Can I Put a Different Address on My Tax Return?

You can use an address on your tax return that isn’t your primary home, but whatever you enter becomes your official “last known address” with the IRS. That single line on Form 1040 controls where audit letters, notices of deficiency, and paper refund checks are sent, and it can also signal to a state tax agency that you live in their jurisdiction. Before you put down a P.O. Box, a relative’s house, or a mailbox in a no-income-tax state, it’s worth understanding what that address actually does.

Your Address Becomes Your “Last Known Address”

Federal regulations define your last known address as the address on your most recently filed and properly processed tax return, unless you give the IRS clear notice of a different one.1eCFR. 26 CFR 301.6212-2 – Definition of Last Known Address When the IRS believes you owe additional tax, it must mail a notice of deficiency to that address.2Office of the Law Revision Counsel. 26 USC 6212 – Notice of Deficiency That notice starts a 90-day clock to petition the Tax Court.

Here is the trap. If the notice is returned as undeliverable because you moved and left no forwarding information, the IRS still treats the mailing as valid. Refunds suffer the same problem in a smaller way. A paper check mailed to a wrong or stale address gets returned to the IRS, and you’ll have to file Form 8822 and contact the agency to have it reissued.5USA.gov. Undelivered and Unclaimed Tax Refund Checks Direct deposit sidesteps the issue.

What Form 1040 Actually Asks For

The IRS instructions are direct: use your home address. A P.O. Box is only appropriate if your post office does not deliver mail to your residence. Foreign addresses have their own fields for country, province, and postal code, and the country name should not be abbreviated.6Internal Revenue Service. Instructions 1040 (2025)

Form 1040 gives you one address field, not two. Whatever you enter serves as both your residential and mailing address for federal purposes, and it stays your last known address until you change it. Some states let you list a separate legal residence and mailing address on their returns; the federal return does not.

Using a P.O. Box, Virtual Mailbox, or Someone Else’s Address

You can technically list an accountant’s office, a family member’s home, or a commercial mail receiving agency (CMRA) as your address on Form 1040. The IRS will accept a CMRA address if it’s tied to a physical location registered with USPS. What you’re doing when you make that choice, though, is telling the IRS and every state that shares data with it that this is where you live.

The most common fallout is a state residency inquiry. If you’re actually domiciled in Florida but you put a New York address on your federal return, New York’s tax agency can treat that as evidence you’re a New York resident and open an audit seeking to tax your worldwide income. Proving the address was purely for mail handling is possible, but it’s slow and expensive even when you win.

The same risk applies to virtual mailboxes located outside the state where you actually live. If you need mail forwarded, the cleaner approach is to keep your real home address on the return and arrange forwarding separately through USPS or your mailbox service, without changing the address of record with the IRS.

When a Different Address Is Legitimate

You Moved Mid-Year

If you relocated during the tax year, use the address where you live when you file. In most cases that’s your new state. You’ll typically need to file a part-year resident return in both the old state and the new one, and the address on your federal return should match your current situation.

Your old state may not concede that you actually left. States claim residents two ways: by domicile (the one permanent home you intend to return to) and by statutory residency (usually 183 or more days plus a home in the state). If the old state audits your residency, the burden is on you to show you genuinely abandoned your former domicile. Auditors weigh where your spouse and children live, where you keep meaningful personal belongings, where you’re registered to vote and licensed to drive, and where you bank. Counting days alone is not a reliable defense.

You Work Remotely Across State Lines

The address on your federal return should be your actual home, even if your employer is elsewhere. Most states tax you on income earned while physically working in the state, based on your working-day ratio. A handful of states apply a “convenience of the employer” rule, which lets the employer’s state tax your wages when you work remotely for your own convenience rather than the employer’s necessity. New York applies this most aggressively. Living in a no-income-tax state doesn’t shield you from those obligations, and putting a no-tax-state address on your 1040 doesn’t either.

You’re on Active-Duty Military Orders

Under the Servicemembers Civil Relief Act, a state cannot tax your military pay just because you’re stationed there, and it cannot force you to become a domiciliary of your duty station.7Office of the Law Revision Counsel. 50 USC 4001 Use your state of domicile on your tax return, not your duty station, even if you’ve been stationed away from home for years. Keep your voter registration, vehicle registration, and military state of legal residence consistent with the domicile you claim.

How to Fix an Address That’s Already Wrong

  • File your next return with the new address. Once the return is processed, the IRS’s records update.
  • File Form 8822 between returns to close the gap during which correspondence could still be routed to your old address.9Internal Revenue Service. About Form 8822, Change of Address
  • Send a signed written statement with your full name, Social Security number, and both old and new addresses to the IRS address where you filed your last return.
  • Call or visit the IRS, verifying your identity and confirming the address currently on file.

There’s no deadline or penalty tied to Form 8822 for individuals, but filing it soon after you move is the best way to avoid missing a notice. When a False Address Becomes Fraud

Using an address you don’t actually live at in order to reduce your state or federal tax is where a paperwork choice becomes a legal problem. On the civil side, the IRS imposes a fraud penalty equal to 75% of the underpayment attributable to fraud, and once any portion of the underpayment is proven fraudulent, the entire underpayment is treated as fraud unless you rebut it.10Office of the Law Revision Counsel. 26 USC 6663 – Imposition of Fraud Penalty State fraud penalties commonly run 25% to 50% of unpaid tax, plus interest.

Criminal exposure is heavier. Filing a return you know to be materially false is a felony punishable by up to three years in prison and a fine of up to $100,000 ($500,000 for corporations).11Office of the Law Revision Counsel. 26 USC 7206 – Fraud and False Statements Deliberately using an address in a no-income-tax state while actually living in a high-tax state is the pattern that draws these referrals.

The final consequence is time. The IRS normally has three years from your filing date to audit a return, but a fraudulent return filed with intent to evade carries no statute of limitations at all.
