What You Need Before You File
Clean payee data is the whole game. On your end, have your business’s legal name, address, and Employer Identification Number ready. For each recipient, you need their full name, address, and Taxpayer Identification Number, which is usually a Social Security Number for individuals or an EIN for businesses. The reliable way to collect this is a signed W-9 from every contractor before the first payment, not in January when people are hard to reach.
The core figure on each return is the total you paid that person during the year. For most payment types, you only file if you paid $600 or more.2Internal Revenue Service. Picking the Right Form
The two most common information returns are Form 1099-NEC and Form 1099-MISC, and mixing them up is a common mistake. Use 1099-NEC to report payments for services performed by someone who isn’t your employee: freelancers, independent contractors, outside service providers.4Internal Revenue Service. Deadlines
The 1099-NEC is due to the IRS by January 31, whether you file on paper or electronically. The 1099-MISC has a later deadline: February 28 on paper, March 31 electronically. If any deadline falls on a weekend or federal holiday, it shifts to the next business day. The recipient copy (Copy B) is due to the payee by January 31 for both forms.5Internal Revenue Service. Which Filing System to Use
You have three electronic options: the IRS IRIS Taxpayer Portal, the older FIRE system, or a third-party filing service. For most businesses, IRIS is the right choice. It’s free, web-based, requires no special software, and works for filers of any size. It’s also the future of IRS information return filing: FIRE is targeted for retirement after filing season 2027, at which point IRIS will be the only intake system.6Internal Revenue Service. FIRE remains available through filing season 2027 and is used mostly by high-volume filers and third-party preparers, because it requires you to build a data file formatted to the rigid technical specifications in IRS Publication 1220. Third-party providers handle the whole process for a per-return fee, which is worth considering if you want error checking and recipient copy delivery without learning the IRS systems yourself.
Filing Through the IRIS Taxpayer Portal
Step 1: Apply for an IRIS Transmitter Control Code
You need an IRIS-specific TCC before you can access the portal. This five-digit alphanumeric code is tied to your business. Apply through the IRS’s online IRIS Application for TCC page. The application is usually processed within 24 hours, though the IRS warns it can take up to 45 days. Don’t wait until January.7Internal Revenue Service. IRIS TCCs and FIRE TCCs are separate. If you already have a FIRE TCC and are transitioning to IRIS, you still need to apply for a new IRIS TCC.7Internal Revenue Service. IRIS Application for TCC
Step 2: Enter or Upload Your Returns
Once you have your TCC and log in, IRIS gives you two ways to input returns. For a small number of forms, type the data directly into the portal’s web interface. For larger batches, download the CSV template from IRIS, fill it in, and upload it. Each CSV file holds up to 100 records, and you can submit as many files as you need.8Internal Revenue Service. The portal flags input errors and missing information before submission, catching many problems that would otherwise result in a rejected filing or a penalty. Fix any flagged issues and submit. You should receive confirmation that the IRS accepted your returns within about 48 hours. Filing Through FIRE (High-Volume Filers)
If you’re already set up on FIRE, the process starts with obtaining a FIRE-specific TCC through the IR Application for TCC. The IRS recommends submitting that application by November 1 of the year before your filing deadline, since processing can take up to 45 days.10Internal Revenue Service. You then build a single data file containing all returns, formatted to Publication 1220 specifications, and upload it through the FIRE system using your TCC, User ID, and password. The system validates the file. If it’s rejected for formatting or data errors, you correct the problems and re-upload the entire file. After You File
Recipient Copies
Filing with the IRS is only half the job. You must furnish Copy B of each 1099 to the recipient by January 31 so they have documentation for their own return. The IRS offers fillable PDF versions of the recipient copies at IRS.gov, which you can complete online and deliver electronically or by mail.5Internal Revenue Service. Filing Corrections
If you discover an error after the IRS accepts your filing, submit a corrected return using the same electronic method you used originally. Prepare a new 1099 of the same type with the correct information. IRIS has a built-in correction feature for returns you previously submitted there. State Filing
Many states require their own copies of 1099 filings. The IRS runs a Combined Federal/State Filing program that automatically forwards your federal 1099 data to participating state tax agencies, potentially saving you from filing separately. Not every state participates, so check whether yours does before assuming the state obligation is covered.11Internal Revenue Service. Extensions
If you can’t meet the deadline, Form 8809 requests a 30-day extension. For most 1099 forms, including the 1099-MISC, the initial 30-day extension is automatic as long as you submit the request by the original due date. The 1099-NEC is the exception. It is not eligible for an automatic extension. If you need more time, you must submit a paper Form 8809 with a written justification, signed by the filer or an authorized representative, and the IRS reviews these on a case-by-case basis.13Internal Revenue Service. Penalties for Late or Incorrect Filing
Per-return penalties for tax year 2026 escalate the longer you wait:
- Up to 30 days late: $60 per return
- 31 days late through August 1: $130 per return
- After August 1 or never filed: $340 per return
- Intentional disregard: $680 per return, with no annual maximum
The same amounts apply to incorrect returns and to failing to furnish correct payee statements on time. Annual maximum caps apply for all tiers except intentional disregard, and those caps are lower for businesses with $5 million or less in average annual gross receipts. Backup Withholding When a TIN Is Missing or Wrong
If a payee fails to provide a correct Taxpayer Identification Number, or the IRS notifies you that a payee’s TIN doesn’t match its records, you must withhold 24% of future payments to that person and remit it to the IRS. Backup withholding applies to most 1099-reportable payment types, and you report the withheld amount in Box 4 of the applicable 1099.15Internal Revenue Service. The practical takeaway loops back to the start: collect W-9s from every payee before the first payment, verify the TIN they provide, and act quickly on any IRS mismatch notice. Chasing a correct TIN in December is much harder than getting it at the start of the relationship.
