If you paid a non-employee $2,000 or more through Venmo during the 2026 tax year for services performed for your business, you generally need to send them a Form 1099-NEC. The payment method doesn’t change the rule. What matters is whether the payment was a business expense and whether Venmo itself will report it on a 1099-K, in which case you can skip the 1099-NEC for that payment. Because Venmo’s 1099-K threshold is high, most business payers using the app will still owe a 1099-NEC.
When a 1099-NEC Is Required
Four conditions trigger the 1099-NEC requirement for a payment made in 2026: the person you paid is not your employee, the payment was for services performed in the course of your trade or business, the recipient is an individual, partnership, or estate (not generally a corporation), and total payments to that person reached $2,000 or more during the year.1Internal Revenue Service. The trade-or-business condition is the one most people miss. If you pay a house cleaner $2,500 through Venmo for work at your personal residence, no 1099-NEC is required because the payment isn’t a business expense. If you pay a graphic designer $2,500 through Venmo for a business logo, it is.
Non-service payments follow a different form. Rent, prizes, and similar categories go on a 1099-MISC, which shares the $2,000 threshold for 2026 payments; royalties have their own $10 threshold.3Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information
When Venmo’s 1099-K Covers the Payment Instead
The IRS doesn’t want the same payment reported twice. When a business payment runs through a third-party settlement organization like Venmo and qualifies as a “third-party network transaction,” Venmo takes on the reporting through Form 1099-K and you don’t file a separate 1099-NEC for it.4Internal Revenue Service. Two things have to be true for this exception to actually apply. First, the payment has to be classified inside Venmo as a goods-and-services transaction. Payments sent through Venmo’s personal payment feature aren’t treated as reportable, even if the money was really for business work. Second, the recipient has to actually cross Venmo’s 1099-K threshold.
That threshold is high. Under the One, Big, Beautiful Bill, the 1099-K threshold reverted to its pre-2021 level: Venmo issues a 1099-K only when a user receives more than $20,000 in gross goods-and-services payments and has more than 200 separate transactions in the calendar year. Both conditions must be met.5Internal Revenue Service. The practical consequence for a business payer: most freelancers you hire won’t cross $20,000 and 200 transactions on Venmo. If you pay a web developer $3,000 through Venmo and they don’t hit those numbers on the platform, Venmo won’t send them a 1099-K. Your 1099-NEC is then the only information return the IRS receives for that payment. Don’t assume Venmo is handling the reporting.
Venmo Payments That Never Need a 1099
Several categories are outside the 1099-NEC requirement regardless of amount:
- Personal payments. Splitting a meal, reimbursing a friend, or sending a gift is never a business transaction and never triggers a 1099.
- Payments to employees. Employee wages go on a W-2, not a 1099-NEC, even if you happen to pay them through Venmo.
- Payments to corporations. If your contractor operates as a C corporation or S corporation, including an LLC taxed as one, you generally don’t file a 1099-NEC. Their W-9 tells you the entity type.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)
- Payments to a non-employee totaling less than $2,000 for the 2026 year.2Internal Revenue Service. Form 1099 NEC and Independent Contractors
Attorneys are the exception to the corporation exception. Legal fees paid in the course of your business go on a 1099-NEC even when the law firm is a corporation.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025) If your business pays a lawyer $2,000 or more through Venmo in 2026, report it.
Tag the Payment Correctly in the App
Venmo lets you send money as either a personal payment or a goods-and-services payment. That tag decides whether Venmo tracks the payment toward the recipient’s 1099-K total.
Payments sent to a Venmo Business Profile are automatically classified as goods and services. There’s no override.7Venmo. Venmo Purchase Protection – Buyers and Sellers Some contractors prefer to skip that fee by asking to be paid as a personal payment, but misclassifying business work as personal creates problems on both sides. The contractor’s income goes unreported by the platform, and you lose any ability to rely on the TPSO exception to your own 1099-NEC obligation.
The reverse mistake matters too. Tagging a genuinely personal payment as goods and services inflates the recipient’s 1099-K total and forces them to reconcile income that was never really income. Match the tag to the reality of the payment.
Get a W-9 Before You Pay
Before you make the first payment to any contractor you might pay $2,000 or more, collect a completed Form W-9. It gives you the contractor’s taxpayer identification number and legal name, which you need to prepare a correct 1099-NEC.9Internal Revenue Service. Form W-9 (Rev. March 2024)
If a contractor refuses to provide a W-9 or gives you an incorrect TIN, you’re required to withhold 24% of their payment as backup withholding and remit it to the IRS.10Internal Revenue Service. Deadlines for the 2026 Filing Season
For the 2026 tax year, the IRS filing deadline for 1099-NEC is February 28 on paper and March 31 electronically. If either date falls on a weekend or federal holiday, it moves to the next business day.12Internal Revenue Service. General Instructions for Certain Information Returns (For Use in Preparing 2026 Returns) Recipient copies also have to be furnished to each contractor; confirm the furnishing date in the current year’s instructions.
Businesses filing 10 or more information returns during the year are required to file electronically. Smaller filers can still use paper, but electronic filing through the IRS FIRE system or a payroll service is faster and less error-prone.
Penalties for Missing or Late 1099s
Penalties apply per form and escalate the longer you wait. For information returns due in 2026:13Internal Revenue Service. Information Return Penalties
- Up to 30 days late: $60 per form
- 31 days late through August 1: $130 per form
- After August 1 or never filed: $340 per form
- Intentional disregard: $680 per form, with no maximum cap
The penalty applies separately to each return you fail to file and each payee statement you fail to furnish, so a single missed contractor can generate two penalties. Skipping 1099s for five contractors easily produces $3,400 or more in penalties before the IRS looks at whether the failure was intentional. The intentional disregard tier has no ceiling.
Records to Keep for Venmo Business Payments
Venmo’s transaction log shows amount, payee, and date, which are the basics the IRS expects for a business expense.14Internal Revenue Service. Publication 583, Starting a Business and Keeping Records It isn’t enough on its own. Keep invoices, contracts, or written descriptions of the services alongside the Venmo record. A memo that just says “design work” won’t hold up as well as a signed engagement and an invoice.
Retain these records for at least three years after filing, which is the standard IRS assessment window. If you underreport income by more than 25%, the window extends to six years, and there’s no time limit at all in fraud cases.15Internal Revenue Service. Also keep every W-9 on file, and if you use one Venmo account for both personal and business activity, log each business transaction separately with date, amount, recipient, and purpose. Contractors receiving business payments should use a dedicated Venmo Business Profile instead of mixing commercial and personal transactions.
Zelle Works Differently
Zelle facilitates direct bank-to-bank transfers rather than holding funds as an intermediary, so it does not function as a third-party settlement organization and does not issue 1099-K forms. If you pay a contractor through Zelle, there is no platform-level reporting at all, and your 1099-NEC obligation always applies once you cross the $2,000 threshold. The TPSO exception is never available for Zelle payments.
