A 1099 for gifts is not something you file, because a genuine gift is not income and falls outside the 1099 system entirely. The catch is that many payments people call gifts are treated as taxable income by the IRS, and those do require a 1099 once they cross the reporting threshold. Starting with payments made after December 31, 2025, that threshold rose from $600 to $2,000 for most 1099 categories under the One, Big, Beautiful Bill Act.1Internal Revenue Service. The Test That Decides Whether a Payment Is a Gift
The Supreme Court set the standard in Commissioner v. Duberstein: a gift has to come from “detached and disinterested generosity,” meaning the giver expects nothing at all in return.2Justia U.S. Supreme Court Center. Commissioner v. Duberstein, 363 U.S. 278 (1960) Intent is what matters. A grandmother wiring $10,000 to her grandchild for a down payment clears the bar. A business owner writing a $5,000 “thank-you” check to a contractor after a good project does not.
Federal law defines gross income broadly as income from all sources.3Office of the Law Revision Counsel. 26 USC 61 – Gross Income Defined A separate provision then excludes property acquired by gift from the recipient’s income.4Office of the Law Revision Counsel. 26 USC 102 – Gifts and Inheritances When a transfer really is a gift, the recipient owes no federal income tax, and the reporting question shifts entirely to the donor’s gift tax return.
The IRS starts from a presumption that runs against most gift claims in a commercial setting: any payment flowing from a business is compensation until proven otherwise. If there is any commercial relationship between the parties, calling the payment a gift will not survive scrutiny without clear evidence there was no business motive behind it.
The 2026 Threshold and Which Forms Apply
For years the reporting trigger was $600. The One, Big, Beautiful Bill Act raised it to $2,000 for payments made after December 31, 2025, and the amount will adjust for inflation starting in 2027. Below the threshold, no 1099 is required, but the underlying income is still taxable to the recipient. The 1099 is only an information report; its absence does not make a payment tax-free.
Two forms carry most of the traffic. Form 1099-NEC reports payments to independent contractors and other nonemployees for services.5Internal Revenue Service. Either way, the filing obligation sits with the payer, not the recipient, and only applies to payments made in the course of a trade or business.
Payments That Look Like Gifts but Are Not
This is where most of the mistakes happen. Writing “gift” or “bonus” on the memo line does not change the character of the payment if there is a business relationship underneath it.
- A contractor bonus for great work is still compensation for services. If total payments to that contractor exceed $2,000 in 2026, the full amount belongs on Form 1099-NEC, Box 1.7Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
- Prizes, raffle payouts, and sweepstakes winnings are taxable even when the recipient did nothing to earn them. Report them on Form 1099-MISC, Box 3, at $2,000.7Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
- Referral fees are payment for a service. Add them up across the year and issue a 1099 if the total to any one person crosses $2,000.
- Non-cash prizes are reported at the fair market value of the item at the time of the award.8Internal Revenue Service. General Instructions for Certain Information Returns
The donor’s good intentions do not save any of these. If the payment has any connection to work performed, goods delivered, or a commercial relationship, the IRS treats it as income.
Employer Gifts to Employees Are Wages
Federal law directly strips the gift exclusion away for anything an employer transfers to an employee.9Office of the Law Revision Counsel. 26 USC 102 – Gifts and Inheritances A holiday cash bonus, a year-end check, or an envelope handed out at a company party is wages. It goes on the W-2, with income tax withholding, Social Security, and Medicare. No 1099 is involved because the correct form is a W-2.
The narrow exception is the de minimis fringe benefit: something so small and administratively impractical to track that the IRS ignores it.10Office of the Law Revision Counsel. 26 USC 132 – Certain Fringe Benefits A holiday turkey, flowers after an illness, or occasional branded merchandise can qualify. Cash and cash equivalents never do, no matter how small. A $25 gift card is taxable wages; a $25 ham is not.
