Yes, the IRS can take your tax refund for child support, but only when specific conditions are met. Your state child support agency must submit the debt to the federal Treasury Offset Program, and the past-due amount must reach at least $150 if the custodial parent receives public assistance, or $500 if not. When those conditions apply, child support is the first debt paid from your refund, ahead of back taxes and every other federal or state obligation.

When the Offset Actually Happens

Two dollar thresholds decide whether a child support case is eligible for submission:

  • $150 in arrears if the custodial parent receives public assistance such as TANF
  • $500 in arrears if the custodial parent does not receive public assistance

The state child support agency decides whether to send your case forward. It certifies your name, Social Security number, and the amount owed, then routes that information through the federal Office of Child Support Services to the Bureau of the Fiscal Service.2NCSEA. Child Support Is Paid Before Every Other Debt

When more than one agency has a claim on your refund, child support wins. Under 26 U.S.C. ยง 6402, refund reductions follow a fixed order:

  • Past-due child support
  • Debts owed to federal agencies, including back taxes owed to the IRS
  • Past-due state income tax and state unemployment compensation debts

Refundable Credits Are Not Protected

Every dollar the IRS calculates as your overpayment is fair game, including refundable credits like the Earned Income Tax Credit and the Child Tax Credit. There is no carve-out that shields any portion of a refund from a child support offset. Notice Before the Offset and How to Check

Before your refund is intercepted, you should receive a Pre-Offset Notice from the state child support agency. It shows the past-due amount as of the notice date and explains your rights, including how to challenge the debt and request an administrative review.5Administration for Children & Families. Joint Returns and Injured Spouse Relief

If you file jointly and only your spouse owes past-due child support, the entire joint refund is still subject to offset. The system does not split the refund automatically. Your share disappears along with your spouse’s unless you take action.

You can attach Form 8379 to your joint return or file it later, after you receive an offset notice. The deadline is three years from the due date of the original return (including extensions), or two years from the date the tax was paid, whichever is later.8Internal Revenue Service. Hardship Won’t Stop a Child Support Offset

The IRS does have a tool called an Offset Bypass Refund that can release a refund when a taxpayer is facing genuine economic hardship, like an eviction or a utility shutoff. The realistic options are narrow: pay the arrears before the return is processed, successfully challenge the amount through the state agency, or get the underlying support order modified in court.

How to Dispute the Offset

The IRS did not decide to take your refund and cannot reverse the underlying debt. Disputes go to the state child support enforcement agency that submitted your case. Common grounds for a dispute:

  • The arrears have already been paid in full
  • The amount taken is more than what you actually owe
  • The debt belongs to someone else through identity or case error
  • A court modified the support order but the state hasn’t updated its records

If the agency never sent you a Pre-Offset Notice before submitting the case, raise that with the state as well. The agency is required to notify you of its intent to collect through offset and to explain your rights, including reviewing the debt and arranging repayment.

What Happens After the Refund Is Taken

Once the Bureau of the Fiscal Service matches your refund to a child support debt, it withholds some or all of the refund depending on how much is owed. You receive a Notice of Offset in the mail from the Bureau of the Fiscal Service, not from the IRS. Intercepted funds do not go straight to the custodial parent. The state agency that submitted the case typically receives the money within two to three weeks.
