When you file taxes after a name change, the name on your Form 1040 has to match whatever the Social Security Administration currently has on file for your Social Security number. That means you have two workable paths: update your name with the SSA and then file under your new name, or leave the SSA record alone for now and file under your old name. Why the SSA Match Is the Only Thing That Matters
The IRS runs the name and Social Security number on every return against the SSA database. E-filed returns get rejected on the spot when the two don’t line up. What matters is the match, not which name you use. Got married in October and never made it to a Social Security office? File under your maiden name and the return processes normally. You can still choose “married filing jointly” while using your former name. The same is true after a divorce or a court-ordered name change: whichever name the SSA has, that’s the name your return needs to carry.1Internal Revenue Service. Updating Your Name with Social Security
If you want the new name on your tax return, start with the SSA. The service is free. Depending on your state, you may be able to begin the change through your personal my Social Security account online; otherwise, you can start online and finish at a local SSA office or Card Center, or file a paper Form SS-5 in person or by mail.2USAGov. You’ll need originals or certified copies of two things. Photocopies are not accepted.4Social Security Administration. Form SS-5 – Application for a Social Security Card
- Proof of the name change: a certified copy of your marriage certificate, divorce decree, or court order, showing both your old and new names.
- Proof of identity: a current, unexpired U.S. driver’s license, state ID, or U.S. passport. If none of those are available, the SSA accepts alternatives like a military ID, employee ID, or health insurance card.
Your new card typically arrives by mail within 5 to 10 business days, and the database updates around the same time the card ships.5Social Security Administration. Change Name with Social Security Don’t file under your new name until the card arrives or you’ve given the SSA at least two weeks. Filing early is how you cause the mismatch you’re trying to avoid.
Filing Under Your Old Name
If the SSA update isn’t done, use your old name. Nothing about the return needs to change except the name field. Your filing status, deductions, and everything else work the way they normally would. Next year, once the SSA record is settled, you’ll file under the new name for the full year, whenever during the year the change happened.
For joint returns, both names have to match SSA records independently. If one spouse changed names but hasn’t updated the SSA yet, that spouse uses their former name on the joint return while the other uses their own current SSA-registered name.1Internal Revenue Service. E-file or Paper
E-filing is stricter. Tax software checks the name and SSN against the SSA database in real time and kicks the return back immediately if anything is off. Paper returns may be accepted at intake and then flagged later during processing, which means weeks of delay before you find out there’s a problem. If you’re confident the SSA has your current name, e-filing is the fastest route. If you’re uncertain whether the update has gone through, filing on paper under your old name is safer than e-filing under a new name that may not be in the system yet.
Direct Deposit for the Refund
A paper refund check issued in a name your bank doesn’t recognize can be refused at the teller window. Direct deposit routes the refund by account and routing number rather than name, which avoids that problem. The IRS advises depositing only into an account in your own name.6Internal Revenue Service. When the Deadline Is Close
Tax season can push people to rush the SSA update. Don’t. If April 15 is coming and your SSA change isn’t complete, file on time under your former name and put the new name on next year’s return.
If you need more time for any reason, Form 4868 gives you an automatic six-month extension. No explanation required. You can file it electronically, on paper, or skip the form entirely by making an electronic tax payment before the deadline and letting the IRS process the extension automatically.7Internal Revenue Service. An extension does not push back your payment deadline. Anything you owe is still due April 15. Miss that, and interest accrues at 7% annually (compounded daily) plus a failure-to-pay penalty of 0.5% per month on the unpaid balance, up to 25%.8Internal Revenue Service. Fixing a Return That Went Out with the Wrong Name
If your e-filed return was rejected for a name mismatch, correct the name to match SSA records and resubmit. A rejection means the IRS never accepted the return, so you’re just filing, not amending.
If the return was actually accepted with a name problem, your options depend on the size of the fix. For a misspelling, call the IRS at 800-829-1040 and have them correct it.1Internal Revenue Service. Put your correct legal name on the amended return and note in the explanation section that you’re correcting a name change; no other figures need to move unless you’re fixing something else at the same time. A Refund Check Your Bank Won’t Take
If a refund check was issued in a name your bank won’t accept, or it never arrived because the name didn’t match the address on file, submit Form 3911 to request a replacement. You’ll sign a certification agreeing to return one refund if two ever show up.12Internal Revenue Service. Dependents and Adoptions
The same match rule applies to a dependent whose name has changed through adoption, a parent’s remarriage, or a court order. The name for that dependent on your return must match SSA records for the dependent’s SSN. To update it, submit Form SS-5 with proof of your authority to act for the child, the child’s identity documents, and proof of the name change.4Social Security Administration. If a domestic adoption isn’t final and you can’t yet get an SSN for the child, the IRS issues a temporary Adoption Taxpayer Identification Number so you can still claim the child.13Internal Revenue Service. Adoption Taxpayer Identification Number Once the adoption is complete and the child has an SSN, notify the IRS on Form 15101 so the permanent SSN gets linked to the child’s tax records.
ITIN Holders
If you file with an Individual Taxpayer Identification Number instead of an SSN, the update path is different. Submit Form W-7, check the box to renew an existing ITIN, put your new legal name on Line 1a, put your existing ITIN on Line 6f, and attach documentation supporting the name change (marriage certificate, divorce decree, or court order). Line 6f is what tells the IRS to attach your new name to the ITIN you already have. Leave it off and you can end up with a duplicate ITIN, which is a much bigger problem to unwind than the original name change would have been.
