529 Gift Tax: Annual Exclusion, Superfunding, and Form 709

Money you put into a 529 college savings plan is treated as a gift from you to the account’s beneficiary under federal law, so the 529 gift tax rules are really the ordinary gift tax rules applied to 529 contributions. For 2026, you can give any one beneficiary up to $19,000 without owing gift tax or filing a return, and a special election unique to 529 plans lets you contribute up to $95,000 in a single year by treating it as spread over five years.1Internal Revenue Service. 2025 Instructions for Form 709 – Section: Line B. Qualified Tuition Programs Stay inside those limits and there is nothing to pay and, in most cases, nothing to file.

The Annual Exclusion Applied to 529 Contributions

The federal gift tax annual exclusion for 2026 is $19,000 per recipient, unchanged from 2025.2Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026 A 529 contribution counts as a completed gift of a present interest, meaning the exclusion applies immediately in the year you make the deposit.3Office of the Law Revision Counsel. 26 USC 529 Qualified Tuition Programs – Section: (c)(2)(A) As long as your total gifts to that beneficiary for the year stay at or below $19,000, no gift tax is owed and no Form 709 is required.

The catch that people miss: the $19,000 is a ceiling on all gifts to that person, not just the 529 deposit. Put $15,000 into your grandson’s 529 and hand him a $5,000 birthday check, and you’ve given $20,000. The extra $1,000 is a taxable gift. It won’t usually mean cash out of pocket, because it can be absorbed by your lifetime exemption, but it does need to be reported.

Gift Splitting for Married Couples

Spouses can effectively double the exclusion. Even if only one spouse writes the check, both can elect to treat the gift as coming half from each, raising the combined exclusion to $38,000 per beneficiary per year.4Internal Revenue Service. Because the exclusion applies per donor and per recipient, a family can move a lot of money in one year without any gift tax exposure. A married couple with three grandchildren could contribute $38,000 to each child’s 529 for a total of $114,000, and never touch their lifetime exemption.

The Five-Year Election: Superfunding a 529

Section 529 gives donors an accelerator the rest of the gift tax code doesn’t: contribute up to five years’ worth of annual exclusions to one beneficiary in a single year, then elect to spread the gift across five tax years for gift tax purposes. For 2026, that means a single donor can front-load $95,000, and a married couple using gift splitting can front-load $190,000.1Internal Revenue Service. 2025 Instructions for Form 709 – Section: Line B. Qualified Tuition Programs The whole amount goes to work in the account immediately, which is the point of the election: years of tax-free compounding you’d otherwise lose to a slower schedule.

You make the election by filing Form 709 for the contribution year and checking the box on Schedule A for five-year treatment. From there, you report one-fifth of the contribution as a gift each year for five years. Here’s the consequence: your annual exclusion for that beneficiary is already used up for all five years. Any other gift to the same person during the window sits on top of an exclusion that’s spoken for, so it’s a taxable gift. You can still give to other people, and you can still give more to the same person if you’re willing to spend lifetime exemption on the excess. You just can’t shelter another dollar to that beneficiary under the annual exclusion until year six.

Contribute more than the five-year maximum and the excess is a taxable gift in the year of the contribution, though again it can typically be absorbed by your lifetime exemption.

If the Donor Dies Before Five Years Are Up

This is the risk that gets overlooked. Die before the five-year period closes, and the portion of the contribution allocated to years after your death is pulled back into your taxable estate.6Office of the Law Revision Counsel. 26 USC 529 Qualified Tuition Programs – Section: (c)(4)(C) The pull-back is pro rata by calendar year. Contribute $95,000 in 2026 and die in 2028, and the amounts for 2026, 2027, and 2028 stay completed gifts ($57,000), while the amounts allocated to 2029 and 2030 ($38,000) come back into the gross estate. For most donors this changes nothing in practice because the estate tax exemption is high, but it matters for anyone already near the threshold.

The Lifetime Exemption as a Backstop

Excess contributions over the annual exclusion (or over the $95,000 five-year cap) don’t automatically produce a tax bill. They count against your lifetime gift and estate tax exemption, which is $15,000,000 per person for 2026 after the One, Big, Beautiful Bill raised it.7Internal Revenue Service. The practical effect is that almost no one pays actual federal gift tax on 529 contributions. A $200,000 lump sum would only chip a small piece off that $15 million. What you’re really doing when you use exemption during life is reducing the amount available to shelter your estate at death, where the tax rate on anything above the exemption is 40%. The tracking happens on Form 709: even when no tax is due, those filings tell the IRS how much exemption you have left when you die.

Changing the Beneficiary

Moving a 529 to a different beneficiary is common when the original beneficiary gets a scholarship, doesn’t go to college, or ends up with money left over. Whether that change creates a new taxable gift depends on who the new beneficiary is.

Skip-Generation Changes and GST Tax

The picture shifts when the new beneficiary is two or more generations below the old one. Moving a child’s leftover balance to a grandchild is the classic example, and it triggers two things: a new taxable gift from the account owner, tested against the annual exclusion for the year of the change, and potentially the generation-skipping transfer (GST) tax.8Office of the Law Revision Counsel. 26 USC 529 Qualified Tuition Programs – Section: (c)(5)(B) GST tax applies at 40% whenever property passes to someone two or more generations below the donor. You have a separate GST exemption equal to the lifetime gift and estate tax exemption ($15,000,000 in 2026), but it’s used up cumulatively across all your skip-generation transfers.7Internal Revenue Service. Grandparents who funded the 529 originally already crossed a generation. Changing the beneficiary from a grandchild to a great-grandchild compounds it. The clean way to avoid the issue is to keep the new beneficiary in the same generation as the old one.

When You Have to File Form 709

You file Form 709, the federal gift tax return, whenever your total gifts to any single person top $19,000 in a calendar year, or whenever you make the five-year election on a 529 contribution regardless of the amount.10Internal Revenue Service. 2025 Instructions for Form 709 Married couples using gift splitting also file, even when neither spouse individually crossed the exclusion.4Internal Revenue Service. The return is due April 15 of the year after the gift, so a 2026 contribution triggers a return due April 15, 2027. Form 709 can be filed electronically through the IRS Modernized e-File system.11Internal Revenue Service. Instructions for Form 709 (2025) For a five-year election, check the box on Line B of Schedule A, report one-fifth as the current-year gift, and continue reporting the remaining fifths on Form 709 for each of the next four years.

Filing usually doesn’t mean owing. Most 709 filings are documentation: they track your use of the annual exclusion, your lifetime exemption, or your five-year election. Skipping the return when it’s required is the mistake, because failing to file can prevent the IRS from recognizing your five-year election, which retroactively turns what you intended as a sheltered contribution into a taxable gift in the year you made it.
