Does Amazon Report to the IRS? 1099-K, 1099-NEC, and Backup Withholding

Yes. Amazon reports seller income to the IRS. For product sales it files Form 1099-K once you cross the federal threshold, and for service payments such as Amazon Associates affiliate commissions it files Form 1099-NEC once you’re paid more than $600 in a year. The IRS gets a copy of every form Amazon issues to you, and you owe tax on your business income whether a form is issued or not.

Why Amazon Has to Report

Amazon processes payments between buyers and sellers, which makes it a third party settlement organization under federal tax law. That status requires Amazon to file an annual return with the IRS listing each qualifying seller’s name, taxpayer identification number, and gross payment amount, and to send each seller a matching written statement by January 31 of the following year.1GovInfo. 26 USC 6050W – Returns Relating to Payments Made in Settlement of Payment Card and Third Party Network Transactions By the time your 1099-K lands in your inbox, the IRS already has its copy.

Form 1099-K: Product Sales

Form 1099-K reports the gross dollar amount of product sales Amazon processed for you during the calendar year. The current federal threshold is more than $20,000 in gross payments and more than 200 separate transactions.2Internal Revenue Service. Understanding Your Form 1099-K

Congress lowered the statutory threshold to $600 with no transaction count back in 2021.1GovInfo. 26 USC 6050W – Returns Relating to Payments Made in Settlement of Payment Card and Third Party Network Transactions The IRS has repeatedly postponed enforcement, so the $20,000/200-transaction test remains the operative standard.2Internal Revenue Service. What the Gross Amount Actually Includes

The 1099-K figure is not your profit. It’s the total of every reportable transaction before any adjustment for refunds, fees, shipping, or credits.3Internal Revenue Service. Instructions for Form 1099-K Amazon’s referral commissions, FBA fulfillment fees, and sales tax collected under marketplace facilitator laws all sit inside that one gross number.

This matters because the IRS treats the gross figure as the starting point for your income. If your 1099-K shows $80,000 but only $55,000 hit your bank account, the gap is fees, refunds, and sales tax. You back those out as deductions or adjustments on your return, but you need records to prove them. Sellers who never reconcile the difference are the ones fielding IRS notices later.

Timing

Amazon must send your 1099-K by January 31.1GovInfo. 26 USC 6050W – Returns Relating to Payments Made in Settlement of Payment Card and Third Party Network Transactions The form uses the disbursement date, not the sale date, so late December sales disbursed in January land on the following year’s form.

Form 1099-NEC: Affiliate and Service Income

Amazon uses Form 1099-NEC for service payments rather than product sales, and the threshold is much lower: $600 in total payments during the year.4Amazon.com Associates Central. Amazon Associates Help – 1099 NEC Tax Form This covers Amazon Associates commissions, referral bonuses, and independent contractor pay.

The 1099-NEC requirement generally applies to payments made to individuals, partnerships, and estates. Payments to corporations are usually exempt.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC If you run affiliate activity as a sole proprietor or individual, expect a 1099-NEC once you cross $600. If the business is incorporated, Amazon likely won’t file one, but the income is still taxable.

You Owe Tax With or Without a Form

A 1099-K or 1099-NEC does not create your tax obligation. It documents one that already exists. A seller who earned $8,000 and fell below every threshold still owes tax on that $8,000.

Sole proprietors and single-member LLCs report Amazon income on Schedule C with Form 1040.6Internal Revenue Service. About Schedule C (Form 1040) – Profit or Loss from Business (Sole Proprietorship) The 1099-K gross amount goes on the gross receipts line. From there you subtract cost of goods sold and business expenses, including Amazon’s fees and any sales tax Amazon collected as a marketplace facilitator, to arrive at net profit. That net profit is the number that gets taxed.

Net profit on Schedule C isn’t only subject to income tax. It also triggers self-employment tax at 15.3%: 12.4% for Social Security and 2.9% for Medicare.7Internal Revenue Service. Self-Employment Tax Social Security and Medicare Taxes The Social Security portion applies only up to $184,500 in combined wages and self-employment earnings for 2026.8Social Security Administration. Contribution and Benefit Base Above that cap, only the 2.9% Medicare portion continues. This catches new sellers off guard more than almost anything else.

Estimated Quarterly Payments

Amazon pays you out with nothing withheld unless backup withholding applies, which means you owe estimated taxes across the year rather than a lump sum at filing time. For the 2026 tax year, federal estimated payments are due April 15, June 15, September 15, and January 15, 2027.9Taxpayer Advocate Service. Making Estimated Payments

Skip them and you’ll face an underpayment penalty. You can avoid it by meeting one of the IRS safe harbors:10Internal Revenue Service. Underpayment of Estimated Tax by Individuals Penalty

  • Your total tax bill after withholding and credits is under $1,000.
  • Your estimated payments and withholding cover at least 90% of the current year’s tax.
  • Your estimated payments equal at least 100% of last year’s total tax, or 110% if your prior-year adjusted gross income exceeded $150,000 ($75,000 if married filing separately).11Internal Revenue Service. Instructions for Form 2210

The prior-year safe harbor is useful when your income is unpredictable. Divide last year’s tax into four, pay that, and you’re protected from penalties no matter how much this year grows.

When the IRS Flags a Mismatch

The IRS runs an automated matching program comparing Amazon’s 1099-K against the income on your return. When the numbers don’t line up, the system generates a CP2000 notice proposing changes and often an additional balance due.12Internal Revenue Service. Understanding Your CP2000 Series Notice

A CP2000 is not a bill and not an audit. It’s a proposed adjustment. The most common trigger for Amazon sellers is failing to account for the gap between the 1099-K gross and their actual taxable income. If your 1099-K shows $50,000 and you reported $35,000 on Schedule C without clearly documenting $15,000 in deductions and adjustments, the IRS assumes you underreported by $15,000.

If you receive one, review it carefully. If the IRS is just missing legitimate deductions, respond by the deadline with documentation of your actual expenses. If the notice is correct, follow the payment instructions; you don’t need to file an amended return.12Internal Revenue Service. Understanding Your CP2000 Series Notice

Backup Withholding

If you don’t give Amazon a valid taxpayer identification number, or the IRS tells Amazon the number you provided is wrong, Amazon must withhold 24% of your payments and send it to the IRS.13Internal Revenue Service. Topic No. 307, Backup Withholding This is automatic; Amazon has no discretion.

The fix is to correct your taxpayer information through the tax interview in Seller Central. Backup withholding then stops going forward, and the amounts already withheld get credited against your tax when you file.14Internal Revenue Service. Backup Withholding You’re not losing the money, but 24% held back from every payout is a real cash flow hit while it lasts.

Non-U.S. Sellers and State Rules

The rules above cover U.S. sellers. Foreign sellers sit in a different framework: most U.S.-source income paid to a nonresident is subject to a default 30% withholding rate that Amazon collects unless a valid Form W-8BEN is on file claiming treaty benefits.15Internal Revenue Service. NRA Withholding

Several states also set their own 1099-K thresholds below the federal $20,000/200-transaction level, some as low as $600. Amazon complies with each state’s rule independently, so you may receive a state 1099-K even when no federal one is issued, and the income needs to appear on your state return.
