When Employee Deferrals Must Be Deposited
The 30-day rule is an outer boundary, not a target. The underlying standard from the Department of Labor is that withheld employee money must be deposited as soon as it can reasonably be separated from the employer’s general assets.2U.S. Department of Labor. Plans with fewer than 100 participants get a safe harbor. If you deposit deferrals within seven business days of the payroll date, the deposit is automatically treated as timely.2U.S. Department of Labor. Faster is better, and slower isn’t necessarily late, but seven business days is the line that guarantees you’re clear.
What Happens If a Deferral Deposit Is Late
A late deposit is treated as a prohibited transaction. The IRS charges a 15% excise tax on the amount involved for each year or partial year the money sat outside the participant’s account, reported and paid on Form 5330.3Internal Revenue Service. You also owe lost earnings to the affected employees, calculated by compounding interest from the date the deposit was due through the date it was actually made.5Internal Revenue Service. The IRS Employee Plans Compliance Resolution System can’t clean up a prohibited transaction on its own. When Employer Contributions Are Due
The employer’s matching or nonelective contribution is due by the business’s federal income tax return deadline for the year the contribution applies to, including any extension.1Internal Revenue Service. SIMPLE IRA Plan The specific date depends on how the business is structured:

Two things worth flagging. First, the contribution has to be clearly designated as applying to the prior tax year, or the deposit gets treated as a current-year contribution. Second, a filing extension truly does extend this deposit deadline. The October 1 Plan Setup Deadline
You can only make contributions to a SIMPLE IRA for a given year if the plan document was in place in time. A SIMPLE IRA can be established effective any date between January 1 and October 1, as long as neither you nor a predecessor employer previously maintained one. Businesses that came into existence after October 1 get one exception: they can establish the plan as soon as administratively feasible after the business begins operating.11Internal Revenue Service. Annual Notice Deadline: Before November 2
Each year, employers must give eligible employees a written notice explaining their right to make or change salary deferral elections and identifying which employer contribution formula applies for the coming year.1Internal Revenue Service. SIMPLE IRA Plan Fix-It Guide – Annual SIMPLE IRA Plan Notification Requirements Weren’t Followed The election period then runs 60 days, from November 2 through December 31, giving employees time to set deferral amounts for the upcoming calendar year.
Missing the notice deadline can require corrective action under the IRS fix-it procedures and may obligate the employer to make additional contributions. It’s one of the most commonly missed steps because it recurs every year even when nothing about the plan has changed.
If you use the 3% match and want to reduce it (down to as low as 1%), the annual notice is where that reduction gets disclosed. The reduction is only allowed in two calendar years out of any rolling five-year window.1Internal Revenue Service. SIMPLE IRA Plan
You Can’t Terminate Mid-Year
One boundary worth knowing about the calendar: a SIMPLE IRA can’t be shut down in the middle of the year. Once the plan is in effect for a given year, it runs through December 31, and you have to fund every contribution the annual notice promised.11Internal Revenue Service. To end the plan effective the following January 1, notify employees within a reasonable time before November 2, and tell the financial institution and your payroll provider that no contributions will be made for the next year. The IRS doesn’t need to be notified. A late-year decision to terminate can push the effective end date more than a full year out.
