Form 1096: What It Transmits, Filing, and Deadlines

Form 1096 is the one-page cover sheet a business sends to the IRS with paper copies of information returns such as 1099s, 1098s, and W-2Gs. Its official name is “Annual Summary and Transmittal of U.S. Information Returns,”1Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns and it works like a packing slip: it tells the IRS how many forms are in the envelope and what dollar totals they add up to. If the numbers on the 1096 don’t match the returns behind it, the IRS sends back a notice for corrections.

Do You Even Need Form 1096

Probably not. Starting in 2024, anyone filing 10 or more information returns in a calendar year must file them electronically, and that count is aggregated across all return types.2Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically Six 1099-NECs plus four 1099-MISCs equals 10 returns, and all of them have to go in electronically.3Internal Revenue Service. General Instructions for Certain Information Returns (2025) The old threshold was 250 returns per type, which is why older guides still mention that number.

When you e-file, you skip Form 1096 entirely; the transmittal function is built into the filing software.1Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns So the form now matters only to very small filers: those with nine or fewer total information returns who choose to mail them in on paper. Which Returns Form 1096 Transmits

Form 1096 accompanies paper copies of Forms 1097, 1098, 1099 (all variants), 3921, 3922, 5498, and W-2G.1Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns The ones most businesses actually encounter:

Each type of return gets its own 1096. If you issued 1099-NECs to contractors and 1099-INTs to account holders, prepare two separate Form 1096s and mail them in separate envelopes.5Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns

How to Fill It Out

The form is short but the IRS is strict about accuracy. At the top, enter your legal name and address, and put your EIN in Box 1 or your Social Security number in Box 2.5Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns

Box 3 is the total number of individual forms in the batch. Twelve 1099-NECs means “12.” Box 4 is total federal income tax withheld across all the attached forms, which is often zero on 1099s. Box 5 is the total dollar amount reported across the attached forms; the instructions specify which box on each return type to sum (for 1099-NEC, it’s Box 1 on every form). A few return types, including 1098-T, 1099-A, and 1099-G, don’t require a Box 5 entry.5Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns

Box 6 is a grid of checkboxes for the type of return you’re transmitting. You can only check one, which is the reason different return types need different 1096s. Sign and date at the bottom under the perjury declaration.

You Cannot Print Form 1096 From the IRS Website

This is where more filers slip up than almost anywhere else. The official Form 1096 is printed in a scannable red ink that ordinary printers don’t reproduce, and the form warns directly: “Do not print and file a Form 1096 downloaded from this website; a penalty may be imposed for filing with the IRS information return forms that can’t be scanned.”5Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns Photocopies are not accepted either.

Order official forms directly from the IRS through the ordering page on IRS.gov.6Internal Revenue Service. Order Paper Information Returns and Employer Returns Orders typically arrive within 15 business days. Many payroll and accounting programs also generate IRS-compatible scannable versions.

Deadlines and Where to Send It

The 1096 is due when the underlying returns are due. Two dates cover most situations:

  • January 31 for Form 1099-NEC. This same date applies to giving copies to recipients and to filing with the IRS.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
  • February 28 for most other paper information returns, including 1099-MISC, 1099-INT, 1099-DIV, and 1098. Electronic filing extends the same deadline to March 31.7Internal Revenue Service. 2026 Publication 1099

If a due date falls on a weekend or federal holiday, it moves to the next business day.

Paper filings go to one of two IRS processing centers depending on the state your business is in: Austin, TX 78714-9213, or Kansas City, MO 64121-9256. The current Form 1096 lists which states go to which center.5Internal Revenue Service. Form 1096 Annual Summary and Transmittal of U.S. Information Returns Ship the forms flat. The IRS scanners can’t process folded pages.

Need more time? Form 8809 requests an automatic 30-day extension for most information returns, including the 1099 series.8Internal Revenue Service. About Form 8809, Application for Extension of Time to File Information Returns Filed electronically through the IRS FIRE system by the original due date, it returns instant confirmation. The extension covers only the IRS filing; you still have to furnish recipient copies by the original deadline. Form 8809 is not available for W-2.

Fixing a Mistake After You’ve Filed

You don’t correct the original 1096. You send a new 1096 that transmits the corrected returns.3Internal Revenue Service. General Instructions for Certain Information Returns (2025) For a wrong dollar amount or wrong code on a 1099, prepare a corrected version of the 1099, attach it to a new Form 1096, check the “CORRECTED” box on the 1096, and mail it to the same processing center. Don’t include the original incorrect return.

For a wrong TIN, wrong payee name, or the wrong type of form entirely, the fix takes two returns: one to zero out the incorrect original and one carrying the correct information, both transmitted with a new 1096. Write “Filed To Correct TIN,” “Filed To Correct Name,” or “Filed To Correct Return” in the bottom margin of that 1096.3Internal Revenue Service. General Instructions for Certain Information Returns (2025) Use a separate 1096 for each return type you’re correcting.

What Late or Wrong Filing Costs

Penalties apply per information return, not per 1096, so the total scales with how many returns are affected. For returns due in 2026, the tiers are:9Internal Revenue Service. Information Return Penalties

  • $60 per return if corrected within 30 days of the deadline.
  • $130 per return if corrected after 30 days but by August 1.
  • $340 per return if filed after August 1 or not filed at all.
  • $680 per return for intentional disregard, with no annual cap.

Twenty late 1099-NECs filed after August 1 works out to $6,800. Small businesses with average annual gross receipts of $5 million or less get lower annual caps on total penalties, though the per-return amounts don’t change.10Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns The IRS can waive penalties for reasonable cause, meaning you exercised ordinary business care but still couldn’t comply. That request has to be in writing and signed under penalty of perjury. A phone call won’t do it.
