Copy A of Form 1099 is the version that goes to the IRS, and getting it there means filing on the correct form by the correct deadline through the correct channel. For most businesses now, that channel is electronic: if you file 10 or more information returns of any kind in a year, the IRS requires you to e-file them.1Internal Revenue Service. What Copy A Is and Where It Goes
Every 1099 has multiple copies, each with a different destination. Copy A goes to the IRS. Copy B goes to the payee so they can report the income on their own return. Copy 1 goes to the state tax department when the state requires it. Copy C is your file copy. The distinction matters because Copy A has formatting rules the other copies don’t, and sending the wrong version to the IRS can be treated as a failure to file.
How to File Copy A
Electronic Filing Through IRIS or FIRE
The 10-return threshold aggregates across form types. It’s not 10 of each 1099. It’s every information return you file combined, including W-2s submitted to the Social Security Administration. A business filing six 1099-NECs and four W-2s hits the threshold and must e-file everything. The IRS runs two electronic filing platforms. The newer Information Returns Intake System (IRIS) is a free web portal where you can key in return data, upload a CSV, or connect through an application-to-application channel. The Taxpayer Portal lets you file up to 100 returns at a time and download payee copies.3Internal Revenue Service. E-File Information Returns With IRIS The older Filing Information Returns Electronically (FIRE) system still works but is scheduled for shutdown after the 2026 tax year, leaving IRIS as the only intake system starting in filing season 2027.4Internal Revenue Service. If you use a payroll service or accounting software to transmit returns, confirm which system it uses and whether it holds a TCC on your behalf.
Paper Filing and the Red-Ink Rule
If you’re under the 10-return threshold and choose paper, Copy A must be printed on official forms in a special red ink that IRS scanning equipment can read. You cannot print Copy A from the IRS website, photocopy it, or generate it from accounting software.5Internal Revenue Service. Every batch of paper Copy A forms must include Form 1096 as a cover sheet summarizing the count and dollar totals. You need a separate Form 1096 for each type of return you’re filing. Deadlines and Extensions
The deadline depends on which 1099 you’re filing and whether you’re on paper or electronic:
- 1099-NEC: January 31, whether on paper or electronic. Same date you must furnish Copy B to the payee.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
- 1099-MISC and most other 1099 forms: February 28 for paper, March 31 for electronic. For 2026, February 28 is a Saturday, so the paper deadline shifts to March 2, 2026.9Internal Revenue Service. General Instructions for Certain Information Returns (2025)
Need more time? File Form 8809 before the due date to request a 30-day extension. For most 1099 forms other than the 1099-NEC, the extension is automatic and requires no justification. The 1099-NEC is different. Extensions for it are not automatic. You must submit a paper Form 8809 with a written explanation signed by an authorized person, and only one 30-day extension is available. The IRS deliberately made 1099-NEC extensions harder because the January 31 date was set to get contractor income data in early and curb refund fraud.
Getting the Payee Data Right Before You File
The most common trigger for a Copy A penalty isn’t lateness. It’s a wrong or missing Taxpayer Identification Number. Before filing, check every payee’s name and TIN against the Form W-9 they gave you.

If a payee refuses to give you a valid TIN, you can’t just file a 1099 with a blank field and move on. Federal law requires you to withhold 24% of the payment as backup withholding and remit it to the IRS, reporting it on Form 945.12Internal Revenue Service. Fixing Copy A After You File
How you correct depends on what went wrong and how you originally filed.9Internal Revenue Service. General Instructions for Certain Information Returns (2025)
For a wrong dollar amount, code, or checkbox, or for a return that shouldn’t have been filed at all, prepare a new 1099 with the “CORRECTED” box checked, enter the correct information, attach a new Form 1096, and send it to the same processing center. That’s a single correction.
A wrong payee name or TIN takes two steps. First, file a corrected return that zeros out all the dollar amounts on the original incorrect return, with the “CORRECTED” box checked. Then file a brand-new original return with the right payee information and the actual dollar amounts. The two-step process lets the IRS remove the bad record and create the right one.
If the original was e-filed, corrections must also be e-filed. Paper corrections apply only when the original was on paper. For large-scale errors or duplicate filings, call the IRS Information Reporting line at 866-455-7438 before submitting a batch of corrections.
What It Costs to File Late or Wrong
Section 6721 penalties are per return and escalate the longer the problem sits. For returns due in 2026:13Internal Revenue Service. Information Return Penalties
- Corrected within 30 days of the deadline: $60 per return.
- Corrected after 30 days but on or before August 1: $130 per return.
- Filed after August 1 or not filed at all: $340 per return.

Small businesses with average annual gross receipts of $5 million or less get annual caps: $239,000 for the 30-day tier, $683,000 for the August 1 tier, and $1,366,000 for the after-August-1 tier.15Internal Revenue Service. IRM 20.1.7 Information Return Penalties Larger businesses face higher caps. Intentional disregard has no cap regardless of business size, and can rise to 10% of the total amount that should have been reported if that exceeds $680 per return.
Because these apply per return, volume matters. A business that files 200 late 1099-NECs after August 1 is looking at $68,000 in potential penalties before any cap. The gap between fixing a TIN error in February and letting it ride until September is roughly six times the per-return cost.
State Filing Through CFSF
Filing Copy A with the IRS may or may not cover your state obligation. Many states require their own copy of 1099 data. If your state participates in the IRS Combined Federal/State Filing program, the IRS forwards your electronically filed 1099 data to the state tax agency, which can eliminate a separate state filing.16Internal Revenue Service. Not every state participates, and only electronically filed returns are covered. If you file on paper or your state isn’t in the program, send Copy 1 directly to the state tax department. Confirm with your state’s tax agency whether it participates and whether any additional state-level filing is required.
