If you are filing Married Filing Separately without your spouse’s SSN, the IRS allows it in two situations: your spouse is a nonresident alien with no U.S. identification number, or you genuinely cannot locate your spouse. You paper-file Form 1040 with either “NRA” or “Refused” written in the spouse’s SSN field, and you attach a signed statement explaining the circumstances. E-filing is not an option, and the return needs to go in by mail with supporting detail the IRS can review.
Do You Qualify for the Exception
The IRS normally requires a spouse’s SSN or ITIN on every MFS return.1Internal Revenue Service. Nonresident Spouse Two circumstances get you out of that requirement.
Nonresident Alien Spouse
A nonresident alien is someone who is not a U.S. citizen and has not passed either the green card test or the substantial presence test.2Internal Revenue Service. Taxation of Nonresident Aliens If your spouse falls into this category and has no SSN, you can note the nonresident alien status on your return in place of a number. This exception only works if you have not elected to treat your NRA spouse as a U.S. resident for tax purposes, because that election would require the spouse to have either an SSN or an ITIN.1Internal Revenue Service. Spouse You Cannot Locate
If your spouse has left and you cannot find them or reach them to get the number, you can file without it. The IRS looks for two things: you and your spouse did not live together during the last six months of the tax year, and you made a reasonable effort to obtain the number before giving up.3Internal Revenue Service. Publication 504 (2025), Divorced or Separated Individuals No formal divorce or separation decree is required. What matters is that you honestly do not know how to reach your spouse.
Check Whether Head of Household Fits Better
Before committing to MFS, look at Head of Household. For 2026, the standard deduction for Head of Household is $24,150 compared to $16,100 for MFS, and the tax bracket thresholds are considerably wider.4Internal Revenue Service. You can file as Head of Household while still legally married if all of these are true:
- Your spouse did not live in your home during the last six months of the tax year.
- You paid more than half the cost of maintaining your home for the year.
- Your home was the main home of your child, stepchild, or foster child for more than half the year, and you can claim that child as a dependent.3Internal Revenue Service. Publication 504 (2025), Divorced or Separated Individuals
If your spouse is a nonresident alien and you have not elected to treat them as a resident, the IRS automatically considers you unmarried for Head of Household purposes. You still need a qualifying person other than your NRA spouse and must meet the other tests.1Internal Revenue Service. Nonresident Spouse
If you have a qualifying child living with you and your spouse is gone, Head of Household is almost certainly the better filing status. Fall back to MFS only if you cannot meet the qualifying child requirement.
What to Enter on Form 1040
Check the “Married filing separately” box in the Filing Status section. Enter your own SSN in the primary taxpayer field. Your spouse’s full legal name still goes on the return.
In the spouse’s SSN field, use one of these entries:
- If your spouse is a nonresident alien, write “NRA.”
- If you cannot locate your spouse, write “Refused.”
Do not leave the field blank. A blank field will flag the return as incomplete. These entries tell the IRS processing center you are claiming an exception, and the written statement you attach fills in the rest.
The Written Statement You Attach
A signed statement must go with your Form 1040. This is the document the IRS reviews to decide whether the exception is valid, so it needs specifics, not vague language. Cover four points:
- Confirm your filing status is Married Filing Separately.
- State the specific reason the SSN is missing. For an absent spouse, explain that you have been unable to locate them. For an NRA spouse, state that the spouse is a nonresident alien with no U.S. identification number.
- Describe the steps you took to obtain the SSN, including dates and methods, even if those attempts failed. The IRS wants to see genuine effort.
- Provide substitute identifying information: your spouse’s full legal name, last known address, and date of birth if you have it.
For the absent-spouse scenario, the statement should also confirm your spouse did not live in your home during the last six months of the tax year.3Internal Revenue Service. Consider an ITIN for a Nonresident Alien Spouse
Filing without any number is not your only path when your spouse is a nonresident alien. Your spouse can apply for an ITIN by submitting Form W-7.1Internal Revenue Service. Nonresident Spouse An ITIN puts a valid identification number on your return, which lets you e-file and avoids the longer processing times of a paper return.
The W-7 requires original or certified copies of identity documents such as a passport and can be submitted by mail or through an IRS-authorized Certifying Acceptance Agent. It is typically filed together with the tax return. If your spouse is willing to cooperate but simply lacks a U.S. identification number, this route is usually smoother than filing without any number, and it preserves the option to elect joint filing or resident treatment in a later year.
Mailing the Return
You cannot e-file a return with “NRA” or “Refused” in the spouse’s SSN field. E-filing systems validate SSNs against IRS records and will reject anything that is not a nine-digit number.5Internal Revenue Service. Age, Name or SSN Rejects, Errors, Correction Procedures Paper is the only route.
Your package includes the signed Form 1040, all applicable schedules, and the reasonable cause statement. Mail it to the IRS service center for your state; the address depends on your location and whether you are enclosing a payment, and the full table is on the IRS website.6Internal Revenue Service. Send it certified mail with a return receipt. Under federal law, the postmark date on a properly mailed return is treated as the filing date, and certified mail creates a legal record of that postmark.7Office of the Law Revision Counsel. 26 USC 7502 – Timely Mailing Treated as Timely Filing and Paying The IRS also accepts certain designated private delivery services such as FedEx and UPS. Keep a full copy of everything, including the statement. You will need it if the IRS follows up, and a return with an SSN exception often draws manual review.
What Filing MFS Costs You
MFS carries real tax penalties beyond the smaller standard deduction. If getting your spouse’s SSN or pursuing an ITIN is at all realistic, the credits and deductions you lose can be worth the effort.
- The Earned Income Tax Credit is unavailable to most MFS filers. A narrow exception exists if you lived apart from your spouse for the last six months of the year and have a qualifying child.8Internal Revenue Service. Filing Status
- The American Opportunity Credit and Lifetime Learning Credit are both off the table.
- The student loan interest deduction is not available.
- The child and dependent care credit is generally unavailable, with a narrow exception similar to the EITC rule.
There is also a forced itemization rule. If one MFS spouse itemizes, the other must itemize too and cannot take the standard deduction.9Internal Revenue Service. Community Property States Add Steps
If you live in Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, or Wisconsin, community property laws change how you report income on a separate return.10Internal Revenue Service. Publication 555 Community Property Normally, each MFS spouse reports half of the couple’s combined community income and attaches Form 8958 showing the division. When you cannot contact your spouse, splitting income accurately is nearly impossible.
A special rule helps. If you and your spouse lived apart for the entire tax year, did not file a joint return, and did not transfer earned income between yourselves, each spouse reports only the income they personally earned rather than splitting everything.10Internal Revenue Service. That effectively removes the community property problem for separated couples who qualify.
If your spouse earned community income you did not know about, you may qualify for relief from tax on that unreported income by showing you had no reason to know and that including it would be unfair.10Internal Revenue Service. Publication 555 Community Property
If Contacting Your Spouse Would Be Unsafe
Some taxpayers cannot obtain a spouse’s SSN because contacting the spouse would put them in danger. Two IRS protections matter here.
If you previously filed a joint return that has tax errors or debts, you can request innocent spouse relief by filing Form 8857. The IRS specifically recognizes domestic abuse as a reason someone may not have challenged items on a joint return, and signing under pressure or threat supports a claim for relief.11Internal Revenue Service. To prevent your spouse from filing a fraudulent return using your SSN, enroll in the IRS Identity Protection PIN program. The IP PIN is a six-digit number assigned to you each year and must appear on any return filed with your SSN. Without it, a return filed in your name will be rejected.
