My Child Received a 1099-NEC: Do They Need to File?

If your child received a 1099-NEC, they must file their own federal tax return once their net self-employment earnings hit $400. That threshold catches most parents off guard because it’s far below the usual filing floor, and the return involves self-employment tax on top of income tax. Your child stays on your return as a dependent, but the filing obligation is theirs alone.

The $400 Filing Trigger

A 1099-NEC reports nonemployee compensation, meaning the payer treated your child as an independent contractor and withheld nothing.1Internal Revenue Service. About Form 1099-NEC, Nonemployee Compensation The IRS requires a return from any self-employed person whose net earnings reach $400 or more.2Internal Revenue Service. Topic No. 554, Self-Employment Tax Net earnings means the gross amount on the 1099-NEC minus legitimate business expenses. A child who was paid $800 but spent $500 on job-related costs has $300 in net earnings and isn’t required to file solely because of that income. The $400 figure is fixed by statute and doesn’t adjust for inflation.3Office of the Law Revision Counsel. 26 USC 1402 – Definitions

A separate dependent rule requires filing when gross income tops the dependent standard deduction, which for 2025 is the greater of $1,350 or earned income plus $450.4Internal Revenue Service. Topic No. 551 – Standard Deduction For kids with 1099-NEC income, the $400 self-employment threshold almost always trips first, so that’s the number to watch.

Your child files their own 1040 even though you claim them as a dependent. Those are independent obligations. Ignoring the $400 trigger exposes your child to a failure-to-file penalty of 5% of unpaid tax per month, capped at 25%, plus daily-compounded interest and a minimum penalty for returns more than 60 days late.

One boundary worth naming: the “kiddie tax” that taxes a child’s investment income at the parent’s rate applies to unearned income, not to money earned by performing services.5Internal Revenue Service. Topic No. 553 – Tax on a Child’s Investment and Other Unearned Income A 1099-NEC puts your child on the self-employment path, not the kiddie-tax path.

Was the 1099-NEC Actually Correct?

Before working through Schedule C, stop and ask whether your child should have been treated as an employee instead. Employees split Social Security and Medicare taxes with their employer. Independent contractors owe both halves. If the company controlled when, where, and how your child worked, supplied the equipment, and set the schedule, the classification may be wrong.

You can ask the IRS to make an official determination by filing Form SS-8. There’s no fee, and either the worker or the business can submit it.6Internal Revenue Service. Form SS-8, Determination of Worker Status for Purposes of Federal Employment Taxes and Income Tax Withholding If a filing deadline hits before the determination comes back, Form 8919 lets your child report the money as wages and pay only the employee’s share of Social Security and Medicare.7Internal Revenue Service. Independent Contractor (Self-Employed) or Employee?

For most child performers, tutors, and freelancers, contractor status is legitimate. But when a business hired your child for regular shifts under direct supervision, don’t accept the 1099-NEC without a second look.

How Self-Employment Tax Works

Self-employment tax is the shock in the bill. It covers Social Security and Medicare at a combined 15.3%, split into 12.4% for Social Security and 2.9% for Medicare.8Internal Revenue Service. Schedule SE (Form 1040) – Self-Employment Tax In a W-2 job the employer covers half. On a 1099-NEC your child owes the entire amount.

The rate doesn’t apply to the full net earnings. First multiply net earnings by 92.35%, then apply 15.3% to that figure.8Internal Revenue Service. Schedule SE (Form 1040) – Self-Employment Tax On $2,000 of net earnings, the taxable base is $1,847 and self-employment tax comes to roughly $283.

