IRS Form 3911, the Taxpayer Statement Regarding Refund, is the paper you file to open a formal trace on a federal refund the IRS says it issued but you never received. It also covers a refund check that arrived and then was lost, stolen, or destroyed before you could cash it. Filing it tells the IRS to work with the Bureau of the Fiscal Service (or, for direct deposits, your bank) to find out what happened and, in most cases, issue a replacement.
Before you send anything in, though, check whether a faster option will do the job.
Try the Faster Options First
You don’t always need to mail or fax a paper form to start a trace. Most individual filers can begin the process through the “Where’s My Refund?” tool at irs.gov, the automated refund hotline at 800-829-1954, or a live representative at 800-829-1040.1Internal Revenue Service. There is one exception. If you filed a joint return, the automated systems will not start a trace for you. You have to speak with a live representative or submit Form 3911.1Internal Revenue Service. Refund Inquiries
When You Can File Form 3911
The form covers two scenarios, both of which assume the IRS has already processed your return and issued the refund.3Internal Revenue Service. About Form 3911, Taxpayer Statement Regarding Refund
- The refund never arrived. Your direct deposit didn’t post, or your paper check never showed up.
- The check arrived and was then lost, stolen, or destroyed before you cashed it.
You also have to wait long enough. For direct deposits, wait at least five days after the deposit date shown in “Where’s My Refund?” For mailed checks, wait four weeks from the issue date, or six weeks if you live outside the state where the check was issued.3Internal Revenue Service. How to Fill Out Form 3911
The form is a single page in three sections. Keep your original return next to you as you fill it in, because several fields have to match it exactly.4Internal Revenue Service. Form 3911 (Rev. 10-2022) Taxpayer Statement Regarding Refund
Section I: Taxpayer and Return Information
Enter your current name, Social Security number or ITIN, and address. On Line 2, add your spouse’s name if the refund came from a joint return. Line 4 asks for the name and address as they appeared on the original return; write “N/A” if nothing has changed.
This section also captures the tax year, the type of return, the date you filed, whether you asked for a check or direct deposit, and the exact refund amount. If direct deposit, you have to provide the bank name, routing number, and account number from your original Form 1040. That banking information is what the IRS uses to trace the deposit through your financial institution.4Internal Revenue Service. Section II: What Happened
Line 8 gives you two boxes to choose from: you didn’t receive the refund at all, or you received the check and it was lost, stolen, or destroyed. One limit is worth noting up front. If you endorsed the check yourself and another person then cashed it, the IRS cannot issue a replacement, because no forgery occurred.4Internal Revenue Service. Form 3911 (Rev. 10-2022) Taxpayer Statement Regarding Refund
Section III: Signature
You sign under penalty of perjury that the information is accurate and that you’re asking for a replacement. Built into the certification is a promise that if you end up with two refunds, you’ll return one. For a joint return, both spouses must sign before the trace begins.4Internal Revenue Service. What Happens After You File
Once your form is in, the trace runs differently depending on how the refund was issued. For paper checks, the IRS asks the Bureau of the Fiscal Service (BFS) whether the check was cashed. For direct deposits, BFS contacts the receiving bank to confirm whether the money arrived and, if so, where it went.5Internal Revenue Service. 21.4.2 Refund Trace and Limited Payability – Section: 21.4.2.3 Refund Trace Process
Paper-check traces take about six weeks.5Internal Revenue Service. 21.4.2 Refund Trace and Limited Payability – Section: 21.4.2.3 Refund Trace Process Direct-deposit traces run longer because banks have up to 90 days from the trace date to respond, and full resolution can take up to 120 days.6Internal Revenue Service. If a paper check was never cashed, the IRS credits the amount back to your account and issues a new refund.5Internal Revenue Service. 21.4.2 Refund Trace and Limited Payability – Section: 21.4.2.3 Refund Trace Process If eight weeks pass without any word, call 800-829-1040 with your Social Security number and return details ready. Any interest the IRS owes on the delay is added to the replacement refund automatically, so you don’t need to ask for it separately.7Internal Revenue Service. Interest
