Tax debt is not a public record on its own. Federal law keeps your return information confidential, and simply owing the IRS money does not put that fact where anyone can find it. It only becomes public when the IRS takes one specific step: filing a Notice of Federal Tax Lien in a local recording office. That filing sits alongside deeds and mortgages, and anyone who looks can find it.
When the IRS Actually Files a Lien
A federal tax lien attaches to everything you own the moment the IRS assesses a tax, sends a demand for payment, and you don’t pay.1Office of the Law Revision Counsel. 26 U.S. Code 6321 – Lien for Taxes That legal claim is invisible to the outside world. What makes the debt public is a separate document, the Notice of Federal Tax Lien, which the IRS files to establish its priority over other creditors who might have claims against the same property.2Office of the Law Revision Counsel. 26 USC 6323 – Validity and Priority Against Certain Persons
The IRS does not file that notice for every debt. As a general matter, it will not file when the unpaid balance is under $10,000, though it keeps discretion to do so in situations like an impending bankruptcy. Below $2,500, the IRS almost never files. It also skips lien filings for defunct corporations that have already been liquidated, deceased taxpayers with no estate assets, and taxpayers who have gone through a liquidating bankruptcy.3Internal Revenue Service. So if you owe less than $10,000 and nothing unusual is going on, your tax debt most likely stays between you and the IRS.
State Tax Debts Work the Same Way
States can also file tax liens for unpaid state income or business taxes, and the mechanics mirror the federal process. The state records a notice locally and the debt becomes searchable. Thresholds, duration, and release rules vary from state to state.
What a Filed Lien Actually Shows
A Notice of Federal Tax Lien includes your name, address, the type of tax owed, the tax periods, the total amount, and the filing date. What the notice does not show is your full Social Security number. The IRS redacts SSNs and EINs on lien documents, displaying only the last four digits.4Internal Revenue Service. Notice of Lien Preparation and Filing It also does not reveal the contents of your return, your income, or how the debt was calculated.
Who Sees It and Why It Matters
Credit Reports and Lenders
The three major credit bureaus stopped including tax liens on credit reports by April 2018, so a lien filing no longer drags down your credit score directly.5Consumer Financial Protection Bureau. A New Retrospective on the Removal of Public Records That does not mean the lien is invisible to lenders. Mortgage underwriters routinely pull county records regardless of what a credit report says, and landlords and employers who run public records searches will find the filing too. A tax lien can still block or delay a home purchase or refinance.
Selling or Refinancing Real Estate
A federal lien attaches to all your property, and title companies will flag it at closing. You generally cannot deliver clear title with a lien outstanding. The IRS has workarounds. It can discharge a specific property from the lien if the remaining property still covers double the debt, or if you pay the IRS the value of its interest in the property being sold. It can also subordinate its lien to a new lender’s mortgage so a refinance can go through.6Office of the Law Revision Counsel. 26 U.S. Code 6325 – Release of Lien or Discharge of Property Both processes take paperwork and several weeks of lead time.
Security Clearances and Licensing
Federal tax liens raise flags in government background investigations. The Defense Office of Hearings and Appeals has upheld clearance denials where applicants had unresolved federal tax liens, noting that waiting for a debt to become legally unenforceable is not a good-faith effort to resolve it.7Defense Office of Hearings and Appeals. How Long the Filing Stays Visible
The IRS generally has 10 years from the date of assessment to collect a tax debt.8Office of the Law Revision Counsel. 26 USC 6502 – Collection After Assessment A filed lien notice stays active and public through that window. The clock can be paused. Bankruptcy suspends the collection period for the duration of the case plus six months, and an installment agreement can also extend it.9Office of the Law Revision Counsel. 26 U.S. Code 6503 – Suspension of Running of Period of Limitation
Bankruptcy does not automatically clear a filed lien from the public record. Even where the underlying debt is discharged, the lien and the filed notice can survive the case and continue to attach to property you owned when you filed.10Internal Revenue Service. Understanding a Federal Tax Lien
And even after the IRS releases a lien, the record of the original filing and the release may stay visible in county databases and commercial background-check systems for years.
Getting a Lien Off the Public Record
Two different outcomes sound similar but have very different effects.
A release happens when the debt is paid in full or has become legally unenforceable. The IRS must issue a certificate of release within 30 days of either event, and it can also release a lien if you post a bond covering the full amount.6Office of the Law Revision Counsel. 26 U.S. Code 6325 – Release of Lien or Discharge of Property A release lifts the lien from your property, but the filing itself remains in public databases with a notation that it was satisfied.
A withdrawal removes the Notice of Federal Tax Lien from public records entirely, as if it had never been filed. The IRS can withdraw a lien when the filing was premature or violated procedures, when you enter an installment agreement, when withdrawal will help the IRS collect, or when the National Taxpayer Advocate determines it serves both sides. Withdrawal is mandatory if the lien was filed in violation of an automatic bankruptcy stay or while a taxpayer was serving in a combat zone.11Internal Revenue Service. The Fresh Start Route to a Withdrawal
If you owe $25,000 or less and set up a Direct Debit Installment Agreement, you can request a lien withdrawal. If you owe more, you can pay the balance down to that threshold and then apply.10Internal Revenue Service. Understanding a Federal Tax Lien The request goes on Form 12277, which asks for your name, address, taxpayer identification number, a copy of the filed lien if you have one, your reason for the request, and authorization for the IRS to share information with creditors and credit reporting agencies.11Internal Revenue Service. Even though tax liens no longer appear on credit reports, a withdrawal is worth pursuing. Lenders who search public records directly will still find a released lien; they will not find a withdrawn one. That distinction can matter when you apply for a mortgage or business loan.
