What the Automated Line Can Do
800-304-3107 is an Interactive Voice Response system, not a staffed help desk. It can identify which agency submitted your debt to TOP, give you that agency’s contact information, and share information about debts referred to TOP and payments that have been offset.3Bureau of the Fiscal Service. What it cannot do is resolve anything. Fiscal Service cannot negotiate a payment plan, change the offset amount, reverse the offset, or issue a refund. Which Number You Actually Need
The right phone number depends on what you’re trying to accomplish.
To find out who took your refund: call 800-304-3107. You should also receive a written notice from Fiscal Service showing the original refund amount, the offset amount, and the receiving agency’s name, address, and phone number. If you didn’t get the notice, the IVR line gives you the same information.1Internal Revenue Service. Reduced Refund

To question the IRS side of the math: contact the IRS only if the original refund amount shown on the Fiscal Service notice doesn’t match the refund shown on your tax return.1Internal Revenue Service. Reduced Refund Anything about the debt itself belongs with the creditor agency.

Getting Your Share Back If the Debt Isn’t Yours
When you filed a joint return and only your spouse owes the debt, you can recover your portion of the refund by filing IRS Form 8379, Injured Spouse Allocation.5Internal Revenue Service. Injured Spouse Relief You qualify if you reported income on the joint return (or claimed a refundable credit like the Earned Income Credit), you made tax payments through withholding or estimated payments, and you are not personally liable for the debt that caused the offset.6IRS. File Form 8379 with your joint return, or send it separately to the IRS service center where you filed the return once you learn of the offset.5Internal Revenue Service. Community property states apply their own allocation rules. In most of them, 50% of a joint overpayment (excluding the Earned Income Credit) can be applied to a nontax debt, and the Earned Income Credit is allocated based on each spouse’s individual earned income.8Internal Revenue Service. Don’t confuse this with innocent spouse relief. Form 8379 recovers your share of a refund taken for your spouse’s debt. Form 8857 is the different form used when the IRS says you owe additional tax because of something your spouse did on a joint return.6IRS. Stopping an Offset Before It Happens
Once your refund has been applied to the debt, options narrow sharply. Acting before the offset gives you more room.
If the debt is a federal tax debt and losing the refund would leave you unable to cover essentials like rent, utilities, or medical care, you may qualify for an Offset Bypass Refund (OBR). The IRS can release part of your refund to relieve immediate hardship instead of applying it to the tax balance. Two limits matter: OBRs apply only to federal tax debts, not to child support, student loans, or other nontax debts collected through TOP, and you must request the OBR before the offset takes place.4Taxpayer Advocate Service. To request one, file your return on time, call 800-829-1040 as soon as possible after filing, and be ready with documentation of the hardship: eviction notices, utility shutoff warnings, medical bills. For nontax debts, the OBR isn’t available, but a parallel option exists. If the creditor agency certifies that the full offset would cause financial hardship, the agency can direct Fiscal Service to offset a lesser amount based on your financial circumstances.9eCFR. Subpart A Disbursing Official Offset You have to reach the agency before tax season and make the case there.
Federal regulations also require the creditor agency to offer you a written repayment agreement before referring the debt to TOP.10eCFR. Part 31 Tax Refund Offset If you know you have an outstanding federal or state debt and a refund is coming, calling the agency to set up repayment is usually the cleanest way to protect the refund.
Disputing the Debt Itself
Disputes go to the creditor agency, not to Fiscal Service and not to the IRS. Call the agency on your offset notice or the one identified through 800-304-3107 and ask for their formal dispute process. Most require a written request.
Your written dispute should include your full name, Social Security number, the offset date and amount, and any reference number the agency uses. Attach anything that supports your position: cancelled checks, payment receipts, payoff confirmations, court orders showing the debt was satisfied, or documents showing the debt isn’t yours.
Documentation varies by debt type:
- Federal student loans: proof of consolidation, rehabilitation, discharge, or current repayment status that should have prevented referral to TOP.
- State tax debts: copies of filed state returns or official notices showing a zero balance.
- Child support: court orders modifying or terminating the obligation, or payment records from the state disbursement unit.
If the agency agrees the offset was wrong, it initiates the refund back to you. Fiscal Service cannot reverse an offset on its own; the correction has to come from the agency that certified the debt.2Bureau of the Fiscal Service. Your Right to a Pre-Offset Notice
You should have received a warning before any of this happened. The creditor agency is required to notify you at least 60 days before referring a debt for tax refund offset. The notice must explain what the debt is for, how much you owe, the agency’s intent to collect from a federal payment, and how to dispute the debt or present evidence that all or part of it is not past-due or not legally enforceable.11Office of the Law Revision Counsel. 31 USC 3720A – Reduction of Tax Refund by Amount of Debt It must also explain your right to review the agency’s records on the debt and your right to enter into a written repayment agreement.3Bureau of the Fiscal Service. If you never received that letter, say so when you contact the creditor agency. It’s a potential basis for challenging the offset.
