Form 943, the Employer’s Annual Federal Tax Return for Agricultural Employees, is due January 31 of the year after you paid wages to farmworkers. For wages paid in 2025, the return is due January 31, 2026. If you deposited every dollar of federal employment tax on time during the year, you get an automatic extension to February 10. That’s the headline date, but it isn’t the only one on the calendar: deposits come due throughout the year, and W-2s to your workers and the Social Security Administration share the same January 31 deadline.
The January 31 Filing Deadline
Form 943 covers the full calendar year. You file one return summarizing the income tax, Social Security tax, and Medicare tax you withheld from farmworkers over those twelve months, plus the employer’s share of Social Security and Medicare.1Internal Revenue Service. The IRS grants an automatic ten-day extension when every required deposit was made on time. In that case you have until February 10 to file.2Internal Revenue Service. Topic No. 760, Form 943 – Reporting and Deposit Requirements for Agricultural Employers You don’t apply for it or notify anyone. The IRS checks your deposit history when it processes the return.
Deposit Deadlines During the Year
Filing once a year does not mean waiting until January to send money. You owe deposits as tax liability accumulates from each payroll. Which schedule you follow depends on how much tax you reported during a lookback period, which for Form 943 filers is the second calendar year before the current one. Monthly Depositors
If you reported $50,000 or less in taxes on your lookback-period Form 943, you’re a monthly depositor. Taxes accumulated during a calendar month are due by the 15th of the following month. Semi-Weekly Depositors

- Wages paid Wednesday through Friday: deposit due the following Wednesday.
- Wages paid Saturday through Tuesday: deposit due the following Friday.
Semi-weekly depositors also file Form 943-A (Agricultural Employer’s Record of Federal Tax Liability) with the annual return. The IRS uses it to verify each deposit was timely. The $100,000 Next-Day Rule
On either schedule, if your accumulated tax liability reaches $100,000 or more on any single day, the full amount is due by the next business day.2Internal Revenue Service. Topic No. 760, Form 943 – Reporting and Deposit Requirements for Agricultural Employers Hitting the threshold also moves you to the semi-weekly schedule for the rest of the current year and all of the next, which means you’ll owe Form 943-A too.4Internal Revenue Service. The $2,500 Small-Liability Exception
If your total Form 943 taxes for the year will be $2,500 or less, you don’t have to deposit at all during the year. You can pay the full amount when you file.2Internal Revenue Service. Topic No. 760, Form 943 – Reporting and Deposit Requirements for Agricultural Employers This is meaningful relief for small operations with only seasonal or part-time farmworkers.
W-2 and 1099 Deadlines Fall the Same Day
Every farmworker who received taxable wages needs a copy of Form W-2 by January 31 of the following year. Copy A of every W-2, along with Form W-3, is also due to the Social Security Administration by January 31.5Social Security Administration. If you file 10 or more information returns in total (W-2s, 1099s, and other forms counted together), you have to file them electronically.6Internal Revenue Service. E-File Information Returns Agricultural employers who also paid independent contractors $600 or more must send Form 1099-NEC to the recipients and the IRS by January 31 as well.
How Weekends and Holidays Shift the Date
Any federal tax deadline that lands on a Saturday, Sunday, or legal holiday moves to the next business day.7Office of the Law Revision Counsel. 26 U.S. Code 7503 – Time for Performance of Acts Where Last Day Falls on Saturday, Sunday, or Legal Holiday That applies to January 31, the February 10 extended deadline, monthly and semi-weekly deposit dates, and W-2 delivery. If January 31 falls on a Saturday, Form 943 and W-2s would both be due the following Monday, assuming Monday isn’t a holiday.
Penalties for Missing a Deadline
Late returns and late deposits are separate problems with separate penalty structures. Deposits are where the real financial exposure is, because those penalties build during the year rather than arriving as one bill in February.
Late Filing
Miss January 31 (or February 10, if you qualified for the extension) with tax still owing, and the penalty is 5% of the unpaid amount for each month or partial month the return is late, capped at 25%.8Internal Revenue Service. Failure to File Penalty If nothing is owed because everything was deposited during the year, the practical cost is lower, but the IRS can still assess penalties.
Late Deposits
The failure-to-deposit penalty is tiered by how late the payment arrives, and only the single highest applicable rate applies:9Internal Revenue Service. Failure to Deposit Penalty
- 1 to 5 calendar days late: 2% of the unpaid deposit.
- 6 to 15 calendar days late: 5%.
- More than 15 calendar days late: 10%.
- Still unpaid 10 days after the IRS sends a first delinquency notice: 15%.

Trust Fund Recovery Penalty
When you withhold income tax and the employee share of Social Security and Medicare from a paycheck, that money is held in trust for the government. Fail to turn it over, and the IRS can pursue a Trust Fund Recovery Penalty equal to 100% of the unpaid trust fund taxes against any person who was responsible for collecting and paying them over and who willfully failed to do so.11Internal Revenue Service. It follows the individual, not the business.
Filing and Paying by the Deadline
You can file Form 943 electronically through IRS-approved e-file software or a tax professional, or you can mail a paper return. E-filing gives you immediate confirmation the IRS received it, which matters when you’re close to the deadline. Paper filers should check the current Form 943 instructions for the right processing center address, since it varies by state and by whether payment is enclosed.
Federal tax deposits must be made electronically. The IRS accepts them through three free channels: your business tax account on IRS.gov, Direct Pay for businesses, and the Electronic Federal Tax Payment System (EFTPS).13Internal Revenue Service. Depositing and Reporting Employment Taxes EFTPS lets you schedule payments up to 120 days ahead, which is worth doing during harvest when payroll deadlines are easy to miss.
If you need to make a same-day deposit, common when the $100,000 next-day rule is triggered, you can arrange a same-day wire transfer through your bank. If you owe a balance when you file (rather than through deposits made during the year), you can pay through EFTPS, IRS Direct Pay, or a debit or credit card via an authorized third-party processor. Employers whose total annual liability is $2,500 or less can include full payment with the return.2Internal Revenue Service. Fixing a Return After the Deadline
If you find a mistake on a filed Form 943, correct it with Form 943-X. The window depends on the type of error. For overreported taxes (you reported and paid too much), you have three years from the date Form 943 was filed or two years from the date you paid the tax, whichever is later. For underreported taxes, the window is three years from the filing date.15Internal Revenue Service. Instructions for Form 943-X (Rev.
