Farm Cash Rent 1099: W-9, Deadlines, and Penalties

A tenant who pays $600 or more in cash rent to a single landowner during the calendar year must issue that landowner a Form 1099-MISC, with the total rent reported in Box 1.1Internal Revenue Service. Skip it and you face per-return penalties starting at $60 and running to $680 for intentional disregard, with the landowner picking up a separate underreporting problem on their end.2Internal Revenue Service. Which Landowners Need a 1099-MISC

The $600 test is cumulative across the year, not per payment. Pay $500 in the spring and $300 in the fall to the same landowner and you have crossed the threshold on the combined $800.

Entity type decides whether a form is required at all. Individuals, partnerships, estates, and trusts get a 1099-MISC. Payments to corporations, including an LLC that has elected to be taxed as a C or S corporation, are generally exempt.1Internal Revenue Service. Single-Member LLCs

A single-member LLC that hasn’t elected corporate treatment is a disregarded entity. The owner is the taxpayer, so the 1099-MISC goes out in the owner’s name with the owner’s Social Security number or EIN, not the LLC’s name or EIN.3Internal Revenue Service. Co-Owned Ground

When farmland is held by more than one owner, such as siblings who inherited a quarter section together, issue a separate 1099-MISC to each owner for the share that owner actually received. Split $30,000 of rent evenly among three co-owners and each gets a form showing $10,000. Each owner’s share has to independently meet the $600 threshold, though farm rent almost always clears that.

Cash Rent Only: What Doesn’t Go on the 1099

The 1099-MISC covers cash rent. A crop-share lease, where the landowner takes a percentage of the harvested crop instead of a fixed payment, doesn’t get reported on a 1099 from the tenant. Conservation Reserve Program payments also sit outside this system. CRP annual rental payments look like rent but the IRS treats them as farm income on Schedule F, line 4a, and they carry self-employment tax unless the recipient is drawing Social Security retirement or disability.5Internal Revenue Service. Conservation Reserve Program “Annual Rental Payments” and Self-Employment Tax If you’re a tenant, CRP isn’t your issue; if you’re a landowner receiving both cash rent and CRP, don’t combine them on the same schedule.

Splitting Rent From Services

Some arrangements bundle land use with hired work, for instance when the same person supplies the ground, the equipment, and the operator. The IRS wants those payments split. The rent portion goes in Box 1 of Form 1099-MISC. The services portion goes in Box 1 of Form 1099-NEC.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025) Dropping the whole payment onto a single form is a common error that triggers mismatch notices on both sides of the transaction.

Get the W-9 First

Collect a completed Form W-9 from each landowner before you write the first rent check. The W-9 supplies the legal name, address, taxpayer identification number, and entity classification you’ll need to prepare an accurate 1099-MISC.6Internal Revenue Service. If a landowner refuses to provide a W-9 or gives you a TIN the IRS flags as incorrect, you must begin backup withholding at 24% on every rental payment and remit those amounts to the IRS.6Internal Revenue Service. Instructions for the Requester of Form W-9 (Rev. March 2024) That is not a conversation you want to be having in October, which is why the W-9 belongs with the lease documents at signing.

Deadlines

  • January 31: furnish Copy B of the 1099-MISC to the landowner.
  • February 28: paper Copy A filings to the IRS, transmitted with Form 1096.
  • March 31: electronic filings to the IRS.

Electronic filing is required if you’re filing 10 or more information returns in the year, counted across all return types combined.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025) A farm operation issuing a few 1099-MISCs for rent alongside several 1099-NECs for custom work can hit that threshold quickly.

Many states also want a copy. The IRS Combined Federal/State Filing Program lets you transmit both in one electronic filing, but not every state participates, so check the landowner’s state before assuming the federal filing covers you.7Internal Revenue Service. What Penalties Look Like

The IRS assesses separate penalties for failing to file the correct return (Copy A to the IRS) and for failing to furnish the correct payee statement (Copy B to the landowner).   • Corrected within 30 days of the due date: $60 per return.
  • Corrected after 30 days but by August 1: $130 per return.
  • Filed after August 1, or not filed at all: $340 per return.
  • Intentional disregard: $680 per return, no annual cap.

A tenant renting from three landowners who simply forgets to file could be looking at up to $2,040 in penalties before interest: $340 for each of the three IRS copies plus $340 for each of the three payee statements. The intentional disregard tier is where the numbers get serious, because there is no ceiling.

Foreign Landowners Are a Different Regime

If the landowner is a nonresident alien or foreign entity, the 1099-MISC rules do not apply. Instead, you withhold 30% of the gross rent and report the payment on Form 1042-S.8Internal Revenue Service. A foreign landlord can also elect effectively connected income treatment by giving you Form W-8ECI in place of a W-9, which changes the withholding and reporting. Until a valid W-8ECI is on file, the statutory withholding applies, so get advice before writing the first check.
