A tax lien will not appear on your credit report at all. Since April 2018, Equifax, Experian, and TransUnion have excluded all tax lien data from consumer credit files, so a federal or state tax lien filed today will not show up on your credit report and will not factor into your FICO or VantageScore.1Experian. The lien is still a public record, and it can still block a mortgage, a property sale, or a security clearance.
What the Rules Used to Be
Before 2018, tax liens were among the most damaging entries a credit report could carry. Under the Fair Credit Reporting Act, a paid tax lien could stay on your report for seven years from the date you paid it, the same window that applies to most negative items like collections and charge-offs.2Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports
Unpaid liens were worse. The FCRA set no time limit on reporting them, which meant they could legally stay on a credit file indefinitely.2Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports In practice, most bureaus removed unpaid liens after roughly ten years, loosely tracking the IRS collection deadline, but there was no guarantee.1Experian. If you are looking at an older report that still shows a lien, or if you remember one being there and are wondering when it drops off, the answer is that it should already be gone. All tax liens were purged from consumer credit files at the three bureaus by April 2018. If one is still showing on your report, dispute it directly with the bureau.
Why the Bureaus Stopped Reporting Liens
The change came out of the National Consumer Assistance Plan, a settlement between the three major credit bureaus and more than 30 state attorneys general. The agreement tightened accuracy standards for public record data, including minimum identifying information and update frequency.3Consumer Financial Protection Bureau. Removal of Public Records Has Little Effect on Consumers’ Credit Scores Tax lien filings in local courthouses often lacked full Social Security numbers or dates of birth, which meant liens were regularly matched to the wrong consumer. Rather than fix the matching, the bureaus dropped the category.
This was not a change in tax law. The IRS can still file a lien against your property, and the lien has the same legal force it always did. The only thing that changed is whether the three big credit bureaus report it.
Where a Tax Lien Still Hurts You
Dropping off the three major credit reports does not make a tax lien disappear. A federal tax lien is filed in your local public records office and stays there until the IRS releases it. Anyone who looks can find it, and several categories of people routinely look.
- Mortgage lenders run a separate public records or title search before funding a loan. An outstanding tax lien discovered during that search will almost certainly stop the approval, whatever your credit file says.
- A federal tax lien attaches to all your property, including real estate. You generally cannot transfer clear title to a buyer until the lien is released or the property is formally discharged from it.4Office of the Law Revision Counsel. 26 USC 6321 – Lien for Taxes
- Specialty data providers like LexisNexis still collect and sell tax lien data to lenders as an FCRA-compliant product, filling the gap the credit bureaus left. - Federal background investigations for security clearances flag tax liens as a financial concern, and the SF-86 questionnaire asks about failure to file or pay taxes within the past seven years. An unresolved lien can delay or derail a clearance.
- Business credit is a separate world. Tax liens still appear on commercial credit reports from Dun & Bradstreet, Experian Business, and Equifax Business. Getting the lien off your credit report happened automatically in 2018. Getting the lien itself off your public record is still on you.
Release Is Not the Same as Withdrawal
Two IRS terms get used interchangeably and shouldn’t be, because the difference is exactly what determines whether the lien stops showing up in future searches.
A release means the IRS acknowledges the debt has been satisfied or the collection period has expired. Federal law requires the IRS to issue a Certificate of Release within 30 days after the liability is fully paid or becomes legally unenforceable.7Office of the Law Revision Counsel. 26 USC 6325 – Release of Lien or Discharge of Property The release lifts the lien’s hold on your property. It does not erase the public filing. The Notice of Federal Tax Lien stays in the record, stamped as released, and a title search will still find it.
A withdrawal goes further. When the IRS withdraws a lien notice, it files a withdrawal notice at the same recording office and treats the original filing as if it never happened.8Office of the Law Revision Counsel. 26 USC 6323 – Validity and Priority Against Certain Persons Withdrawal is what actually clears the public record. If you stop at release, the lien filing keeps turning up.
How to Get a Federal Tax Lien Withdrawn
Withdrawal is not automatic. You file Form 12277, Application for Withdrawal of Filed Form 668(Y), Notice of Federal Tax Lien.9Internal Revenue Service. Form 12277 – Application for Withdrawal of Filed Form 668(Y), Notice of Federal Tax Lien The IRS will grant withdrawal in any of the following situations:
- The lien notice was filed prematurely or not in accordance with proper procedures.
- You have entered an installment agreement to satisfy the debt, and the agreement did not require a lien to be filed.
- Removing the lien notice would actually help the IRS collect, for instance by letting you refinance and free up funds to pay.
- Withdrawal is in the best interest of both you and the government, with your consent or with the Taxpayer Advocate’s involvement.8Office of the Law Revision Counsel. 26 USC 6323 – Validity and Priority Against Certain Persons
If the IRS approves, it files Form 10916(c), Withdrawal of Filed Notice of Federal Tax Lien, at the recording office where the original lien was filed, and sends you a copy.9Internal Revenue Service. Form 12277 – Application for Withdrawal of Filed Form 668(Y), Notice of Federal Tax Lien Keep that notice permanently. You can also ask the IRS in writing to notify credit reporting agencies and specific financial institutions about the withdrawal.8Office of the Law Revision Counsel. 26 USC 6323 – Validity and Priority Against Certain Persons
State and local tax liens follow a similar release-then-withdrawal pattern, but forms and agencies differ. Contact your state’s Department of Revenue or local tax authority for the specific process.
Withdrawal Before You’ve Fully Paid
You do not have to wait until the debt is gone. Under the IRS Fresh Start initiative, taxpayers who owe $25,000 or less can request a lien withdrawal while still making payments, provided they meet all of the following:10Internal Revenue Service. Understanding a Federal Tax Lien
- You are enrolled in a Direct Debit Installment Agreement, not a regular payment plan. If you are on a regular installment agreement, you can convert it.
- Your balance is $25,000 or less. If you owe more, you can pay it down to $25,000 first.
- Your agreement fully pays the debt within 60 months or before the collection statute expires, whichever comes first.
- You have made at least three consecutive on-time direct debit payments.
- You are fully compliant on filings, and you have not defaulted on any current or previous Direct Debit Installment Agreement.
Most people assume the public lien filing is stuck there until the debt is fully cleared. The Fresh Start path can remove it years earlier, which matters if you are trying to buy property or secure financing while still paying down the balance.11Internal Revenue Service. If you are trying to sell or refinance property while a lien is still active, or if you believe the IRS’s 10-year collection window has already expired, there are separate procedures for those situations, including subordination, discharge of specific property, and requesting release based on an expired Collection Statute Expiration Date.
