Are Aflac Premiums Tax Deductible for You?

Aflac premiums are tax deductible in some situations and not in others. Whether you can deduct them depends on who pays the premium, whether it comes out of your paycheck before or after taxes, and what the policy actually covers. If you pay out of pocket, deducting is possible but hard to reach. If your employer runs the premium through a pre-tax plan, you’ve already received the tax benefit and can’t deduct again. Self-employed people get the best treatment of the three.

If You Pay for the Policy Yourself

Buying an Aflac policy on your own means you’re paying with after-tax dollars. Those premiums can count as a medical expense on Schedule A, but only if you itemize and only to the extent your total qualified medical costs exceed 7.5% of your adjusted gross income.1Office of the Law Revision Counsel. 26 U.S.C. 213 – Medical, Dental, Etc., Expenses2Internal Revenue Service. That floor is what stops most people. Someone earning $80,000 needs more than $6,000 in qualifying medical expenses before any of it becomes deductible, and only the excess counts. If you take the standard deduction, individually paid premiums give you no tax benefit at all.

The policy also has to cover something the tax code recognizes as medical care: diagnosis, treatment, prevention of disease, or coverage affecting the structure or function of the body.1Office of the Law Revision Counsel. 26 U.S.C. 213 – Medical, Dental, Etc., Expenses Aflac’s accident and critical illness policies generally meet that standard. Disability income coverage doesn’t.

If Aflac Comes Out of Your Paycheck

Employer-based Aflac usually runs through a Section 125 cafeteria plan, where premiums come out of your wages before taxes are calculated. The IRS treats those pre-tax premiums as if the employer paid them.3Office of the Law Revision Counsel. 26 U.S.C. 125 – Cafeteria Plans You don’t get a separate deduction on your tax return because you’ve already received the benefit through lower taxable wages on your W-2.

If your employer pays the premium outright and doesn’t include it in your wages, the same idea applies: the premium isn’t taxable to you, and there’s nothing left to deduct.4Office of the Law Revision Counsel. 26 U.S.C. 106 – Contributions by Employer to Accident and Health Plans

Check your pay stub if you’re unsure. Deductions labeled “pre-tax” or shown as reducing your taxable wages are already giving you the tax break.

If You’re Self-Employed

Sole proprietors, partners, and S-corporation shareholders who own more than 2% of the company can deduct Aflac premiums as an above-the-line deduction. That reduces your AGI directly, doesn’t require itemizing, and skips the 7.5% floor entirely. Two limits catch people off guard. First, the deduction can’t exceed net earned income from the business that established the coverage. Pay $35,000 in premiums against $30,000 in business income and only $30,000 is deductible above the line. The excess can go to Schedule A, back under the 7.5% AGI hurdle.6Internal Revenue Service. Second, you lose the deduction for any month you were eligible for a subsidized health plan through any employer, including your spouse’s. The IRS applies this month by month. If your spouse’s open enrollment starts in July, you can lose the deduction from July onward even if you never actually enrolled.6Internal Revenue Service. Instructions for Form 7206 (2025)

S-Corp Shareholders and Partners

Owners of pass-through businesses can’t receive tax-free employer-paid coverage the way regular employees can. If the business pays premiums for a more-than-2% S-corp shareholder, those premiums have to show up as taxable wages on the W-2. For partners, they show up as guaranteed payments on Schedule K-1. The owner then claims the self-employed health insurance deduction to offset that income. The added W-2 wages aren’t subject to Social Security or Medicare taxes as long as the plan covers a class of employees.7Internal Revenue Service. The Trade-Off You Should Understand Before Deciding

How you pay for the premium determines how the benefit gets taxed later. This is the piece most policyholders miss, and it matters more than the deduction itself.

Pay with after-tax dollars, and the benefits Aflac pays you are generally tax-free.8Office of the Law Revision Counsel. 26 U.S.C. 104 – Compensation for Injuries or Sickness Pay with pre-tax dollars through a Section 125 plan, and the benefits are generally taxable.9Office of the Law Revision Counsel. 26 U.S.C. 105 – Amounts Received Under Accident and Health Plans For most individual policyholders who wouldn’t clear the 7.5% floor anyway, keeping the payout tax-free is the far better outcome.

Fixed indemnity policies like Aflac’s accident and critical illness coverage complicate this on the pre-tax side. If you paid premiums pre-tax, benefits are excludable from income only to the extent they reimburse actual unreimbursed medical costs. Anything above that is taxable. What the Policy Covers Changes the Answer

Accident and Critical Illness

Premiums for accident and critical illness policies that pay based on a medical event generally qualify as medical care.1Office of the Law Revision Counsel. 26 U.S.C. 213 – Medical, Dental, Etc., Expenses These are the Aflac products most likely to be deductible, subject to the 7.5% floor for individuals and the earned-income cap for the self-employed.

Disability Income

Premiums for disability income policies that replace lost wages are not deductible as a medical expense. The IRS excludes policies covering loss of earnings from the definition of medical care.2Internal Revenue Service. Publication 502 (2025), Medical and Dental Expenses The upside: because you paid with after-tax dollars, the disability benefits are entirely tax-free.8Office of the Law Revision Counsel. 26 U.S.C. 104 – Compensation for Injuries or Sickness Keeping every dollar of a $5,000 monthly benefit is worth more than deducting $200 in premiums.

A separate rule applies to business overhead expense disability policies, which cover fixed business costs while an owner is disabled. Those premiums are deductible as a business expense, and the benefits are then fully taxable.

Long-Term Care

Qualified long-term care insurance premiums are deductible as medical expenses, but only up to age-based annual limits. For 2026:11Internal Revenue Service. Rev. Proc. 2025-32

  • Age 40 or younger: $500
  • Age 41 to 50: $930
  • Age 51 to 60: $1,860
  • Age 61 to 70: $4,960
  • Age 71 or older: $6,200

Pay $2,500 in qualified long-term care premiums at age 48 and only $930 counts. Individuals still have to clear the 7.5% AGI floor with that capped amount. Self-employed filers can deduct up to the applicable limit above the line.

Components That Never Qualify

Some coverage bundled into supplemental policies is never deductible as a medical expense. That includes life insurance, policies paying for loss of life or limb, and policies guaranteeing a fixed weekly payment during hospitalization.2Internal Revenue Service. If your Aflac policy contains any of these features, the portion of the premium tied to them has to come out before you calculate the deduction.

HSAs and FSAs Won’t Cover the Premium

A related question worth heading off: you generally can’t use Health Savings Account funds to pay Aflac premiums. HSA dollars can cover insurance premiums only in four narrow situations — long-term care insurance, COBRA, coverage while collecting unemployment, and Medicare coverage at 65 or older.12Internal Revenue Service. Publication 969 (2025), Health Savings Accounts and Other Tax-Favored Health Plans Aflac accident, critical illness, and disability premiums don’t fit any of them. Holding these policies alongside a high-deductible plan doesn’t jeopardize your HSA eligibility, but you’ll need to pay premiums from another source. Health FSAs face a parallel restriction and can’t reimburse insurance premiums either.

Records to Keep

If you’re planning to deduct, keep documentation of the amount paid, the dates, and the type of coverage.2Internal Revenue Service. Publication 502 (2025), Medical and Dental Expenses Aflac premium statements, bank or credit card records, and your employer’s benefits summary all work. Self-employed filers should also keep proof of net business income, since the deduction is capped there.

If you receive benefits from a pre-tax plan, keep receipts for every out-of-pocket medical expense during the coverage period. The taxable portion of a fixed indemnity payout is whatever exceeds your actual costs, and you’ll want records on both sides of the calculation.
