How to Report UK State Pension on a U.S. Tax Return: Treaty and FBAR

Your UK State Pension is reported on your U.S. federal return as fully taxable ordinary income on Schedule 1 (Form 1040), Line 8z, with “UK State Pension” written in the description field. That’s the short answer to how to report a UK State Pension on a US tax return: convert the year’s payments to dollars, enter the total on the catch-all “Other income” line, and let it flow into your Form 1040 as part of adjusted gross income. It does not go on the Lines 6a/6b reserved for U.S. Social Security, and no partial exclusion applies.

Where the Pension Goes on Your Return

IRS Publication 915 treats foreign social security benefits separately from U.S. Social Security, classifying them as taxable annuity-type income rather than the equivalent of a U.S. Social Security check.1Internal Revenue Service. U.S. Social Security can be up to 85% tax-free depending on income; the UK State Pension gets none of that treatment for U.S. residents.

Enter the full converted dollar figure on Schedule 1, Part I, Line 8z, and write “UK State Pension” in the description.2Internal Revenue Service. 2025 Schedule 1 (Form 1040) The Line 8z total moves to Schedule 1, Line 9, then to Form 1040, Line 8.

Report the gross amount, before any UK withholding. If the UK did take tax out, you address that with a foreign tax credit, not by shrinking the income figure.

Converting Pounds to Dollars

Everything on the return has to be in U.S. dollars, and the UK Department for Work and Pensions doesn’t send anything like a Form 1099. Pull your payment amounts from DWP correspondence, your Government Gateway account, or your UK bank statements.

For pension payments received across the year, the IRS lets you use the yearly average exchange rate published on its website. For 2025 the average rate for the British pound was 0.759, meaning one pound was roughly $1.32.3Internal Revenue Service. Why the UK Usually Shouldn’t Be Taxing It

Article 17(3) of the US-UK Income Tax Treaty says social security payments made by one country to a resident of the other are “taxable only in” the country of residence.4U.S. Department of the Treasury. Convention Between the Government of the United States of America and the Government of the United Kingdom – Article 17 The UK State Pension is paid under the UK’s social security system, so if you live in the United States, the U.S. has exclusive taxing rights and the UK should not be withholding.

If HMRC has been taking tax from your payments, you can apply for a refund and ask that withholding stop under the treaty.5GOV.UK. State Pension if You Retire Abroad – Paying Tax

The treaty’s Saving Clause in Article 1(4) preserves each country’s right to tax its own citizens and residents as if the treaty didn’t exist, which is why the IRS gets to tax this pension regardless.6Internal Revenue Service. U.S. Citizens and Resident Aliens Abroad

Foreign Tax Credit Only if the UK Actually Taxed It

Because the treaty hands taxing rights to the U.S., most U.S. residents have no UK tax on the State Pension to credit, and Form 1116 doesn’t come into it. Skip it.

If the UK did withhold or collect tax (say, HMRC hadn’t yet been notified of your treaty status, or you were UK-resident for part of the year), a Foreign Tax Credit prevents double taxation. If your total creditable foreign taxes for the year are $300 or less ($600 married filing jointly), you can claim the credit directly on Schedule 3, Part I, Line 1 and skip Form 1116 entirely.8Internal Revenue Service. Instructions for Form 1116 (2025)

When Form 8833 Is Required

Form 8833 discloses a treaty-based position that overrides what the Internal Revenue Code would otherwise require. The penalty for skipping it when required is $1,000.9Internal Revenue Service. Form 8833 – Treaty-Based Return Position Disclosure

If you’re simply reporting the pension as fully taxable and not using the treaty to reduce your U.S. tax, you’re not overriding the Code, and Form 8833 isn’t needed. It becomes necessary when you use the treaty to do something the Code alone wouldn’t allow, such as re-sourcing income to boost a foreign tax credit or claiming a treaty exemption for a pension. When in doubt, file it. The form costs nothing but time.

Recovering Cost Basis From National Insurance Contributions

If you paid UK National Insurance out of after-tax earnings, part of each pension payment may come back to you tax-free under the IRS General Rule. Publication 939 lays out the math: divide your total after-tax NI contributions by the expected number of payments based on your life expectancy, and exclude that fraction from each payment.10Internal Revenue Service. If the Pension Is Paid to a UK Bank Account

A UK account can trigger reporting requirements that are separate from income tax and apply even when no additional tax is due.

FBAR (FinCEN Form 114)

File an FBAR if the combined value of all your foreign financial accounts exceeded $10,000 at any point during the year. It’s filed electronically through FinCEN’s BSA E-Filing System, not with the IRS.11Financial Crimes Enforcement Network. How Do I File the FBAR? For FBAR purposes, convert each account’s maximum balance during the year using the Treasury’s year-end exchange rate, not the yearly average you used for income. That difference catches people out. Non-willful penalties start at a statutory $10,000 per violation (adjusted for inflation), and the Supreme Court held in Bittner v. Form 8938 (FATCA)

Form 8938 is filed with your return and covers a broader set of foreign financial assets, with higher thresholds that depend on where you live:

  • Single, living in the U.S.: total foreign financial assets over $50,000 on the last day of the year, or $75,000 at any time during the year.
  • Single, living abroad: over $200,000 on the last day, or $300,000 at any time.

Married-filing-jointly thresholds are higher; the instructions list every combination. The penalty for not filing is $10,000, with up to $50,000 in additional penalties for continued non-filing after IRS notification.13Internal Revenue Service. Fixing Past Years

Plenty of people receive a UK State Pension for years before realizing it belongs on the U.S. return. The IRS has specific paths back into compliance, and using them before the IRS contacts you preserves your best options.

If the only problem is missed FBARs and you properly reported and paid tax on the income from those foreign accounts, the Delinquent FBAR Submission Procedures generally let you file the late reports without penalty. Both routes require getting current: file the missing returns, pay the tax owed, and submit the delinquent information returns. In return, penalties are substantially reduced or eliminated.