If the Check Was Cashed by Someone Else
When the trace shows your check was cashed but you never received or endorsed it, the IRS sends you a forgery claim package. You fill out FS 1133 and sign it three times so BFS can compare your handwriting with the endorsement on the cashed check. Both payees sign if the check was issued to two people. Return the completed form together with the check copy to the BFS Check Resolution Division in Philadelphia. If Your Direct Deposit Went to the Wrong Account
If you entered the wrong routing or account number on your return and the money landed with someone else, the process is harder. The IRS does not take responsibility for taxpayer or preparer errors on banking details.6Internal Revenue Service. Refund Inquiries 18
Call the bank first and ask them to recover the funds. If five calendar days pass with nothing returned, file Form 3911 and the IRS will contact the bank on your behalf.6Internal Revenue Service. Refund Inquiries 18
Here is where the story can end badly. If the bank cannot recover the money or refuses to return it, the IRS has no authority to force the issue. Expired Refund Checks
U.S. Treasury checks carry “VOID AFTER ONE YEAR” above the disbursing officer’s signature. Under the Competitive Equality Banking Act, a Treasury check that isn’t cashed within one year of issuance is automatically canceled, and the funds go back to the issuing agency.9Department of the Treasury Bureau of the Fiscal Service. Don’t throw an expired check away, and don’t try to deposit it. Contact the IRS for instructions on returning it and asking for reissuance.4Internal Revenue Service. Form 3911 (Rev. 10-2022) Taxpayer Statement Regarding Refund The IRS can recertify the payment, but not on its own.
When Form 3911 Isn’t the Right Tool
Two situations look like missing refunds but call for a different form.
Identity theft. If the IRS tells you a return was already filed and a refund already issued, but you never filed that return, someone may have used your Social Security number. File Form 14039, the Identity Theft Affidavit, if you can’t e-file because your SSN is already in use, you get a tax transcript you didn’t request, a preparer contacts you about an account you didn’t open, or the IRS says you owe taxes on income you never earned. If you’ve already received IRS Letter 5071C, 4883C, or 5747C, follow the instructions in that letter rather than filing Form 14039.10Internal Revenue Service. When to File an Identity Theft Affidavit
Refund offset. If you got a smaller refund than expected, the Bureau of the Fiscal Service may have reduced it under the Treasury Offset Program to cover past-due child support, federal agency debts, state income tax, or certain state unemployment debts. BFS sends a notice showing the original refund, the amount taken, and the agency that received it. Dispute the debt with that agency, not the IRS. If you didn’t get the notice, call the BFS TOP call center at 800-304-3107, Monday through Friday, 7:30 a.m. to 5 p.m. CST.11Internal Revenue Service. The Deadline to Claim a Refund
There is a hard outer limit. You must file a refund claim within three years of the date you filed the original return or two years from the date the tax was paid, whichever is later.12Office of the Law Revision Counsel. 26 U.S. Code 6511 – Limitations on Credit or Refund Miss that window and the IRS legally cannot pay you, no matter how clearly you’re owed the money.
If you file after the three-year mark but within two years of paying the tax, your refund is capped at the amount you actually paid in those two years. This matters most when withholding was heavy in one year and the return wasn’t filed right away.13Taxpayer Advocate Service. Refund Statute Expiration Date (RSED)
If the IRS Denies Your Claim
A denial comes as Letter 105C or Letter 106C, which explains the decision. You can appeal in writing to the IRS Independent Office of Appeals, sending your explanation and supporting documents to either the address on the denial letter or the IRS office where you filed the original return.14Taxpayer Advocate Service. If the appeal doesn’t resolve things, you have two years from the date of the disallowance letter to file a refund suit in U.S. District Court or the U.S. Court of Federal Claims.13Taxpayer Advocate Service. Refund Statute Expiration Date (RSED)