Your child then deducts half the self-employment tax on Schedule 1, reducing adjusted gross income for regular income tax purposes.8Internal Revenue Service. Schedule SE (Form 1040) – Self-Employment Tax This is an automatic adjustment, not an itemized deduction. All the arithmetic sits on Schedule SE and flows into Form 1040.9Internal Revenue Service. Instructions for Schedule SE (Form 1040)

Deducting Business Expenses on Schedule C

Schedule C is where your child’s actual profit gets calculated. Gross 1099-NEC income goes at the top; ordinary and necessary business expenses come off the bottom. “Ordinary” means common in that line of work. “Necessary” means helpful and appropriate. The net profit on Line 31 flows into both Schedule SE and Form 1040.10Internal Revenue Service. Schedule C (Form 1040) – Profit or Loss From Business

Common deductions for a self-employed minor include commissions paid to an agent or manager, specialized wardrobe that isn’t suitable for everyday wear, travel and mileage to auditions or job sites (including a parent’s driving, as long as the miles are tracked), supplies and equipment needed for the specific work, and training or coaching directly tied to the freelance activity.

Personal costs don’t qualify. Regular school clothes, everyday grooming, and general education are off-limits even if they help your child look the part. Keep receipts. The IRS can question deductions years later, and estimates don’t survive an audit. If expenses exceed income, Schedule C shows a loss, which erases the self-employment tax and can offset other earned income on the return.

One more break to check: the Section 199A qualified business income deduction lets sole proprietors deduct up to 20% of net business income from taxable income. Tax software calculates it automatically for simple sole-proprietor returns.

Do You Need to Make Quarterly Payments?

Because nothing was withheld from the 1099-NEC, the IRS may expect estimated tax payments during the year. The rule kicks in when total tax owed will be $1,000 or more after withholding and refundable credits.11Internal Revenue Service. Estimated Tax for Individuals Most kids with a single modeling job or a short freelance project stay under that line and won’t owe a penalty even if they wait until April to pay.12Internal Revenue Service. Topic No. 306 – Penalty for Underpayment of Estimated Tax

If your child does earn steadily and the combined income tax and self-employment tax will clear $1,000, set up quarterly payments. For tax year 2026, the due dates are April 15, June 15, and September 15 of 2026, plus January 15, 2027. Filing the 2026 return and paying the balance by February 1, 2027 lets your child skip the January payment.11Internal Revenue Service. Estimated Tax for Individuals

The Roth IRA Opportunity

Self-employment income unlocks something most parents miss. Any child with earned income can contribute to a Roth IRA, and 1099-NEC earnings qualify. For 2026, the contribution limit is $7,500 or the child’s taxable compensation, whichever is less.13Internal Revenue Service. Retirement Topics – IRA Contribution Limits A child who nets $2,000 can contribute up to $2,000.

There’s no minimum age. A parent opens a custodial Roth IRA in the child’s name and manages it until the child reaches the age of majority in your state. The money doesn’t have to come out of the child’s own pocket. A parent or grandparent can gift the contribution as long as it doesn’t exceed the child’s earned income for the year. Decades of tax-free growth from a contribution made in childhood can compound into a significant retirement balance.

Filing the Return

Once Schedule C and Schedule SE are done, everything consolidates on your child’s Form 1040. Net profit from Schedule C feeds the income tax calculation and Schedule SE; the self-employment tax lands on the 1040 as additional tax; half of it comes back off as an adjustment on Schedule 1.

A few practical points that trip parents up:

  • If your child is too young to sign, a parent or guardian signs the child’s name followed by “By [your signature], parent for minor child.”14Internal Revenue Service. VITA/TCE Training – Return Signature
  • For the 2026 filing season, IRS Free File guided software is available to taxpayers with adjusted gross income of $89,000 or less, which covers essentially every child in this situation. Free File Fillable Forms is open to anyone.15Internal Revenue Service. Free Options and Resources for Preparing and Filing Taxes in 2026
  • The return can go through any IRS-authorized e-file provider or by mail to the service center for your state.

Save copies of the 1040, Schedule C, Schedule SE, the 1099-NEC itself, and every receipt behind a deduction. The general retention period is three years from the filing date, but the IRS recommends holding records longer in certain situations, such as underreporting income by more than 25%.16Internal Revenue Service. How Long Should I Keep Records For a child’s first filing, six years is a reasonable floor.
