An LLC must file Form 720, the Quarterly Federal Excise Tax Return, for any calendar quarter in which it collects or incurs a federal excise tax. That obligation is tied to the activity, not to the LLC’s size, revenue, or income tax classification. Most LLCs never touch excise taxes. The ones that do face strict semi-monthly deposit rules, and the penalties compound quickly if you miss them.
What Triggers a Form 720 Filing
The trigger is always something your LLC did during the quarter, not something about the LLC itself. The taxes on Form 720 fall into a handful of broad categories:
- Fuel taxes on gasoline, diesel, kerosene, aviation fuel, and other taxable motor fuels you produce, import, or sell.1Internal Revenue Service. Instructions for Form 720
- Air transportation taxes on passenger tickets and air freight. The passenger tax includes a percentage of the fare plus a per-segment charge; for 2026, the domestic segment fee is $5.30 per passenger.2Federal Aviation Administration. Current Aviation Excise Tax Structure and Rates 2026
- Environmental and Superfund taxes on ozone-depleting chemicals and listed taxable chemical substances, reported on Form 6627 attached to Form 720. The IRS keeps expanding the taxable list; recent additions include polyphenylene sulfide, nylon 6, and caprolactam. If you import a chemical substance and can’t calculate the exact tax, a default rate of 10% of the appraised entry value applies.3Internal Revenue Service. - Manufacturers’ excise taxes on sport fishing equipment, bows and arrow components, and certain firearms and ammunition.5Internal Revenue Service. Form 720 – Quarterly Federal Excise Tax Return
- The 10% tax on indoor tanning services.
- Vaccine manufacturer taxes charged per dose.
- Excise taxes on premiums paid to foreign insurers, ranging from 1% on life insurance and reinsurance to 4% on casualty coverage.
The PCORI Fee for Self-Insured Health Plans
One trigger catches employers off guard because it has nothing to do with the usual excise tax picture. If your LLC sponsors a self-insured health plan, you owe the Patient-Centered Outcomes Research Institute (PCORI) fee, and you report and pay it on Form 720.6Internal Revenue Service. For plan years ending between October 1, 2025, and September 30, 2026, the fee is $3.84 per covered life. Covered lives include employees, dependents, retirees, former employees, and anyone on COBRA. Multiply the average number of covered lives during the plan year by the applicable rate.
The PCORI fee is annual, not quarterly. For plan years ending in 2025, the return and payment are due by July 31, 2026.7Internal Revenue Service. Patient-Centered Outcomes Research Institute Filing Due Dates and Applicable Rates The obligation runs through plan years ending before October 1, 2029.
File Under the LLC’s EIN, Not Your SSN
For income tax, the IRS classifies an LLC as a disregarded entity, partnership, or corporation.8Internal Revenue Service. Limited Liability Company (LLC) Excise taxes work differently. Even a single-member LLC that is otherwise disregarded is treated as a separate entity for excise tax purposes, and must use its own name and EIN when filing Form 720, registering activities on Form 637, and claiming refunds on Form 8849.9Internal Revenue Service. This is where single-member owners most often trip up. Filing Form 720 under a personal SSN puts the return under the wrong taxpayer identification number and can trigger penalties and processing delays. Multi-member LLCs classified as partnerships or corporations also file under the LLC’s EIN. Regardless of income tax classification, excise taxes go under the LLC’s identity.
Quarterly Deadlines and Semi-Monthly Deposits
Form 720 is due on the last day of the month following each calendar quarter:1Internal Revenue Service. Instructions for Form 720
- Q1 (January–March): April 30
- Q2 (April–June): July 31
- Q3 (July–September): October 31
- Q4 (October–December): January 31
If a deadline lands on a weekend or federal holiday, it shifts to the next business day.
Filing the return is only half the obligation. Most taxes reported in Part I of Form 720 require deposits twice a month. The IRS defines the semi-monthly periods as the 1st through the 15th and the 16th through the last day of the month.10Internal Revenue Service. Notice 2025-55 – Relief from Penalty for Failure to Deposit Remittance Excise Tax Each deposit must equal at least 95% of the net tax liability for that period, and deposits are due within 14 days after the period ends. In practice, the deposit for days 1–15 is due by the 29th of the same month, and the deposit for days 16–end is due by the 14th of the following month.11Internal Revenue Service. Deposits must go through the Electronic Federal Tax Payment System (EFTPS). Enroll in advance and schedule payments at least one business day before they’re due.
The $2,500 Small-Liability Exception
If your LLC’s total net liability for Part I taxes is $2,500 or less for the entire quarter, you can skip the semi-monthly deposits and pay the full amount when you file the return. The exception applies only to Part I taxes. Part II taxes, including the PCORI fee, follow their own schedules regardless.
Fuel Credits on Schedule C
If your LLC buys taxable fuel and uses it for a nontaxable purpose, you can claim a credit on Schedule C of Form 720 instead of filing a separate refund claim. Qualifying uses include farming, off-highway business use, commercial fishing, school buses, use by nonprofit educational organizations, and export. Only the entity that actually purchased and used the fuel can claim the credit, and the credit offsets your excise tax on the same return, which can meaningfully reduce your payment.
Penalties Stack Fast
Three separate penalty regimes apply to Form 720, and interest runs on top of all of them.
Late filing. Filing Form 720 late without reasonable cause costs 5% of the unpaid tax per month or partial month, capped at 25%.12Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax The cap hits in five months.
Late deposits. Missing a semi-monthly deposit triggers its own penalty, tiered by how late the deposit lands:13Office of the Law Revision Counsel. 26 USC 6656 – Failure to Make Deposit of Taxes
- 1–5 days late: 2%
- 6–15 days late: 5%
- More than 15 days late: 10%
- Still unpaid 10 days after a delinquency notice: 15%
These apply to each missed deposit, not once per quarter. Miss both semi-monthly deposits in a month and you pay the penalty twice.
Interest. The IRS charges daily compounded interest on unpaid excise tax. The Q1 2026 underpayment rate is 7%,14Internal Revenue Service. Trust fund recovery penalty. Some excise taxes, including air transportation and indoor tanning, are collected from customers and held in trust for the IRS. If your LLC fails to pay those over, the IRS can personally assess a trust fund recovery penalty against any individual deemed responsible for collection and remittance. That reaches LLC members, officers, and employees with authority over tax payments. The penalty equals 100% of the unpaid trust fund tax.
Fixing a Mistake With Form 720-X
Errors on a filed Form 720 get corrected on Form 720-X, the Amended Quarterly Federal Excise Tax Return.16Internal Revenue Service. About Form 720-X, Amended Quarterly Federal Excise Tax Return Identify the specific quarter and explain the reason for the adjustment.
For overpayments, you generally have three years from the date the original return was filed or two years from the date the tax was paid, whichever is later.17Internal Revenue Service. Amended Quarterly Federal Excise Tax Return Miss that window and the refund claim is gone. If the correction produces additional tax, submit payment with the amended return to stop penalties and interest.
One boundary to know: Form 720-X cannot adjust most Schedule C credits from the original return. The only Schedule C items 720-X can correct are the tire credit under section 4051(d) and section 6426 fuel credits. Other Schedule C corrections use a different process.
Closing Out a Final Return
If your LLC stops all excise-taxable activity, don’t just stop filing. File a final Form 720 for the last quarter you had liability and check the “Final” return box above Part I. If there’s no tax for that final quarter, enter zero on the relevant lines, write “None” on Part III, line 3, and sign the return. Skipping the final return leaves the IRS expecting your next quarterly filing, and the notices will follow.
