Whether you have to pay taxes on eBay sales depends on one thing: did you make a profit? If you’re clearing out personal belongings and selling them for less than you originally paid, you owe nothing in federal income tax. If you sold something for more than it cost you, or your eBay activity looks like a hobby or a business, the answer changes. Most casual sellers owe zero. Consistent resellers usually owe both income tax and self-employment tax.
What Actually Makes an eBay Sale Taxable
Every eBay sale is measured against your cost basis, which is what you originally paid for the item plus anything you spent getting it ready to sell. Sell for less than that number and you have a loss. Sell for more and you have a gain, and the gain is what the IRS taxes.
Selling personal belongings at a loss is what most casual sellers do. You paid $800 for a phone two years ago, used it, and sold it for $250. That $550 shortfall isn’t income and doesn’t get reported. It also can’t be deducted. Taxable income only appears when the sale price beats your cost basis. Buy a vintage watch at a flea market for $100, sell it on eBay for $900, and you have an $800 capital gain to report on Form 8949 and Schedule D. Hold the item more than a year and long-term capital gains rates apply, topping out at 20% for most assets. Are You a Personal Seller, a Hobby Seller, or a Business
The IRS puts eBay activity into three buckets, and the bucket decides which forms you file and whether you can write off expenses.
Personal Seller
You’re liquidating things you bought for your own use. Losses don’t count, gains are taxable, and that’s the whole rule. Most people selling on eBay live here and owe nothing.
Hobby Seller
Some sellers sell often but aren’t really trying to run a profitable operation. The IRS weighs nine factors to draw the line, including whether you keep business-like records, how much time you put in, and whether you depend on the income. A working shortcut: if the activity turned a profit in at least three of the last five years, the IRS generally presumes it’s a business.3Internal Revenue Service. Business or Hobby? Hobby is the worst tax outcome. You report all gross hobby income on Schedule 1 of Form 1040 (line 8j), and you can’t deduct any of the expenses you paid to generate it. The old category of miscellaneous itemized deductions that once allowed partial hobby write-offs was permanently eliminated. Every dollar of revenue is taxed with no offset for inventory, shipping, or fees.
Business Seller
If your primary purpose is profit and you operate with continuity and regularity, the IRS treats your eBay activity as a business.4Internal Revenue Service. You file Schedule C, and you owe self-employment tax on the net profit.
What to Do If You Get a 1099-K
eBay files Form 1099-K with the IRS when a seller’s gross payments exceed $20,000 and there are more than 200 separate transactions in a calendar year. Both conditions have to be met. You may have heard about a $600 threshold. That change was delayed for years and never took effect. The One, Big, Beautiful Bill retroactively reinstated the $20,000-and-200-transaction rule, so $600 is off the table at the federal level.6Internal Revenue Service. Form 1099-K FAQs: General Information Some states set lower thresholds of their own, so you might still get a 1099-K in states like those even without crossing the federal line. The gross amount on the 1099-K includes everything the buyer paid through the platform: item price, shipping, sales tax collected, and fees. It doesn’t subtract refunds, eBay fees, your shipping costs, or what you paid for the goods.7Internal Revenue Service. Form 1099-K (Rev. March 2024) Payment Card and Third Party Network Transactions The number is almost always much larger than your actual profit. Receiving a 1099-K doesn’t mean you owe tax on the full reported amount.
If All Your Sales Were Personal Items at a Loss
You don’t owe tax, but you do need to account for the 1099-K on your return so the IRS doesn’t flag it as unreported income. The IRS has a specific method. On Form 8949, list the item, put the sale proceeds in column (d), your cost basis in column (e), write “L” in column (f) to mark the loss as nondeductible, and enter a positive adjustment in column (g) that brings the gain or loss to zero in column (h).8Internal Revenue Service. 2025 Instructions for Form 8949 The IRS sees the 1099-K amount accounted for. This only works if you can document what you originally paid. Keep receipts, credit card statements, or any record of the purchase price. Without proof, the IRS can treat the full sale price as gain.
