Yes, ADP can file 1099s with the IRS on your behalf. It’s offered as part of ADP’s year-end tax compliance services, usually as an add-on to standard payroll rather than a default feature. ADP prepares the forms, prints and mails recipient copies, transmits the electronic file to the IRS, and handles most state submissions. What it will not do is verify your data. Every name, taxpayer identification number, payment total, and classification decision comes from you, and the IRS penalties for getting any of that wrong land on your business.

What ADP Actually Files

Before ADP transmits anything, you review and digitally approve a final proof of the 1099 data through the ADP portal. That sign-off is the moment responsibility for accuracy locks in on your side.

What You Still Have to Do

ADP files what you give it. It does not independently verify contractor names, addresses, or TINs, it does not decide whether a worker should be classified as an employee or a contractor, and it does not chase down missing W-9s.

Before you pay any contractor, get a completed Form W-9 on file. The W-9 gives you the contractor’s legal name, business name, tax classification, and TIN. If the name-and-TIN combination doesn’t match IRS records, you’ll face mismatch penalties later.4Internal Revenue Service. Payments you make outside the ADP platform, through direct bank transfers or checks written from a separate account, have to be entered or imported before ADP’s cutoff. If a payment slips through and you underreport a contractor’s compensation, the mismatch flag hits your business.

Exclude Card and Payment-App Transactions

One of the most common 1099 errors is double-counting payments made by credit card or through a third-party network like PayPal, Venmo, or Stripe. Those payments are reported on Form 1099-K by the payment processor, not on Form 1099-NEC by you.5Internal Revenue Service. If you paid a contractor $8,000 by check and $4,000 by credit card, only the $8,000 goes on the 1099-NEC. Getting this wrong inflates the contractor’s reported income and creates the exact kind of mismatch the IRS follows up on.

Reimbursed expenses, when properly documented and separated from service fees, should also be excluded from the reportable total.

ADP’s Deadline Is Earlier Than the IRS Deadline

ADP sets its own data submission cutoffs weeks before that, often in early to mid-January, so it has time to process forms across all clients. Treat ADP’s internal date as the real deadline. By the time January 31 arrives, your window to submit or correct data through ADP may already be closed.

Who Pays the Penalty When Something Goes Wrong

  • Corrected within 30 days: $60 per return
  • Corrected by August 1: $130 per return
  • After August 1 or never filed: $340 per return

The division of labor with ADP matters here. If ADP files late because you missed its internal cutoff, the IRS penalizes your business. If ADP files on time but with a wrong TIN because you entered it incorrectly, the penalty still lands on you. ADP is the messenger.

Backup Withholding After a TIN Mismatch

When the IRS finds that a name-and-TIN combination on a filed 1099 doesn’t match its records, it sends a CP2100 or CP2100A notice to the payer. For a completely missing or obviously wrong TIN, you must begin backup withholding immediately at 24% of all future payments to that contractor.4Internal Revenue Service. Backup withholding is not optional. Failing to withhold when required makes the business liable for the uncollected tax.

Fixing Errors After ADP Has Filed

If you discover an error on a 1099 that ADP already submitted, you’ll need to file a corrected return. ADP can file corrections on your behalf, but the window through ADP’s platform may narrow after the initial filing season. State Filings Through ADP

Most states require a 1099 filing at the state level as well. Not every state participates in CF/SF, and the IRS acts only as a forwarding agent with no responsibility for state compliance.
