Yes, you can get a tax refund with an ITIN. The mechanics are identical to filing with a Social Security number: if your withholding and estimated payments exceed your actual tax, or if you qualify for a refundable credit, the IRS pays you the difference.1Internal Revenue Service. The Two Ways ITIN Filers Get Money Back
The first and most common path is overpayment. If your employer withheld federal income tax, or you paid estimated tax during the year, and those payments came in higher than your final liability, the excess comes back as a refund. No credit claim is required; it’s just your own money returning.
The second path is a refundable credit. A refundable credit can drive your tax below zero and produce a payment from the IRS even if nothing was withheld. ITIN holders can access some of these credits and are shut out of others, and that distinction drives most of what follows.
Credits You Can and Can’t Claim With an ITIN
The Child Tax Credit Is Largely Closed
The Child Tax Credit is worth up to $2,200 per qualifying child for tax year 2025, with up to $1,700 of that refundable through the Additional Child Tax Credit.2Internal Revenue Service. Child Tax Credit For lower-income families this is usually the credit that produces an actual refund check.
You probably can’t claim it with an ITIN alone. Federal law requires the qualifying child to have a Social Security number issued before the return’s due date, and on a joint return at least one spouse must have an SSN.3Office of the Law Revision Counsel. 26 USC 24 – Child Tax Credit A single filer with only an ITIN cannot claim the CTC or ACTC even when the child has an SSN. Current law sunsets at the end of 2025. Absent new legislation, the CTC for tax year 2026 would revert to $1,000 per child with less restrictive identification requirements.4Congress.gov. The American Opportunity Tax Credit Is Open
The AOTC is the one significant partially refundable credit that clearly works for ITIN filers. It’s worth up to $2,500 per eligible student for qualified higher education expenses, with 40% (up to $1,000) refundable. It requires only a valid taxpayer identification number, and an ITIN counts.5Internal Revenue Service. The Earned Income Tax Credit Is Closed
The federal EITC is off limits. It requires the filer, the spouse on a joint return, and every qualifying child to have an SSN. An ITIN disqualifies the return entirely.6Internal Revenue Service. Credit for Other Dependents
The Credit for Other Dependents is worth up to $500 per dependent who doesn’t qualify for the CTC, and it accepts dependents with either an SSN or an ITIN.7Internal Revenue Service. Refunds for Nonresident Aliens
Nonresident aliens filing Form 1040-NR often see refunds because payers withheld at flat statutory rates that exceed the filer’s actual liability. U.S.-source income not connected to a trade or business (dividends, interest, royalties) is generally taxed at 30%, and tax treaties reduce that rate for residents of many countries.8Internal Revenue Service. If a treaty lowers your rate but the payer withheld at the full 30%, you claim the difference on Form 1040-NR, identify the treaty provision on Schedule OI, and attach supporting documentation.9Internal Revenue Service. 2025 Instructions for Form 1040-NR Any withholding shown on Forms 1042-S, 8805, or 8288-A has to be attached to the return, and the IRS warns that refunds relying on these forms can take up to six months.
Students and scholars on F, J, or M visas may be exempt from Social Security and Medicare taxes during their first five calendar years in the U.S. If an employer withheld those taxes anyway, ask the employer to correct it first; if that fails, file Form 843 with the IRS to claim the refund directly.10Internal Revenue Service. State Credits Can Fill Part of the Gap
Although the federal EITC is closed, roughly ten states and the District of Columbia have extended their state-level earned income credits to ITIN filers. California, Colorado, Illinois, Maine, Maryland, Minnesota, New Mexico, Oregon, Vermont, and Washington currently offer some form of state EITC access to ITIN filers. Amounts and eligibility differ by state, and several of these programs are recent, so check the state tax authority for current rules. For a household shut out of the federal credit, a state version can be meaningful money.
Expired ITINs Delay or Shrink Refunds
An ITIN expires if it hasn’t appeared on a federal return for three consecutive years. If you didn’t file for tax years 2022, 2023, or 2024, your ITIN expired on December 31, 2025.11Internal Revenue Service. How to Renew an ITIN Separately, ITINs with middle digits 70 through 88, and those assigned before 2013 with middle digits 90 through 99 (except 93), were phased out earlier and need renewal regardless of use.
Filing with an expired ITIN doesn’t cause the IRS to reject your return. It will process it and disallow the credits you claimed, including the ACTC and AOTC, until you complete renewal. The practical result is a delayed or reduced refund, and sometimes a balance due notice. Renew before you file if you can.

How the Refund Actually Reaches You
Once the IRS approves the refund, you can take it by direct deposit or paper check. Direct deposit needs a U.S. bank account, and many banks and credit unions open accounts for ITIN holders without an SSN, so this route is usually available. Put the routing and account numbers on the return and the deposit typically lands within a few weeks of approval.
If you don’t choose direct deposit, the IRS mails a check to the address on your return. Filers abroad face longer delivery and higher loss risk, so keeping your address current with the IRS matters.

How Long It Takes
ITIN returns take longer than SSN returns. A first-time applicant who submits Form W-7 with the return should expect seven to eleven weeks for the ITIN assignment alone, plus additional time for the return to be processed.1Internal Revenue Service. If you claim the Additional Child Tax Credit, federal law bars the IRS from issuing the refund before mid-February regardless of when you filed. That PATH Act hold applies to every ACTC filer, and for ITIN filers it stacks on top of the longer processing baseline.
Refunds based on withholding reported on Forms 1042-S, 8805, or 8288-A can take up to six months even on clean returns.9Internal Revenue Service. 2025 Instructions for Form 1040-NR Paper returns are slower than e-filed ones across the board. Every withholding document (W-2, 1099, 1042-S) has to be attached; claim withholding without the supporting form and the IRS will disallow that amount, cutting the refund or turning it into a balance due.
One deadline is worth writing down: you have three years from a return’s original due date to claim a refund. Miss that window and the money is forfeited to the Treasury.
