What to Do in the First 24 Hours
Call your bank first. Confirm the exact dollar amount frozen, the date the levy was received, and ask for a copy of the Form 668-A notice the IRS sent.4Internal Revenue Service. What if I Get a Levy Against One of My Employees, Vendors, Customers or Other Third Parties The levy date is what starts your 21-day clock, so pin it down before anything else.
Then call the IRS at the number printed on the levy notice, or at 1-800-829-1040 if you don’t have the notice yet. Before you dial, pull together your Social Security number or EIN, every IRS notice you can find (especially any CP504 or Letter LT11 you received in the months before the levy), and recent bank statements.5Internal Revenue Service. Grounds That Force the IRS to Release the Levy
Federal law lists specific situations in which the IRS must release a levy. When you meet one of them and document it, the agency doesn’t have discretion to refuse.2Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy and Return Property
- The tax has been paid in full, or the 10-year collection statute of limitations has expired.6Office of the Law Revision Counsel. 26 USC 6502 – Collection After Assessment
- You’ve entered into an installment agreement under IRC 6159.
- The levy is creating economic hardship, meaning it prevents you from covering basic living expenses like housing, food, utilities, and medical care.
- The levy was wrongful (wrong taxpayer, debt already paid, or exempt funds).
- Releasing the levy will actually help the IRS collect, for example by letting you keep operating a business.
- The frozen amount exceeds what you owe; the excess can be released.
Set Up an Installment Agreement
If you owe $50,000 or less, you can request a streamlined installment agreement with repayment stretched over as long as 72 months.7Internal Revenue Service. IRM 5.14.1 – Securing Installment Agreements Entering the agreement triggers a mandatory release. This is the fastest lever most taxpayers can pull inside the 21-day window.
Claim Economic Hardship
Hardship is the ground people most often qualify for and most often botch, because the IRS won’t act on a description of your situation over the phone. You need numbers on paper. Expect to complete Form 433-A (individuals) or Form 433-B (businesses), listing income, monthly expenses, and assets, and to back it up with rent or mortgage statements, utility bills, medical bills, insurance premiums, and grocery documentation.8Internal Revenue Service. Form 433-A – Collection Information Statement for Wage Earners and Self-Employed Individuals The IRS compares your expenses to its allowable living expense standards, so precise records matter more than a compelling story.
Offer in Compromise
An Offer in Compromise settles the debt for less than the full amount when there’s a legitimate dispute about the liability, when the IRS couldn’t realistically collect the full amount, or when full payment would be unfair given exceptional circumstances.9Internal Revenue Service. Topic No. 204, Offers in Compromise Review takes months, so an OIC alone won’t unfreeze your account in time. Pair it with a hardship request or an installment agreement if you need the levy lifted now.
Currently Not Collectible Status
If you genuinely can’t pay anything, the IRS can mark your account currently not collectible and pause collection activity, including the levy.10Internal Revenue Service. Temporarily Delay the Collection Process The debt itself doesn’t go away and penalties and interest keep running, but no new levies can be issued while the status holds. The IRS revisits your finances periodically to decide whether to resume collection.
Funds That Are Exempt From Levy
Some money is legally protected even when it’s sitting in the frozen account. The IRS won’t figure this out on its own; you have to trace the deposits.11Office of the Law Revision Counsel. 26 USC 6334 – Property Exempt From Levy
- Unemployment compensation, both federal and state.
- Workers’ compensation payments.
- Public assistance payments.
- Certain pension and annuity payments, including Railroad Retirement benefits and some service-connected military disability benefits.
- Amounts needed to satisfy a court-ordered child support judgment entered before the levy date.
- A portion of wages and salary based on filing status and dependents.
Bank statements showing direct deposits from a state unemployment agency, a workers’ comp insurer, or a benefits administrator are the cleanest proof. Deliver that documentation to the IRS well inside the 21-day window.
If You Share the Account With Someone Else
Joint accounts get frozen in full, even when only one owner owes the tax. The IRS treats all funds in a joint account as available to satisfy either owner’s debt and doesn’t attempt to split by contribution. A non-liable co-owner can request a partial release by proving that specific funds belong to them, using paycheck deposit records, benefit award letters, or separate income documentation. The wrongful-levy provisions of 26 USC 6343 support returning property that clearly belonged to a non-liable party.2Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy and Return Property A spouse who didn’t know about the underlying liability may separately qualify for innocent spouse relief. Whatever the theory, act inside 21 days. Recovering money is much harder once it’s left the bank.
When Phone Calls Aren’t Working: Formal Appeals
Two appeal routes exist, and they aren’t interchangeable.
Collection Due Process Hearing
If you received a Letter LT11 (Notice of Intent to Levy), you have 30 days from that letter to file Form 12153 and request a Collection Due Process hearing.12Internal Revenue Service. Collection Due Process (CDP) FAQs A CDP hearing lets you propose alternatives, challenge the underlying debt (if you haven’t had a chance to before), and preserves your right to take the case to U.S. Tax Court if IRS Appeals rules against you. Miss the 30 days and you lose the Tax Court option. Submit Form 433-A or 433-B with the request so the Appeals officer has your financials from the start.
Collection Appeals Program
CAP is faster and less formal, and it’s available even after a levy has already occurred. It begins with a conference with the collection employee’s manager. If that doesn’t resolve it, you must notify the Collection office within two business days that you plan to file Form 9423, and the form has to be postmarked within three business days of the manager conference.13Internal Revenue Service. Form 9423 – Collection Appeal Request The IRS generally pauses collection during a CAP appeal. The catch: the Appeals ruling is final, and you cannot take a CAP decision to Tax Court.
The Taxpayer Advocate Service
If the regular channels aren’t moving fast enough, or the levy is causing real financial harm, contact the Taxpayer Advocate Service at 1-877-777-4778.14Taxpayer Advocate Service. Contact Us TAS is an independent organization inside the IRS that can intervene when you’re facing economic hardship, when the IRS hasn’t responded within its own timeframes, or when IRS systems have mishandled your case. A case advocate can sometimes expedite a release that would otherwise take weeks. This is the option to reach for when you can document that the freeze is preventing you from paying rent, buying food, or keeping the lights on.
After the Release
Once the IRS agrees to release the levy, it sends Form 668-D (Release of Levy) to your bank.4Internal Revenue Service. What if I Get a Levy Against One of My Employees, Vendors, Customers or Other Third Parties Most banks unfreeze the account within a few business days of receiving it. Call the bank to confirm the release arrived and the account is accessible again.
If the levy was issued in error and you were charged bank fees because of it, you can file Form 8546 to recover those charges. Three conditions must all be met: the IRS caused the error, you didn’t contribute to it, and you responded promptly to IRS contacts before the levy went out.3Internal Revenue Service. Information About Bank Levies Recovering the seized funds themselves, rather than just fees, requires showing that the levy itself was wrongful, which usually means working through IRS Collections or a formal appeal.
