent claims from unqualified filers have become common enough that the IRS flags them aggressively.7Internal Revenue Service. Excessive Claims for Fuel Tax Credits – IRS Dirty Dozen A bogus claim can carry a $5,000 frivolous return penalty in addition to the freeze.

Reading the Codes Around 810

Code 810 rarely appears alone. The codes near it tell you where the review stands.

  • TC 811 reverses Code 810. When it posts, the freeze is lifted and the refund should start moving.
  • TC 971 means a notice has been sent to you. Expect a CP05 or CP75 in the mail within a week or two.8Internal Revenue Service. Understanding Your CP05 Notice
  • TC 420 or TC 424 means the return has been sent to examination. Alongside 810, this signals the freeze is tied to a formal audit rather than an automated hold.

If 810 is followed weeks later by 811, the review has resolved in your favor. If 810 is followed by 420, the situation has escalated. Check the transcript every couple of weeks to track the movement.

What to Do When You See Code 810

Find the notice that came with the freeze. The response depends entirely on which one you got.

CP05 Notice

A CP05 means the IRS needs more time to verify your income, withholding, or credits. You don’t need to do anything. The notice tells you not to call until at least 60 days have passed.8Internal Revenue Service. Understanding Your CP05 Notice The IRS is working through verification using records it already has. If 60 days pass with no update, call the number printed on the notice.

CP75 Notice

A CP75 is an audit notice and requires action. The IRS is auditing your eligibility for the Earned Income Credit, Additional Child Tax Credit, or both, and you must send supporting documentation within 30 days of the notice date.9Internal Revenue Service. CP75 Notice – Supporting Documentation Required Miss the deadline and the IRS will disallow the credits and send a proposed tax bill.

The notice spells out what records to send. For EITC claims involving a qualifying child, the IRS typically wants proof of relationship and proof that the child lived with you for more than half the year: school records, medical records, childcare provider statements, and letters from a landlord confirming the household.10Internal Revenue Service. Form 886-H-EIC Toolkit for EITC Send everything in one package rather than piecemeal, and make sure copies are legible. Faxing blurry documents is one of the fastest ways to add months to a review.

5071C Identity Verification Letter

Go to irs.gov/verifyreturn to complete verification online. You’ll need the return for the tax year listed on the letter, a prior-year return if you have one, and supporting documents like W-2s or 1099s.4Internal Revenue Service. Understanding Your CP5071 Series Notice If you can’t verify online, call the number on the letter. If verification succeeds, you do not need to file Form 14039 unless the IRS specifically instructs you to.

If someone else filed a fraudulent return using your Social Security Number, that’s different. File Form 14039 and attach it to a paper return mailed to the IRS.11Internal Revenue Service. How IRS ID Theft Victim Assistance Works The case is assigned to a specialized identity theft team, and resolution typically takes several months.

Formal Audit Notice

When TC 420 appears alongside 810, the letter you receive will name the specific line items under examination and list the documents to send. For a Schedule C loss, that means profit-and-loss records, receipts, bank statements, and mileage logs. For education credits, expect to need Form 1098-T and proof of enrollment.

Call the number on the notice, not the general IRS helpline. The general line routes you to agents who often don’t have access to your examination file. The number on the notice reaches the unit actually handling your case.

After You Respond

Once the IRS has your documentation, expect roughly 60 to 120 days before you hear back. CP05 reviews sometimes resolve faster; CP75 audits sit at the longer end. Calling for status updates before that window closes doesn’t accelerate anything, because the agent answering the phone can’t move a file sitting in an examiner’s queue.

What Happens If You Ignore It

The freeze doesn’t lift on its own. Miss the CP75 deadline and the IRS disallows the credits without weighing any evidence you had. You’ll get a proposed assessment showing additional tax owed. If you don’t challenge it within 90 days, the assessment becomes final and you lose the right to dispute it in Tax Court.

From there the IRS sends a bill, adds penalties and interest, and eventually refers the debt to collections. That can mean a federal tax lien, a levy on your bank account, or wage garnishment. Having refundable credits disallowed through an audit also means you’ll need to file Form 8862 in any future year you want to claim them again.12Internal Revenue Service. Instructions for Form 8862 If the IRS determines the original claim was fraudulent rather than mistaken, the disallowance runs ten years.

Interest You’re Owed, Penalties You Could Owe

If the IRS holds your refund beyond 45 days after your filing deadline (or 45 days after you actually filed, if you filed late), the agency owes you interest on the delayed amount.13GovInfo. 26 USC 6611 – Interest on Overpayments For the first quarter of 2026, that rate is 7% for individual taxpayers, adjusted quarterly.14Internal Revenue Service. Interest Rates Remain the Same for the First Quarter of 2026 You don’t file a separate claim. The IRS calculates the interest automatically and adds it when the refund releases.

If the review finds you underreported income or overclaimed credits, expect a 20% accuracy-related penalty on the underpaid tax.15Office of the Law Revision Counsel. 26 USC 6662 – Imposition of Accuracy-Related Penalty on Underpayments The penalty covers negligence, disregard of IRS rules, or any substantial understatement of income tax, generally an understatement over the greater of 10% of your correct tax or $5,000. Interest runs on top of the penalty from the original due date. If a preparer inflated your credits, the IRS still assesses the penalty against you, not the preparer.

When to Bring in the Taxpayer Advocate Service

The Taxpayer Advocate Service is an independent organization inside the IRS that can intervene when a refund freeze causes real financial hardship. If the frozen refund means you can’t pay rent, cover utilities, buy food, or keep transportation to work, TAS may be able to expedite the case.16Taxpayer Advocate Service. Can TAS Help Me With My Tax Issue TAS can also step in when you’ve already worked through normal IRS channels without result.

Submit Form 911 by mail, fax, or email, and include documentation of the hardship such as an eviction notice or a past-due utility bill.17Internal Revenue Service. Form 911 – Request for Taxpayer Advocate Service Assistance If you don’t hear back within 30 days, call TAS at 877-777-4778. Don’t submit the form more than once for the same issue; duplicates slow things down.

TAS isn’t a shortcut for routine freezes. If the IRS is still within its stated review window and you aren’t facing an emergency, the advocate’s office will tell you to wait. When a freeze runs past 120 days with no communication, or when the financial pressure is immediate, TAS is the most effective escalation available.
