No, an ITIN cannot be used on a W-2. What an Employer Should Do When a Worker Only Has an ITIN
The employer must reject the ITIN for W-2 purposes and ask the employee to provide a valid Social Security Number. If the SSN application is still pending at the W-2 filing deadline, the employer writes “Applied For” in the SSN field on a paper W-2, or enters all zeros when filing electronically. Penalties for Putting an ITIN on a W-2
Knowingly filing a W-2 with an ITIN in the SSN field exposes an employer to penalties from two directions.
IRS Information Return Penalties
Filing a W-2 with an incorrect taxpayer identification number triggers penalties under the Internal Revenue Code, tiered by how quickly the employer corrects the error:
- Corrected within 30 days of the deadline: $60 per form.
- Corrected after 30 days but before August 1: $130 per form.
- Not corrected by August 1 or never filed: $340 per form.
- Intentional disregard: $680 per form, with no annual cap.
That last tier is the one that applies when the IRS determines the employer deliberately ignored the SSN requirement, and there is no maximum on the total assessed across all affected forms.
Immigration Penalties

How to File a Tax Return When You Have an ITIN and a W-2
If you have an ITIN and were issued a W-2 anyway, you still have a legal obligation to report the income. The IRS is not asking about immigration status on Form 1040; it is asking that income be reported and taxed.
On the return, put your ITIN at the top of Form 1040 as your taxpayer identification number. When you enter the W-2 information, use the SSN exactly as it appears on the W-2 the employer issued, even though it does not match your ITIN. The IRS generally credits the income tax withholding shown on the W-2 to the ITIN filer, though a mismatch can prompt additional review. Keep pay stubs and employment records to substantiate wages and withholding if asked.

What Happens With the Social Security and Medicare Taxes
Federal law defines “employment” for FICA purposes to cover services performed by an employee within the United States “irrespective of the citizenship or residence of either” the worker or the employer.11Office of the Law Revision Counsel. 26 US Code 3121 – Definitions Wages paid to an unauthorized worker are still subject to Social Security and Medicare taxes, and the withholding is legally correct.
The result is uncomfortable but consistent: FICA is properly withheld, yet without a valid SSN the SSA will not credit those earnings to any benefits record. When FICA Refunds Actually Apply
Form 843 is for situations where FICA was genuinely withheld by mistake. The most common cases involve certain visa holders:

- Students who work for the school, college, or university where they are enrolled at least half-time are exempt on that on-campus work, incidental to their studies. If you fall into one of these categories and your employer withheld FICA anyway, ask the employer to correct the overcollection first. ITINs Are Fine on a 1099-NEC
The prohibition applies to W-2s, not to every tax form. An ITIN can be used on Form 1099-NEC for independent contractor payments. When someone performs services as an independent contractor, the hiring party does not complete Form I-9 and does not withhold FICA, so the ITIN functions as a valid taxpayer identification number in the same field where an SSN would normally appear. Fixing Prior-Year W-2s
If a past W-2 carries the wrong SSN and the employer is willing to fix it, the employer files Form W-2c (Corrected Wage and Tax Statement) with the SSA.
