If you’re a landlord who received rental assistance, a 1099 for rental assistance may or may not land in your mailbox, but the tax outcome is the same either way: the payment is taxable rental income and belongs on Schedule E. Starting with the 2026 tax year, the reporting threshold for rent on Form 1099-MISC rose from $600 to $2,000, so fewer landlords will see the form even though nothing about the underlying tax obligation changed.1Internal Revenue Service. Whether the check comes from a tenant, a state housing agency, a Public Housing Authority, or a private nonprofit, the IRS treats it as rent.2Internal Revenue Service. Emergency Rental Assistance Frequently Asked Questions The source of the payment doesn’t create a different tax category. You benefited economically from the use of your property, and that’s rental income.
When You Should Expect a 1099-MISC
Two things determine whether a 1099-MISC gets issued: who paid you, and how much they paid you during the calendar year. Anyone making rent payments in the course of a trade or business must file the form once total payments to a single landlord reach $2,000 in 2026, with the amount reported in Box 1 (Rents).3Internal Revenue Service. The form has to be furnished to you by January 31 of the year following payment.4Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information
Government Agencies and Public Housing Authorities
Federal, state, and local government agencies that pay rent to landlords are subject to information return reporting.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC That includes PHAs administering Section 8 Housing Choice Vouchers. Because voucher payments recur monthly across a lease, they usually clear the threshold easily. An $800 monthly voucher payment adds up to $9,600 across the year, so expect a 1099-MISC.
Compliance among government payers is uneven. Some Emergency Rental Assistance programs distributed funds to millions of landlords without issuing a 1099 to every recipient. That doesn’t help you at filing time. Whether or not the form arrives, the income is still reportable.
If a property manager receives the PHA’s payments on your behalf, the property manager may be the party that receives the 1099.
Nonprofits and Private Charities
Nonprofits count as being engaged in a trade or business for 1099 reporting purposes.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC A private charity paying $2,000 or more to a single landlord during 2026 must issue Form 1099-MISC. Nonprofits tend to be more consistent about filing than government agencies, since the penalties for not filing land directly on the organization.
The Corporate Landlord Exception
If you hold your rental property through a C-corporation or S-corporation, or an LLC that has elected corporate tax treatment, payers generally aren’t required to issue a 1099-MISC for rent paid to you.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Single-member LLCs taxed as sole proprietorships and partnerships don’t get this exemption; they’re treated like individual landlords for reporting purposes. Payers figure out your entity type from the Form W-9 you provide, which is why completing that form accurately matters.
The W-9 and Backup Withholding
Before an assistance agency sends you anything, they’ll typically ask for a Form W-9 with your taxpayer identification number. If you refuse to submit one or provide an incorrect TIN, the agency can be required to apply backup withholding at 24% on every payment.6Internal Revenue Service. Backup Withholding The withheld amount goes to the IRS and eventually shows up as a credit on your return, but you lose the cash flow in the meantime. Submit a correct W-9 before the first payment and this doesn’t come up.

Reporting Rental Assistance on Your Return
All rental assistance income goes on Schedule E (Form 1040), combined with any rent your tenant paid directly.8Internal Revenue Service. Federal tax is almost never withheld from rental assistance payments, so keep that in mind when working out estimated taxes.
If a 1099-MISC arrives, the amount in Box 1 should match your total assistance from that payer. When it doesn’t, your own records govern. Bank statements and program award letters showing the covered dates and amounts are what you’ll rely on to reconcile.
Report the gross figure. You can’t deduct maintenance, insurance, property taxes, depreciation, or other rental expenses on Schedule E without first reporting the rental income those expenses relate to.9Internal Revenue Service. About Schedule E (Form 1040), Supplemental Income and Loss
Which Year the Payment Belongs To
Most landlords use cash-method accounting, so income is reported in the year you actually receive it or it becomes available to you. A check received before December 31 counts as that year’s income even if you don’t deposit it until January.10Internal Revenue Service. Publication 525, Taxable and Nontaxable Income
Rental assistance programs are known for slow payments. If a program awards you six months of back rent in 2025 but the check doesn’t arrive until March 2026, the whole amount is 2026 income. The period the assistance was meant to cover doesn’t determine the tax year. When the money was available to you does.
If No 1099 Arrives
No 1099 does not mean no taxable income. The IRS can match payer records against your return whether or not the form ever reached your mailbox, and unreported rental income typically comes back as a notice with additional tax, penalties, and interest attached. If you know you received reportable rental assistance and haven’t seen a 1099-MISC by mid-February, contact the payer. Meanwhile, report the correct amount from your own records on Schedule E.
A Note About the Tenant Side
One boundary worth knowing, because tenants sometimes ask their landlords: rental assistance paid on a tenant’s behalf under a government program is not taxable income to the tenant, and the tenant won’t receive a 1099.2Internal Revenue Service.
