Yes, a single-member LLC does get a 1099 in most cases. If your LLC keeps its default tax status as a disregarded entity, any client that pays it $2,000 or more for services in 2026 must send a Form 1099-NEC.1Internal Revenue Service. The answer flips if your LLC has elected to be taxed as a corporation, in which case most clients won’t send one at all.
Why Your Default Tax Status Matters
The IRS treats a single-member LLC as a “disregarded entity” by default. It ignores the LLC as a separate taxpayer and views all business income and expenses as belonging directly to the owner.2Internal Revenue Service. Clients report payments to you the same way they’d report payments to any individual contractor.
A disregarded LLC can use either the owner’s Social Security number or its own Employer Identification Number on a W-9. Either works for 1099 reporting. Many owners prefer the EIN so their Social Security number isn’t sitting on every W-9 they hand out.
This default isn’t permanent. An SMLLC can elect S corporation status by filing Form 2553, which the IRS also treats as an automatic election to be classified as a corporation.3Internal Revenue Service. When a Client Must Send Your SMLLC a 1099-NEC
If your LLC is a disregarded entity, a business client that pays it $2,000 or more for services during the calendar year is required to file a Form 1099-NEC and send you a copy.1Internal Revenue Service. Before a client can prepare that form, they need a completed W-9 from you. A disregarded SMLLC checks the box labeled “Individual/sole proprietor or single-member LLC” and supplies its TIN. When the client sees that box checked, they know a 1099 is on the hook once payments cross the threshold.
The $2,000 threshold applies to service payments made after December 31, 2025. Payments in earlier years still fall under the old $600 rule.1Internal Revenue Service. Form 1099 NEC and Independent Contractors
The Corporate Election Exception
Clients generally do not need to issue a 1099-NEC to a corporation, and that includes an LLC that has elected corporate tax status.5Internal Revenue Service. The signal to the client is the W-9: an SMLLC taxed as a corporation checks the “S Corporation” or “C Corporation” box instead of the sole proprietor box, and the client skips the 1099.
This is one reason some SMLLC owners elect S corporation status. Beyond the potential self-employment tax savings on distributions, it removes the 1099 paperwork between the business and its clients. The owner then takes a reasonable salary through payroll and gets a W-2 for that portion.
One important carve-out: payments for legal services always require a 1099, even when the firm or attorney is a corporation.6Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025) If your SMLLC provides legal services and has elected corporate status, your clients still have to report your fees on Form 1099-NEC.
Payments by Credit Card or Payment App
When a client pays your SMLLC by credit card, debit card, or through a third-party payment network such as PayPal or Venmo, they do not issue a 1099-NEC for that payment. The payment processor handles the reporting on Form 1099-K instead.7Internal Revenue Service. Form 1099-K FAQs – Third Party Filers of Form 1099-K The income isn’t reported twice.
For 2026, a 1099-K is required only when gross payments through the platform exceed $20,000 and there are more than 200 transactions.8Internal Revenue Service. IRS Issues FAQs on Form 1099-K Threshold Under the One, Big, Beautiful Bill Both conditions must be met. Whether or not a 1099-K arrives, the income is still taxable and belongs on your return.
What Payments Won’t Show Up on a 1099
Not every dollar your SMLLC earns triggers a 1099. Payments from individuals who aren’t running a business (a homeowner hiring you for a personal project, for example) don’t come with a 1099 at all. Payments from business clients that stay under $2,000 for the year don’t either. And, as above, card and app payments get routed through the 1099-K system instead. All of this income remains fully taxable regardless of what paperwork does or doesn’t arrive.
The Other Direction: When Your SMLLC Pays Contractors
Receiving 1099s is only half the picture. When your SMLLC pays an unincorporated contractor, a partnership, or another disregarded LLC $2,000 or more for services in a year, you’re the one who has to file a 1099-NEC, by the same January 31 deadline.1Internal Revenue Service. Backup Withholding If Your W-9 Is Off
If you don’t give a client a TIN, give them an incorrect one, or the IRS notifies them that your TIN doesn’t match its records, the client must withhold 24% of every payment and send it to the IRS.10Internal Revenue Service. The same rule works in reverse when a contractor you’re paying fails to give you a valid TIN: you become responsible for the 24% withholding on their payments.11Internal Revenue Service.
