That 45-day figure is a floor, not a promise. Where you land in the range depends on when you apply, how clean your application is, and whether the IRS can verify your residency without asking for more documents.
When to File So the Timeline Works

There’s also a hard floor on the front end for current-year certification. The earliest postmark the IRS will accept is December 1 of the prior year. An application mailed earlier gets returned, and you lose your place in line entirely. What Determines Whether You Wait 45 Days or 90
The IRS doesn’t publish a fixed turnaround, and the realistic window sits between 45 and 90 days for most applicants. Several factors push you toward one end or the other.
Application volume. Early in the calendar year is the busiest stretch, because so many applicants need certificates for the current year. Whether the IRS has your return posted. If you filed your tax return shortly before submitting Form 8802, it may not be posted to IRS systems yet. In that case, expect a request for a signed copy of the return, and the clock stretches while you send it in.4Internal Revenue Service. Entity complexity. A straightforward individual application moves faster than a partnership, trust, or S corporation where multiple owners are seeking their own certifications. More parties means more review.
Name or TIN mismatches. If the name on your application doesn’t line up with IRS records, often the case after a name change, the certificate won’t issue until you clear it up.
Current-year requests. When you request certification for a year whose return hasn’t been filed yet, the IRS has nothing to verify against. You have to attach a penalties-of-perjury statement attesting that you’re a U.S. resident and will remain one for the entire tax year, and the specific language varies by entity type.3Internal Revenue Service. Mistakes That Reset the Clock
The fastest way to blow past 90 days is to submit something the IRS returns for correction. When that happens, processing hasn’t slowed; it hasn’t started. A few specific errors are responsible for most returned applications:
- Missing e-payment confirmation number. Since September 29, 2024, anyone paying the user fee through Pay.gov must upload a copy of Form 8802 at the time of payment. The agency tracking ID from the Pay.gov confirmation is your e-payment confirmation number, and it must appear on your application. - A P.O. box or “care of” address. Either one can be grounds for denial.
- A blank purpose field. You have to state whether you need the certificate for treaty benefits, a VAT exemption, or another purpose.
- A nontreaty country listed for treaty benefits. If the country you name doesn’t have an income tax treaty with the U.S., the application comes back.

Also worth knowing before you send anything: the $85 user fee for individuals and $185 fee for other entities covers a single Form 8802, regardless of how many countries or years you list on it. Checking Where Your Application Stands
Wait at least 30 days before calling. That’s the point at which the IRS commits to reaching out if there’s a delay, so calling earlier rarely produces useful information.1Internal Revenue Service. Delivery Adds Time on Top of Processing
Form 6166 arrives by mail once it’s approved, sent to the mailing address on line 3a of Form 8802, or, if that’s blank, to the address on line 2. You can also name a third-party appointee to receive it.1Internal Revenue Service. Instructions for Form 8802 (10/2024)
The IRS will mail to a foreign address if one is listed, but standard international mail is slow. If you want express delivery, include a prepaid DHL label and envelope for international, or a prepaid UPS or FedEx label for domestic. Without a prepaid label, the certificate goes by regular mail, and overseas applicants should factor in the extra transit time when planning.
If You Need More Copies Later
Additional copies of Form 6166 after your original request has been approved go through a streamlined path: file another Form 8802 and check the “Additional Request” box.
