Ways to Get an IRS Levy Released

Paying the Balance

Full payment is the fastest exit. Economic Hardship

Collection Due Process Hearing

When the IRS sends a final notice of intent to levy, you have 30 days to request a Collection Due Process hearing by filing Form 12153. A timely request stops the IRS from proceeding with the levy while the hearing and any appeal are pending, and it gives you a forum to propose alternatives or challenge the underlying tax. Why Private Creditor Levies Run on a Different Clock

A credit card company, medical debt collector, or similar private creditor cannot freeze your account on its own. It must first sue you, win a judgment, and obtain a writ of execution directing local law enforcement to levy the account. A sheriff or marshal then serves the writ on the bank.

There is no universal federal 21-day hold like the IRS levy has. Timing rules vary by state: some give you as little as 10 days to claim an exemption after notice, others allow 30 days or more. The sheriff’s office, the court’s schedule, and the bank’s internal procedures all shape the pace.

Your options for ending a private creditor levy include:

  • Paying the judgment in full, negotiating a lump-sum settlement, or agreeing to a payment plan the creditor accepts in exchange for releasing the levy.
  • Filing a claim of exemption with the court or levying officer if the frozen funds are legally protected. You will typically need bank statements or other documentation showing the source of the money, and most states schedule a hearing within a few weeks.
  • Filing for bankruptcy, which triggers an automatic stay that immediately halts almost all collection activity, including bank levies. How Fast the Money Comes Back After Release

Once a release order reaches the bank, the actual thaw depends on how it was delivered and how the bank processes it.

The fastest scenario is an IRS release sent by fax. If you resolve the issue by phone and the IRS faxes the release directly to your bank, same-day access is possible.4Internal Revenue Service. Standard mail adds days on the front end and more time once the bank has to process the paperwork. Private creditor releases usually take longer still, because the document typically travels from the creditor to the sheriff’s office and then to the bank, with each handoff adding time. A few days to two weeks is realistic. Weekends and bank holidays inside the processing window can push things out another day or two.

Funds Your Bank Protects Automatically

Not every dollar in the account is fair game for a private creditor. For garnishment orders from private creditors, federal regulation requires the bank to run a two-month lookback on your deposits, identify federal benefit payments, and protect that amount from being frozen. You do not have to file paperwork for the protection to apply. This covers Social Security, SSI, Veterans Affairs benefits, Railroad Retirement, and federal employee retirement benefits. IRS levies work differently. The IRS has broader collection powers than private creditors and can reach some funds that would be exempt from private garnishment.
