Do I Need to Issue a 1099 for Advertising? Rules and Deadline

You need to issue a 1099 for advertising whenever your business paid $600 or more during the calendar year to an individual, partnership, or LLC for advertising services such as copywriting, graphic design, media strategy, or social media management. The form to use is the 1099-NEC. Payments to corporations, payments run through a credit card or payment app, and money spent on ad space itself are the main situations where no 1099 is required, even if the total sails past $600.

The $600 Rule for Advertising Services

The reporting obligation begins once total payments to a single vendor reach $600 in a calendar year for services performed.1Internal Revenue Service. The threshold applies per vendor, not per project.

Any entity you run with the intent to earn a profit counts as a trade or business for this purpose: sole proprietorships, partnerships, LLCs, and corporations all qualify. Nonprofits that pay a freelancer for a fundraising campaign also have a reporting obligation. Purely personal payments (hiring a designer for a birthday party invitation, for example) are the one clear carve-out.

The specific type of advertising work doesn’t change the analysis. Campaign strategy consulting, website copywriting, video production, search engine optimization, and branding projects are all nonemployee compensation when performed by someone who isn’t your employee.2Internal Revenue Service. When You Don’t Need to Issue a 1099

Three situations account for most of the advertising payments that don’t require a 1099-NEC. Getting these right prevents wasted paperwork and keeps you from sending vendors forms they shouldn’t receive.

Payments to Corporations

Payments to C-corporations and S-corporations for advertising services are generally exempt, even when they exceed $600.1Internal Revenue Service. Many established agencies are organized as corporations, so a large share of typical advertising spend falls outside the reporting rules for that reason alone. The vendor’s W-9 tells you their entity type. If they check the box for C-corp or S-corp, no 1099-NEC.

The corporate exemption has narrow exceptions. Payments to incorporated law firms for legal services still get reported on a 1099-NEC, and medical or healthcare payments to corporations go on a 1099-MISC.3Internal Revenue Service. Payments by Credit Card or Payment App

Pay a vendor through a credit card, debit card, or a third-party settlement organization such as PayPal or Venmo, and you don’t issue a 1099-NEC. The payment processor picks up the reporting through a Form 1099-K to the vendor.4Internal Revenue Service. Zelle is the platform that catches people out. It transfers funds directly between bank accounts rather than holding money in a settlement account, so under current law it isn’t classified as a third-party settlement organization. Payments through Zelle are treated like check or wire payments: you’re still on the hook for a 1099-NEC once the total hits $600.

The practical point: track how you paid each vendor, not just how much. A $2,000 payment to a graphic designer by check requires a 1099-NEC. The same $2,000 on a business credit card does not.

Buying Ad Space vs. Buying Advertising Services

Buying advertising space or airtime counts as purchasing merchandise, not paying for services. A newspaper display ad, a sponsored post purchased directly from a social media platform, or television airtime are product purchases, and no 1099-NEC is required.2Internal Revenue Service. The line gets blurry when a single vendor provides both creative work and media placement. Say you pay a freelance marketing consultant $8,000 for the year, and $3,000 of that is their creative work while $5,000 is a pass-through for ad placement costs. If those placement costs are clearly separated on invoices and backed by receipts, you may be able to report only the $3,000 service portion. If everything is lumped into one fee, the full $8,000 goes in Box 1.

Get a W-9 Before You Pay

Request a completed Form W-9 from every new advertising vendor before you pay them. The W-9 gives you their legal name, address, taxpayer identification number, and entity classification, which is everything you need to decide whether a 1099-NEC is required and to fill it out correctly.5Internal Revenue Service. Entity classification is the data point that drives the answer. Individual, sole proprietor, partnership, or LLC taxed as a partnership all trigger reporting. C-corp or S-corp generally doesn’t. You can’t tell from the business name alone. “Smith Marketing Group” could be a sole proprietorship or a corporation, and the W-9 is the only thing that settles it.

If a vendor refuses to provide a W-9 or gives you an incorrect TIN, you’re required to begin backup withholding at 24% on every payment.6Internal Revenue Service. Topic No. 307, Backup Withholding Most vendors produce the form quickly once that’s on the table.

Filling Out the 1099-NEC

Advertising services paid to non-corporate vendors go on Form 1099-NEC, not the 1099-MISC. The NEC form has been the required form for nonemployee compensation since 2020.7Internal Revenue Service. Reporting Payments to Independent Contractors

The core entries are short. Box 1 (Nonemployee Compensation) takes the total gross amount paid to the vendor during the calendar year, including any reimbursed expenses the vendor didn’t separately substantiate with receipts.2Internal Revenue Service. Boxes 5 through 7 cover state income tax withheld, the state ID number, and state income, and most payers leave them empty unless a state withholding rule applies.

Fill in the payer and recipient identification sections at the top from the W-9. Double-check the TIN. A mismatched number is one of the most common triggers for IRS notices.

Reimbursed Expenses

When you reimburse a contractor for out-of-pocket costs like stock photography, printing, or travel to a shoot, the treatment depends on how the expenses are tracked. If the contractor provides receipts and the reimbursements are accounted for separately from the service fee, those amounts can be excluded from Box 1. If the contractor bills you a flat amount that includes expenses with no separate accounting, the entire payment goes in Box 1.2Internal Revenue Service. The January 31 Deadline

Copy B to the recipient and Copy A to the IRS are both due by January 31 of the year after payment.3Internal Revenue Service. If January 31 falls on a weekend or federal holiday, the deadline shifts to the next business day.

If your business files 10 or more information returns of any type in a year, counting all 1099s, W-2s, and other forms together, you must file electronically.8Internal Revenue Service. Many states require their own copy of the 1099-NEC as well. Some participate in the IRS Combined Federal/State Filing Program, which forwards the federal data to participating state agencies automatically, though a few of those states still expect separate notification.9Internal Revenue Service. What It Costs to Skip It

The IRS assesses penalties per return, so a business with a stable of freelance vendors can rack up serious money fast. For returns due in 2026:10Internal Revenue Service. Information Return Penalties

  • Filed up to 30 days late: $60 per return
  • Filed 31 days late through August 1: $130 per return
  • Filed after August 1 or not filed at all: $340 per return
  • Intentional disregard: $680 per return, with no maximum cap

These penalties apply separately to the failure to file with the IRS and the failure to furnish the statement to the recipient. Miss both deadlines for the same vendor and you face two penalties. A business that ignores its 1099 obligations for ten freelancers could be looking at $6,800 in penalties before the intentional disregard tier even enters the conversation.

The IRS may waive or reduce penalties for reasonable cause, meaning you acted responsibly and the failure came from circumstances beyond your control.10Internal Revenue Service. Foreign Advertising Vendors

If you’re paying a foreign individual or entity for advertising services, the 1099-NEC rules don’t apply. You collect Form W-8BEN from an individual or W-8BEN-E from an entity to document the vendor’s foreign status.11Internal Revenue Service. Where the payment is U.S.-source income (for example, the foreign contractor performed the work while physically present in the United States), you report it on Form 1042-S and may need to withhold at the applicable rate.7Internal Revenue Service. Reporting Payments to Independent Contractors A tax treaty between the U.S. and the contractor’s home country may reduce or eliminate the withholding, but the 1042-S still gets filed even when the withheld amount is zero, along with Form 1042, the annual return for U.S.-source income of foreign persons.12Internal Revenue Service. Instructions for Form 1042-S If you hire a designer overseas and all the work is performed abroad, the payment may not be U.S.-source income at all, but the analysis turns on the type of income and the specific treaty provisions.
