W-3 Due Date: Filing Steps, Penalties, and Extensions

The W-3 due date is January 31 of the year after the wages were paid, filed with the Social Security Administration alongside your W-2 copies. Form W-3 is the transmittal cover sheet that summarizes the totals from every W-2 you’re sending: total wages, federal income tax withheld, Social Security wages, and the rest. If you file even one W-2, you file a W-3 with it.1Internal Revenue Service. Topic No. 752, Filing Forms W-2 and W-3

The Employee Copy Shares the Same Date

February 2, 2026 is also the last day to furnish W-2 copies to your employees for the 2025 tax year. Mailed copies count as furnished on time as long as they are properly addressed and postmarked by the deadline. You can hand a departing employee their W-2 earlier, but not later than the standard date. If a former employee asks for their W-2, you have 30 days from the request or 30 days from the final wage payment, whichever comes later.1Internal Revenue Service. How to File by the Deadline

Employers who file fewer than 10 information returns for the calendar year may file on paper. Paper W-3 and W-2 forms have to be the official red-ink scannable versions, which you order from the IRS at 800-829-3676, then mail to the SSA processing address for your location.1Internal Revenue Service. If your total information returns for the year hit 10 or more, electronic filing is mandatory. That count combines W-2s with any other information returns you file, such as 1099s, so most employers are pushed into e-filing.3Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically Electronic submissions go through the SSA’s Business Services Online (BSO) portal or a compatible payroll platform. BSO now requires a Login.gov or ID.me credential, and setting up a new account involves identity verification that takes several days, so don’t leave account setup for the last week of January.4Social Security Administration. Penalties for Missing the Deadline

The IRS charges the penalty per form. Every W-2 that is late, incorrect, or unfiled is a separate hit, and the employee statement copy is charged on its own track. For returns due in 2026, the tiers are:5Internal Revenue Service. Information Return Penalties

  • Filed within 30 days of the deadline: $60 per form.
  • Filed after 30 days but on or before August 1: $130 per form.
  • Filed after August 1 or not filed at all: $340 per form.
  • Intentional disregard: $680 per form, with no annual cap.

The math gets painful quickly. An employer with 50 employees who files two months late is looking at $6,500 on the information returns alone, plus a matching set of penalties on the late employee statements. If penalties do land, the IRS can reduce or waive them for reasonable cause. You have to show you acted responsibly before and after the failure and that real mitigating circumstances existed, such as a natural disaster, a strong compliance record, or reliance on an agent. Extensions Are Not Automatic for W-2s

You can ask for extra time using Form 8809, but the W-2 and W-3 rules are stricter than for other information returns. The automatic 30-day extension available for many other forms does not apply to W-2s.8Internal Revenue Service. A separate waiver, Form 8508, exists for employers who cannot meet the electronic filing requirement due to hardship. It has to be filed at least 45 days before the return due date. First-time waivers are granted automatically; later ones require documented hardship, a catastrophic event, or another qualifying reason.10Internal Revenue Service. Reconcile Before You Submit

Before hitting send, confirm that your W-3 totals match the sum of your quarterly Form 941 filings for the year. Total compensation, federal income tax withheld, Social Security wages, and Medicare wages should each tie out across the two. The IRS publishes a reconciliation worksheet that walks the comparison line by line.11Internal Revenue Service. Year-End Reconciliation Worksheet for Forms 941, W-2, and W-3 The usual sources of a mismatch are mid-year adjustments, voided checks, or corrected 941s that didn’t carry through to the W-2 file. Catching a discrepancy now is easier than answering an SSA notice later.

Fixing Errors After You File

If you find a mistake after the W-3 is in, file Form W-3c along with W-2c copies for the affected employees. The W-3c works as a corrected cover sheet the same way the original W-3 does.12Internal Revenue Service.
