No — having a Taxpayer Identification Number does not give you legal permission to work in the United States. The number most individuals without a Social Security Number hold is an Individual Taxpayer Identification Number (ITIN), and the IRS is explicit that an ITIN exists for federal tax purposes only. It does not authorize employment and does not change your immigration status.1Internal Revenue Service. The two systems run on parallel tracks, and confusing them is what gets people into trouble.
That said, people with ITINs do earn income in the U.S. every day. The tax system is built to accept their returns and payments whether or not they were authorized to earn that income. What follows is how the pieces actually fit together.
Why an ITIN Cannot Get You Hired as an Employee
Every U.S. employer must complete Form I-9 for each new hire to verify both identity and employment authorization.2U.S. Citizenship and Immigration Services. If your employer uses E-Verify, the federal system that electronically confirms employment eligibility, an ITIN will not go through at all. So an ITIN, on its own, will not open the door to a W-2 job.
The One Employee Situation Where an ITIN Has a Role
There is a narrow case. If you already have valid work authorization through a visa or an EAD but haven’t yet received your Social Security Number, you can use your ITIN on Form W-4 so your employer can set up federal income tax withholding.5Internal Revenue Service. Apply for the SSN through the Social Security Administration as soon as you’re authorized — the ITIN is only a temporary stand-in here, and the authorization to work is coming from your visa or EAD, not from the ITIN.
Working as an Independent Contractor With an ITIN
Contractor work is where an ITIN shows up most often in a work context. When you perform services as an independent contractor, you give clients your ITIN on Form W-9, which the client keeps on file.6Internal Revenue Service. Contractors don’t have taxes withheld from their payments. You receive the full amount and handle the taxes yourself. If you don’t give a client a valid TIN, or the IRS notifies the client that your number is incorrect, the client must withhold 24% of your payments and send it directly to the IRS. This is backup withholding, and it applies to 1099-reportable payments generally.8Internal Revenue Service. Providing a current ITIN on Form W-9 upfront prevents it.
Tax Compliance Is Not Work Authorization
This is the point where the two systems really need to be kept separate. The IRS accepts your ITIN on tax forms because federal law requires everyone earning income in the U.S. to report it, regardless of immigration status. Reporting the income does not make the work itself authorized. Working without proper immigration authorization can create serious consequences for future visa, green card, or status applications. The IRS will process your return and take your payment either way. USCIS decisions run on their own track.
The Tax Obligations That Come With Earning Income Under an ITIN
If you’re going to be paid under an ITIN as a contractor, plan for the tax side before the money starts arriving. Contractors owe self-employment tax at a combined 15.3% — 12.4% for Social Security and 2.9% for Medicare — because there’s no employer paying half.9Internal Revenue Service. The filing floor is low. If your net self-employment earnings hit just $400, you have to file a return and pay self-employment tax, even if your total income is well under the regular filing threshold.9Internal Revenue Service. Self-Employment Tax (Social Security and Medicare Taxes)
Because nothing is being withheld, the IRS expects contractors to pay quarterly using Form 1040-ES. For tax year 2026, the estimated tax due dates are:
- First quarter: April 15, 2026
- Second quarter: June 15, 2026
- Third quarter: September 15, 2026
- Fourth quarter: January 15, 2027

A common trap: contractors receive the full check, spend it, and then can’t cover the tax bill in April. Setting aside a portion of every payment for federal (and, where applicable, state) tax is the discipline that keeps this manageable.
When Your Status Changes and You Get an SSN
If your immigration status changes and you become eligible for a Social Security Number, you must stop using the ITIN and switch to the SSN for tax purposes. This is required, not optional.15Internal Revenue Service. Additional ITIN Information

Skipping this step can mean you don’t get credit for wages and withholding reported under the ITIN, which can affect refunds and future Social Security benefit calculations.
The short version stays the same no matter which situation you’re in: an ITIN handles taxes, not permission to work. If you need to work legally as an employee, you need immigration status that authorizes it. If you’re contracting and reporting your income, an ITIN keeps you compliant with the IRS, but it does not settle the separate question of whether that work is authorized under immigration law.
