1099-MISC vs. 1099-NEC: Filing Rules, Deadlines, and Penalties

Use Form 1099-NEC when you paid an individual or unincorporated business $600 or more for services performed for your trade or business. Use Form 1099-MISC for other business payments that are not compensation for services — rent, royalties, prizes not tied to work, medical payments, and gross proceeds paid to an attorney in a settlement. That is the whole distinction between 1099-MISC vs 1099-NEC, and every other difference (deadlines, penalties, how the recipient is taxed) follows from it.

The Dividing Line: Services or Not

Ask one question about the payment: was it compensation for work someone did? If yes, and the recipient is not your employee, it goes on the 1099-NEC.1Internal Revenue Service. Two rules cut across both forms. First, payments to C-corporations and S-corporations are generally exempt from 1099 reporting, but two categories of payments must be reported no matter how the recipient is organized: legal services and medical or health care services.3Internal Revenue Service. April 2025) Second, if you paid through a credit card, debit card, or a third-party network like PayPal or Venmo, do not issue either form for that payment. Attorney payments are the classic trip-up because the same lawyer can generate either form. When you pay a lawyer for legal services rendered to your business, that fee is compensation for services and goes on the 1099-NEC. When you pay gross proceeds to an attorney in connection with a settlement — money that flows through the lawyer but isn’t for the lawyer’s own work — that goes on the 1099-MISC in Box 10.1Internal Revenue Service. What Belongs on Form 1099-NEC

The 1099-NEC captures nonemployee compensation: fees, commissions, prizes, and awards paid to someone who performed services for your business but is not on payroll. A freelance designer, a contract plumber, an outside bookkeeper — pay any of them $600 or more in a calendar year and you owe them a 1099-NEC.5Internal Revenue Service. The recipients who normally trigger the form are individuals, partnerships, LLCs taxed as sole proprietorships or partnerships, and estates. Payments under $600 in the year do not require a 1099-NEC, though the recipient still owes tax on the income. One exception to the threshold: if you had to withhold federal income tax from a contractor under the backup withholding rules, you must issue a 1099-NEC no matter how small the total.1Internal Revenue Service. What Belongs on Form 1099-MISC

The 1099-MISC sorts non-service payments into numbered boxes, each with its own threshold.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)

  • Box 1, Rents — $600 or more for office space, land, equipment, or machinery. Surface royalties on land are reported here rather than in the royalties box.
  • Box 2, Royalties — $10 or more for the use of oil, gas, mineral properties, patents, copyrights, trade names, or trademarks. The threshold is $10, not $600.
  • Box 3, Other income — $600 or more in prizes and awards not earned through services, taxable damages, Indian gaming profits, and certain payments to beneficiaries of deceased employees.
  • Box 6, Medical and health care payments — $600 or more paid to physicians, dentists, or other providers in the course of your business, reportable even if the provider is a corporation.
  • Box 10, Gross proceeds paid to an attorney — $600 or more in settlement proceeds paid through a lawyer that are not fees for the lawyer’s own services.

Less common boxes cover crop insurance proceeds, fish purchased for resale, Section 409A deferrals, and excess golden parachute payments, each with its own threshold in the form instructions.

Deadlines Are Not the Same

The deadlines are the practical reason the IRS separates these forms, and mixing them up is a common source of penalties.

For the 1099-NEC, both the recipient copy and the IRS filing are due January 31 of the year after payment. There is no automatic extension.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)

What the Form Choice Means for the Recipient

Which form you send changes the recipient’s tax bill, so getting it right matters on both sides of the transaction.

1099-NEC Income

Nonemployee compensation flows to Schedule C on the recipient’s Form 1040 and is subject to self-employment tax at a combined 15.3%: 12.4% Social Security on net earnings up to $184,500 in 2026, plus 2.9% Medicare with no cap.6Internal Revenue Service. 1099-MISC Income

Where 1099-MISC income lands on the return depends on the box. Because the tax treatment is different, misclassifying a payment isn’t just a paperwork issue. A prize dropped onto a 1099-NEC would be reported on Schedule C, could incorrectly qualify the recipient for credits like the Earned Income Tax Credit, and could pull IRS scrutiny.8Internal Revenue Service. 1099-NEC and 1099-MISC Income Treatment Scenarios

Penalties for Late or Incorrect Filing

The IRS assesses one penalty for a late or incorrect return filed with the agency, and a second, separate penalty for a late or incorrect statement furnished to the recipient. For returns due in 2026:11Internal Revenue Service. Information Return Penalties

  • Up to 30 days late: $60 per return
  • 31 days late through August 1: $130 per return
  • After August 1 or never filed: $340 per return
  • Intentional disregard: $680 per return, with no maximum

The per-return amounts apply to both the IRS filing penalty and the recipient statement penalty, so a single form that is both filed late and furnished late draws two charges. Small businesses (average annual gross receipts of $5 million or less over the three most recent tax years) get lower annual caps, but the per-return figures are the same.

If You Got the Wrong Form

If you received a 1099-NEC but believe you were actually an employee, you can file Form SS-8 to ask the IRS to determine your worker status. The determination can take six months or longer. While you wait, filing Form 8919 with your return lets you pay only the 7.65% employee share of Social Security and Medicare rather than the full 15.3% self-employment tax on the disputed wages.12Internal Revenue Service. If a payment landed on the wrong 1099 (a prize reported as nonemployee compensation, for example), contact the issuer and ask them to void the incorrect form and issue the correct one.
