To change your name with the IRS, update it with the Social Security Administration first. The IRS doesn’t run its own name-change process. The process is free. The timing is what matters. If you file a return before the SSA has processed your change, the return can be delayed or rejected.
Why the SSA Is the Starting Point
Every return you file gets checked against SSA records. A mismatch between the name on your return and the name Social Security has for your SSN triggers a flag. There is no separate IRS form for a personal name change and no phone line that will do it for you outside of a spelling correction. Updating Social Security is the update.
Documents You’ll Need
The SSA wants two things: proof that you legally changed your name, and proof of who you are. You complete Form SS-5, the Application for a Social Security Card, which covers new cards, replacements, and name corrections.2Social Security Administration. For proof of the name change, you’ll need one of:
- Marriage certificate
- Divorce decree
- Court order approving the name change
- Certificate of Naturalization showing the new name
The document has to be recent and show both your old and new names. If the name-change event happened more than two years ago, or if the document doesn’t carry enough identifying detail, the SSA can ask for extra proof of identity in both names.2Social Security Administration. For identity, the SSA accepts a U.S. driver’s license, a state-issued non-driver ID card, or a U.S. passport. Everything you submit must be an original or a copy certified by the issuing agency. How to Submit the Change
Some name changes can be done entirely online through the SSA’s Replace Social Security Card page. The site asks a series of questions to see whether your situation qualifies. Otherwise, bring the completed Form SS-5 and your original documents to your local SSA office, or mail them in. Mailing originals carries obvious risk. What to Put on Your Tax Return if the Change Isn’t Done Yet
This is where most people trip up. If tax season arrives before Social Security finishes processing your change, use your old name on the return. The IRS is explicit: the name on your return must match the name the SSA currently has on file for your SSN.1Internal Revenue Service. If you recently married and file a joint return, you don’t have to wait to choose married filing jointly. Use whatever name currently appears on each spouse’s Social Security card. The same logic applies to dependents. If a child’s name changed through adoption or a court order, update the child’s SSA record before claiming them under the new name. What a Name Mismatch Costs You
A mismatch isn’t just a paperwork hiccup. When the name and SSN on your return don’t match Social Security’s records, the IRS flags the return, refunds slow down, and certain credits face extra scrutiny.
The Earned Income Tax Credit is especially sensitive. The name and SSN must match SSA records exactly for every person listed on the return, including your spouse and qualifying children. Confirming the IRS Has Your New Name

If the IRS Still Shows the Old Name
If you’ve updated Social Security, filed under the new name, and the IRS still shows the old one, start with the SSA. Confirm that Social Security actually processed the change and that your card reflects your current legal name. Processing delays on the SSA side are the most common cause.
If Social Security’s records are correct but the IRS hasn’t caught up, call 1-800-829-1040. A representative can correct the IRS record directly. This is uncommon when the SSA step went through cleanly, but it happens with returns filed close to the name-change date.
Business Names Are a Separate Process
If you own a business, changing your personal name doesn’t change your business’s name at the IRS. An Employer Identification Number is tied to a specific name, and the IRS has to be told separately.
