Can You Work With an ITIN? Hiring, 1099s, and Tax Duties

No, you cannot legally work in the United States with an ITIN alone. An Individual Taxpayer Identification Number is a nine-digit number the IRS issues strictly for federal tax purposes, and the agency states directly that it “creates no inference concerning your immigration status or your right to work in the United States.”1Internal Revenue Service. What an ITIN Is Actually For

The IRS issues ITINs to people who have a U.S. federal tax filing obligation but don’t qualify for a Social Security Number. That includes certain foreign nationals, nonresident aliens with U.S.-source income, and dependents or spouses of U.S. citizens or residents. An ITIN lets you file returns, report income, and pay what you owe. That is the entire function. According to the IRS, an ITIN does not qualify you for Social Security benefits, make you eligible for the Earned Income Tax Credit, provide or change your immigration status, authorize you to work, or serve as identification outside the federal tax system.2Internal Revenue Service. Why an ITIN Fails the Hiring Process

Every employer in the United States must complete Form I-9 for each new hire, and the employee has to present documents proving identity and work authorization within three business days of starting. The accepted documents are grouped into three lists: a single List A document that proves both (like a U.S. passport or Permanent Resident Card), a List B identity document, or a List C work-authorization document such as an unrestricted Social Security card.3U.S. Citizenship and Immigration Services. Employers who run new hires through E-Verify hit the same wall. The system’s own guidance states that “ITINs and the cards on which they are printed do not provide evidence of employment authorization and are not acceptable for Form I-9 or E-Verify.”5E-Verify. The 1099 and Independent Contractor Myth

A common misunderstanding is that ITIN holders can bypass all of this by working as independent contractors. It’s true that businesses don’t complete Form I-9 for contractors, and it’s also true that an ITIN can appear as the payee’s taxpayer identification number on Form 1099-NEC, the form used to report payments to non-employees. None of that makes the work legal. Federal law prohibits individuals or businesses from contracting with an independent contractor when they know the contractor is not authorized to work in the U.S.8U.S. Citizenship and Immigration Services. Exceptions The I-9 exemption for contractors is a paperwork rule, not a grant of work authorization. Receiving a 1099 does not mean the underlying work was lawful from an immigration standpoint.

The Immigration Consequences of Working Anyway

Working without authorization can follow you for years. Under USCIS policy, if you accepted or continued unauthorized employment at any point before filing an application to adjust status, you may be ineligible to become a lawful permanent resident. Leaving the country and returning does not reset the clock. USCIS officers review an applicant’s full employment record across all entries into the United States, with no time limit on how far back they look.9U.S. Citizenship and Immigration Services. For most people, though, a history of unauthorized work creates a serious obstacle to future legal status.

You Still Owe Taxes on Whatever You Earn

Immigration law and tax law operate on separate tracks. The IRS expects you to report all income and pay taxes on it regardless of whether you were authorized to earn it. Filing keeps you in good standing with the IRS, and if you later gain legal status, a clean tax record can help in immigration proceedings while a history of non-filing works against you.

ITIN holders with self-employment income of $400 or more must file Schedule SE and pay self-employment tax covering Social Security and Medicare. The IRS specifically states that either an SSN or an ITIN can be used to pay self-employment tax.10Internal Revenue Service. Filing with an ITIN comes with real limits on credits, though. You cannot claim the Earned Income Tax Credit with an ITIN.1Internal Revenue Service. Topic No. 857, Individual Taxpayer Identification Number (ITIN) Self-employment taxes paid under an ITIN also don’t earn Social Security credits toward retirement or disability benefits while you hold only the ITIN. If you later receive a Social Security Number, earnings previously reported under your ITIN may be credited to your Social Security record once your tax accounts are combined.

How People Actually Get Work Authorization

Legal work authorization runs through immigration law, not the tax system. The main categories of people who can work in the United States are:

  • U.S. citizens, whether born or naturalized, who have an inherent right to work.

If you currently hold only an ITIN and want to work legally, the practical step is consulting an immigration attorney about whether any pathway applies to your situation. The ITIN won’t get you there. What it does is keep you compliant with the IRS while your immigration situation is being worked out.

What Happens When You Get a Social Security Number

If you gain work authorization and receive a Social Security Number, you must stop using your ITIN and use the SSN for all tax purposes going forward. The IRS does not allow you to keep both.15Internal Revenue Service. Additional ITIN Information

You also need to tell the IRS so your prior tax history gets merged under the new SSN. If you skip this step, you may not get credit for wages and taxes previously reported under your ITIN, which can reduce future refunds and Social Security earnings credit. You can visit a local IRS office in person or send a letter to the IRS at Austin, TX 73301-0057 explaining that you’ve received an SSN and want your records combined. Include your full name, mailing address, ITIN, a copy of your Social Security card, and, if you still have it, your CP 565 notice (the ITIN assignment letter).15Internal Revenue Service.