If Your Numbers Don’t Match
The IRS receives a copy of every 1099-K and its automated systems will notice if the amount doesn’t show up somewhere on your return. Business sellers report the gross figure on Schedule C, line 1, then deduct expenses within the form.9Internal Revenue Service. It isn’t a bill or an audit, but it does require a response, and a documented reply showing your cost basis and expenses usually clears it.10Internal Revenue Service. What Business Sellers Owe Beyond Income Tax
If your eBay activity is a business, the net profit on Schedule C is subject to self-employment tax on top of regular income tax. Self-employment tax funds Social Security and Medicare, and you pay both the employer and employee shares.
The combined rate is 15.3%: 12.4% Social Security and 2.9% Medicare. It applies to 92.35% of your net profit. You can then deduct half of the self-employment tax you paid as an adjustment to income, which reduces your income tax.11Internal Revenue Service. You must file Schedule SE and pay self-employment tax once your net earnings from self-employment reach $400 in a year.13Internal Revenue Service. Topic No. 554, Self-Employment Tax That’s a low bar for even a modest side operation.
Quarterly Estimated Payments
eBay income has no withholding, so profitable sellers usually have to make quarterly estimated tax payments to avoid an underpayment penalty. You’re required to pay estimates if you expect to owe $1,000 or more for the year after subtracting withholding and refundable credits.14Internal Revenue Service. 2026 Form 1040-ES – Estimated Tax for Individuals
The 2026 deadlines are April 15, June 15, September 15, and January 15, 2027. You can skip the January payment if you file your 2026 return and pay the balance in full by February 1, 2027.14Internal Revenue Service. 2026 Form 1040-ES – Estimated Tax for Individuals
Pay at least 90% of the current year’s tax or 100% of last year’s tax (whichever is less) to avoid a penalty. If your prior-year AGI exceeded $150,000 ($75,000 if married filing separately), the safe harbor rises to 110% of last year’s tax.15Internal Revenue Service. Deductions That Lower a Business Seller’s Tax
Every deduction on Schedule C reduces both your income tax and your self-employment tax, so tracking them carefully matters. Each one has to be ordinary (common in your line of business) and necessary (helpful and appropriate).
Cost of goods sold is usually the biggest. It’s what you paid for items you resold, plus inbound freight. Small business taxpayers with average annual gross receipts of $31 million or less over the prior three years can skip formal inventory accounting and deduct inventory costs as supplies when the items sell.17Internal Revenue Service. eBay’s final value fees, listing fees, promoted listings, and payment processing fees are deductible. So are shipping costs, insurance, delivery confirmation, and packaging supplies like boxes, bubble wrap, and tape.
A dedicated home space used exclusively and regularly for the business qualifies for the home office deduction. The simplified method gives you $5 per square foot up to 300 square feet, capped at $1,500.18Internal Revenue Service. Business trips to the post office, supply store, or estate sales can be deducted at the 2026 standard mileage rate of 72.5 cents per mile.20Internal Revenue Service. Sales Tax Is Not Your Problem
Sales tax is separate from income tax, and for eBay sales it almost never lands on you. Nearly every state with a sales tax has a marketplace facilitator law that puts collection and remittance on the platform. eBay calculates the tax from the buyer’s shipping address, adds it to the buyer’s total, and sends it to the state. The money never hits your account and isn’t part of your income. Sales tax only becomes your responsibility if you also sell outside the platform, like through your own website or in person.
Records to Keep
Good records are the difference between a clean tax return and an expensive problem. Business sellers should track every purchase receipt, shipping cost, fee statement, and mileage log. Casual sellers should keep proof of what they originally paid for items, so a 1099-K can be answered with documented cost basis if one arrives.
The IRS generally wants records supporting a return kept for three years from the filing date. Understate income by more than 25% of the gross amount shown, and that window extends to six years. eBay provides transaction history and fee summaries through Seller Hub, but don’t rely on it as your only copy. Download the data periodically. If the account is ever closed or the platform changes retention rules, independent records are what remain.
