Do You Have to Report eBay Sales on Taxes? 1099-K and Schedule C

Profit from selling on eBay is taxable income under federal law, whether or not the platform sends you a tax form. Reporting eBay sales on your taxes comes down to one question: did you make money? Someone clearing out a closet and taking a loss on used goods generally owes nothing. Someone flipping items for profit, or running eBay like a side business, owes income tax and possibly self-employment tax on the net gain. Which Kind of Seller Are You

The IRS does not treat “eBay seller” as a category. It treats your activity as one of three things, and the tax treatment for each is different.

The IRS decides business versus hobby by looking at factors like whether you keep business-like records, put in serious time, depend on the income, and have actually turned a profit in three of the last five years.3Internal Revenue Service. What a 1099-K Means (and What It Doesn’t)

Form 1099-K is an informational document eBay sends to you and the IRS showing your gross payment volume for the year.4Internal Revenue Service. Understanding Your Form 1099-K “Gross” means it includes buyer-paid shipping, sales tax eBay collected, and the fees eBay took out before paying you. The number on the form will be larger than what actually landed in your bank account.

The federal threshold went through several years of proposed changes before being reinstated. Under the One, Big, Beautiful Bill Act, eBay is required to issue a 1099-K only when your gross payments exceed $20,000 and you have more than 200 transactions in the year. The reinstatement is retroactive and applies to current and prior tax years.5Internal Revenue Service. Here is what people miss: the threshold controls when eBay has to send the form. It does not control when you have to report income. If you cleared $8,000 in profit but stayed under 200 transactions, you still owe tax on that profit.6Internal Revenue Service. What to Do With Form 1099-K A few states also set their own lower thresholds, so you may receive a 1099-K for state purposes even when you fall below the federal cutoff.

Personal Items You Sold at a Loss

This is the situation most casual sellers are in. You sold used furniture, an old phone, or clothes for less than you originally paid. You owe no tax because there was no gain. But if the total was large enough to generate a 1099-K, you still need to account for the form on your return so the IRS matching system doesn’t treat the whole amount as taxable.

The IRS gives you two ways to do that:6Internal Revenue Service. What to Do With Form 1099-K

  • Report the gross amount at the top of Schedule 1 and enter an offsetting adjustment below it, so the net is zero.
  • List the sales on Form 8949, showing sale price and original cost, and carry the result to Schedule D. The loss itself is not deductible against other income, but the entries explain why nothing is owed.

Either works. The one thing you should not do is ignore the 1099-K. When the IRS receives a form showing income and your return shows none, its automated system generates a notice, and answering that notice takes more time than the original filing would have.

Personal Items You Sold at a Profit

If a personal item sold for more than you paid, the difference is a capital gain. Report the sale on Form 8949 with your cost basis, sale price, and dates of purchase and sale; totals flow to Schedule D.7Internal Revenue Service. Held a year or less, it is taxed as short-term gain at your ordinary rate. Losses on personal-use property are not deductible, so the treatment runs one way only.

Business Sellers: Schedule C and What You Can Deduct

If your activity is a business, taxable income is net profit: gross receipts minus legitimate expenses, all reported on Schedule C.8Internal Revenue Service. Instructions for Schedule C (Form 1040) (2025)

The biggest line for most eBay sellers is cost of goods sold: beginning inventory, plus purchases, minus ending inventory. When you convert a personal item into business inventory, your basis is the lesser of what you originally paid or the item’s fair market value on the date it entered inventory.9Internal Revenue Service. Beyond inventory, ordinary operating expenses are deductible:

  • eBay final value fees, insertion fees, promoted listing charges, and store subscriptions.
  • Payment processing fees.
  • Postage, boxes, tape, bubble wrap, and label printing.

  • Listing software, inventory apps, and the business-use share of your internet.
  • li>Accountant or tax preparer fees tied to the business.

A dedicated space used regularly and exclusively for the business qualifies for the home office deduction. The simplified method pays $5 per square foot up to 300 square feet, for a $1,500 maximum; the actual-expense method uses a proportional share of housing costs and usually produces a larger number if you keep the records.11Internal Revenue Service. Self-Employment Tax

Once net profit reaches $400, it is also subject to self-employment tax at a combined 15.3% rate covering Social Security and Medicare.12Internal Revenue Service. Hobby Sellers: Income Without Deductions

Hobby income goes on Schedule 1 (Form 1040), Line 8j as other income.15Internal Revenue Service. 2025 Schedule 1 (Form 1040) The hard part: hobby sellers pay income tax on the full gross amount and cannot deduct supplies, shipping, or eBay fees against it. The Tax Cuts and Jobs Act eliminated the hobby expense deduction and later legislation made that permanent. This is why the business-versus-hobby line matters so much. Get it wrong toward hobby and you lose every deduction; claim business losses year after year without a genuine profit motive and you invite scrutiny.

Quarterly Estimated Payments

eBay does not withhold income tax or self-employment tax from your payouts. If you expect to owe $1,000 or more in federal tax after accounting for any withholding from a regular job, you generally need to make quarterly estimated payments.16Internal Revenue Service.   • April 15 for January through March income.
  • June 15 for April and May.
  • September 15 for June through August.
  • January 15, 2027 for September through December.

Miss a deadline and you owe an underpayment penalty that works like interest on the shortfall. If your eBay income is uneven, a workable habit is to move 25% to 30% of each month’s net profit into a separate savings account and pay from that.

Records to Keep

Every reported number should have documentation behind it: purchase receipts for inventory, shipping receipts, eBay fee statements, a mileage log, and records for any other deduction.18Internal Revenue Service. Three years after filing is the minimum retention period for most returns. Underreport by more than 25% and the IRS has six years to audit; skip filing entirely and there is no time limit at all.19Internal Revenue Service. How Long Should I Keep Records Six years is a comfortable default.

Sales Tax Is Handled Separately

Sales tax is not the same thing as income tax, and for eBay it is mostly not your problem. Under marketplace facilitator laws in effect across nearly all states, eBay collects sales tax from the buyer and remits it to the state directly. You generally do not register for a sales tax permit or file state sales tax returns for transactions eBay processed in those states. One thing to watch: the sales tax eBay collected on your behalf can appear inside the gross figure on your 1099-K, so account for it when reconciling the form against your actual revenue.
