Do Employers Have to Mail Out W-2s? Deadlines, Delivery, and Fixes

Employers don’t have to mail W-2s. Federal law requires every employer to furnish a completed W-2 to each employee for the tax year, but the form can be delivered electronically instead of by physical mail as long as the employee has agreed to that method. When Your W-2 Has to Reach You

The statutory deadline for furnishing W-2s is January 31 of the year after the tax year.2Office of the Law Revision Counsel. 26 U.S. Code 6051 – Receipts for Employees When that date falls on a weekend or federal holiday, it shifts to the next business day. January 31, 2026, is a Saturday, so W-2s for 2025 wages are due Monday, February 2, 2026.1Internal Revenue Service. Topic No. 752, Filing Forms W-2 and W-3

The deadline is a send-by date, not a receive-by date. An employer meets it as long as the form is properly addressed and either mailed or electronically transmitted by that date; the paper copy doesn’t need to be in your hands.3Internal Revenue Service. The obligation covers anyone who received wages during the year, including people who left mid-year. If you quit or were terminated before December 31, your former employer can send the W-2 any time after your last day, but no later than the standard deadline.1Internal Revenue Service. Electronic Delivery and the Consent Rule

Many employers now deliver W-2s through an online payroll portal, which is faster than mail and avoids the address problems that plague physical delivery. But an employer cannot switch you to electronic-only delivery without your consent. The IRS requires a disclosure-and-consent process that includes specific protections.4Internal Revenue Service.   • That you’ll still get a paper W-2 if you don’t consent to electronic delivery.
  • What hardware and software you’ll need to access the electronic form.
  • How to withdraw your consent, with confirmation that the withdrawal was received.
  • Whether electronic access continues after your employment ends.

If you never consented, or you consented and later withdrew that consent, the employer has to send a paper copy. The electronic version is due by the same date as a mailed one.

How Mail Delivery Actually Works

When an employer mails a W-2, it goes to the last address on file with payroll. If you moved during the year and didn’t update your records, the form is going to your old address. Undeliverable W-2s returned by the post office must be kept by the employer for four years, and the employer cannot forward the undeliverable copies to the Social Security Administration.3Internal Revenue Service. General Instructions for Forms W-2 and W-3 (2026) In other words, if your address is wrong, the form sits in a file cabinet rather than reaching you or the government. Confirming your address with payroll before January is the simplest way to avoid a delay.

What to Do If It Doesn’t Arrive

Give it about a week past the deadline before escalating. Mail takes time, and the employer only had to postmark it on time.

Start with your employer’s payroll or HR department. Confirm they have your correct mailing address, and ask whether the form was mailed or posted to an online portal you may not have checked. A wrong address is the most common reason a W-2 doesn’t show up, and payroll can usually reissue quickly once it’s corrected.

If your employer doesn’t respond or still hasn’t provided the W-2 by the end of February, call the IRS at 800-829-1040.5Internal Revenue Service.   • Your name, address, phone number, and Social Security number.
  • Your employer’s name, address, and phone number.
  • Your dates of employment.

The IRS will initiate a formal W-2 complaint on your behalf, which prompts the employer to issue the form. The agency will also send you a letter with instructions for filing your return if the W-2 still doesn’t turn up.

Filing Without a W-2

You still have to file on time even if the W-2 never arrives. The IRS provides Form 4852 as a substitute for the missing W-2.7Internal Revenue Service. Beyond the wage and withholding figures, the form asks how you determined those amounts (for example, “estimated from final pay stub”) and what steps you took to get the actual W-2 from your employer.8Internal Revenue Service. Form 4852 (Rev. September 2020) Attach the completed Form 4852 to your federal return and file as normal.

One catch: if the real W-2 shows up later and the numbers differ from what you estimated, you have to file an amended return using Form 1040-X.6Internal Revenue Service. W-2 – Additional, Incorrect, Lost, Non-Receipt, Omitted Even a small discrepancy in withholding can affect your refund or balance due, so it’s worth correcting once you have the actual figures.