Gifts to Clients and Customers
A business can deduct only $25 per recipient per year for gifts made directly to individuals outside the company.11Office of the Law Revision Counsel. 26 USC 274 – Disallowance of Certain Entertainment, Etc., Expenses That cap has held for decades and applies regardless of business structure. A genuine $25 gift to a client does not trigger a 1099, because the item is not income to the recipient. But hand a client something of value in exchange for a referral or any other service, and the transfer stops being a gift. Once payments to that person cross $2,000 in the year, a 1099 is required.
Crowdfunding and Payment Apps
The same law that raised the 1099 threshold reset Form 1099-K reporting to $20,000 in gross payments and more than 200 transactions per year, reversing the lower thresholds that had been proposed in recent years.12Internal Revenue Service. IRS Issues FAQs on Form 1099-K Threshold Under the One, Big, Beautiful Bill Dollar Limit Reverts to $20,000 Both conditions have to be met before a third-party payment network like PayPal or Venmo issues a 1099-K.
For crowdfunding, the tax treatment tracks what the contributor gets back. Donations to a GoFundMe out of pure generosity, with nothing given in return, are gifts. No 1099 is involved and no income is recognized. When contributors receive a product, a service, or another tangible benefit for their money, the transaction is a sale, and the proceeds can be reportable income. The payment processor handles any 1099-K if the thresholds are met, but the income is taxable to the campaign organizer whether or not a form is filed.
When It Really Is a Gift, the Donor May File Form 709
If the transfer genuinely qualifies as a gift, the recipient has no filing obligation and no tax liability. The reporting responsibility shifts to the donor through the federal gift tax system, which is entirely separate from 1099 reporting.
For 2026, you can give up to $19,000 per recipient with no reporting at all.13Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026, Including Amendments From the One, Big, Beautiful Bill Give $19,000 each to ten different people and nothing needs to be filed. The exclusion runs per recipient, per year.
Once gifts to any one recipient exceed $19,000 in the year, the donor files Form 709, the federal gift and generation-skipping transfer tax return.14Internal Revenue Service. About Form 709, United States Gift (and Generation-Skipping Transfer) Tax Return Filing does not automatically mean tax is owed. The excess reduces the lifetime exemption, which is $15,000,000 for 2026.15Internal Revenue Service. What’s New – Estate and Gift Tax Because that cushion is so large, very few donors actually pay gift tax. Gifts to a U.S. citizen spouse are unlimited under the marital deduction; gifts to a non-citizen spouse are excluded up to $194,000 in 2026. Form 709 is due April 15 of the year after the gift, with a six-month extension available, though any tax owed is still due by April 15.
Fixing a 1099 Issued for What Was Actually a Gift
If you issued a 1099 for a payment that was truly a non-taxable gift, correct it as soon as possible. Prepare a new version of the same 1099 form with the corrected information (zero in the payment box), check the “CORRECTED” box at the top, attach a new Form 1096 transmittal, and send both to the IRS.8Internal Revenue Service. General Instructions for Certain Information Returns Furnish a corrected copy to the recipient too, so they are not stuck reporting income that does not exist. Move quickly, because the IRS matching program will flag the mismatch if the recipient has already filed. Voiding is different from correcting; the VOID box only helps if you catch the error before submitting to the IRS.
Penalties for Getting the Call Wrong
Treating a payment as a gift when it was really compensation, and skipping the 1099, exposes you to information return penalties. For returns due in 2026:16Internal Revenue Service. Information Return Penalties
- Filed within 30 days of the due date: $60 per return
- Filed after 30 days but by August 1: $130 per return
- Filed after August 1 or never filed: $340 per return
- Intentional disregard: $680 per return with no maximum cap
Penalties apply separately to filing with the IRS and to furnishing the statement to the recipient, so one missed 1099 can generate two hits. The intentional-disregard tier applies when the IRS concludes you knew you should have filed and did not, and at $680 per return with no ceiling, the exposure grows quickly for a business with several contractors. That risk is the reason to work the Duberstein question honestly at the front end rather than sort it out later.
