Claiming a dependent with an ITIN follows the same dependency rules as any other dependent, but the Individual Taxpayer Identification Number caps what you can actually get out of the claim. In most cases you are limited to the $500 Credit for Other Dependents. The Child Tax Credit, the refundable Additional Child Tax Credit, and the Earned Income Tax Credit all require the child to have a Social Security Number, not an ITIN. Head of household status stays on the table if you otherwise qualify.
What You Can and Cannot Claim
The federal personal exemption is $0, so “claiming a dependent” today is really about which credits the dependent unlocks. With an ITIN dependent, the answer is short.
Credit for Other Dependents: Up to $500
A dependent who has an ITIN and meets every dependency test qualifies you for the Credit for Other Dependents, worth up to $500 per dependent.1Internal Revenue Service. Understanding the Credit for Other Dependents The ODC is nonrefundable. It reduces the tax you owe dollar for dollar, but once your liability reaches zero, any leftover credit is gone. It will not, on its own, generate a refund.
One timing rule matters here: the ITIN must be assigned by the due date of your return, including extensions, for you to claim the ODC. If the number is not issued in time, the credit is denied for that year.2Internal Revenue Service. Individual Taxpayer Identification Number (ITIN)
Child Tax Credit and Additional Child Tax Credit: Not Available
Federal law requires any qualifying child to have a valid Social Security Number issued before the return’s due date for the taxpayer to receive the Child Tax Credit.3Office of the Law Revision Counsel. 26 USC 24 – Child Tax Credit An ITIN does not satisfy that rule. The same restriction applies to the refundable Additional Child Tax Credit. A child with an ITIN instead of an SSN disqualifies both, leaving only the $500 ODC.
The taxpayer claiming the CTC must also have a valid SSN. For joint filers, at least one spouse must. If both the parent and the child lack SSNs, neither the CTC nor the ODC is available.
Earned Income Tax Credit: Not Available for That Child
The EITC has its own SSN rule. Both the taxpayer and every qualifying child claimed for the credit must have Social Security Numbers issued on or before the return’s due date.4Internal Revenue Service. If you otherwise qualify for the childless EITC on your own, you can still claim it. Listing an ITIN dependent on the return does nothing to increase the amount. For 2026, the maximum EITC for taxpayers with qualifying children is $8,231.6Internal Revenue Service. If your dependent later obtains an SSN, you may be able to amend prior returns to claim the CTC and EITC retroactively for open tax years.
Head of Household Still Works
An ITIN dependent does not block head of household filing status. If your ITIN-holding dependent is a qualifying child or a qualifying relative who is related to you, you can file as head of household and list the dependent on your return.2Internal Revenue Service. The Dependency Tests Still Apply
The ITIN only handles identification on the return. The dependent still has to pass every other IRS dependency test, and there is one residency-related rule that catches ITIN filers off guard: the dependent must be a U.S. citizen, U.S. resident alien, or a resident of Canada or Mexico for at least part of the calendar year.7Internal Revenue Service. From there, the dependent falls into one of two buckets.
Qualifying Child
A qualifying child must meet four tests:
- Relationship. Your child, stepchild, foster child, sibling, stepsibling, or a descendant of any of these.
- Age. Under 19 at the end of the tax year, under 24 if a full-time student, or permanently and totally disabled at any age.8Internal Revenue Service. Understanding Taxes – Dependents
- Residency. Lived with you for more than half the year. This is satisfied even if the child is a resident of Canada or Mexico.
- Support. The child did not provide more than half of their own financial support.
The child must also be younger than you (or your spouse, if filing jointly) unless permanently disabled.
Qualifying Relative
A dependent who does not meet the qualifying child rules may still be claimed as a qualifying relative:
- Relationship or household. Parents, siblings, aunts, uncles, certain in-laws, or any person who lived in your home as a member of the household for the entire year.
- Gross income. The dependent’s gross income for the year must fall under the annually adjusted IRS threshold. The most recently published figure is $5,050; check the current number before filing.9Internal Revenue Service. Dependents
- Support. You provided more than half of the dependent’s total support for the year.
Fail any one test and the claim collapses. Keep records of living arrangements, school enrollment, and financial support; the IRS can ask for proof of any element.
Filing When the ITIN Is Not Ready
ITIN processing currently runs about 11 weeks.10Internal Revenue Service. ITIN Documentation Frequently Asked Questions If April is coming and the number is not in hand, you can request an automatic extension. File Form 4868 by the April deadline and write “ITIN TO BE REQUESTED” in the SSN/ITIN fields.2Internal Revenue Service. Individual Taxpayer Identification Number (ITIN) Do not attach Form W-7 to the extension. This gives you until October 15 to file without a late-filing penalty.
The extension covers filing, not paying. If you expect to owe, pay as much as you can by April to hold down interest. You can make estimated payments even without an ITIN.2Internal Revenue Service. Individual Taxpayer Identification Number (ITIN)
If your dependent does not yet have an ITIN at all, the W-7 application is filed alongside the tax return that claims them, generally Form 1040.11Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number Check box “d” on the W-7 for “Dependent of U.S. citizen/resident alien,” and make sure the name and date of birth on the form match the supporting identity documents exactly.12Internal Revenue Service. Form W-7 (Rev. December 2024) A spelling difference between the form and a birth certificate is enough to get the whole package rejected.
Watch for an Expired ITIN
An ITIN that has not appeared on a federal return for three consecutive tax years expires on December 31 of the third year of non-use. Filing with an expired ITIN can delay your return, disallow credits, and reduce your refund.13Internal Revenue Service. How to Renew an ITIN
Renewal uses the same Form W-7 and the same documents as an original application. A dependent being renewed for a tax benefit must be listed on the attached return along with the form or schedule for the credit being claimed.13Internal Revenue Service. Wait until March or April and you may end up choosing between filing with an expired number and losing the ODC, or extending and waiting months for the renewal to clear.
